Trouble in unacceptable green card application

Hi all,

This is to seek ur kind comment and idea. My brother has gone to U.S by married to U.S citizen. It was an arrangement married. They didn't love each other. After got in U.S they were live seperately. While my brother applied for green card, there was something bad happen. The local government has stated that this a fraud married because his wife's boyfriend brought this statement to. The local authority has offered two choices: 1) recall back his green card application; 2) continue the application process but they sure that finally it would be declined n he will be deported. Now brother obtained option 1. But does anyone know what should he do next? Need he find the attorney or jus keep living like this? Can he apply for college? He is so depress now. As sister, I can't help a thing. I feel bad and sad. :(

The best thing he can do is get on the plain and return home. Since they already suspected it is a fraud there is nothing he can do. Better to leave now if he ever want to return to USA.

It would be good idea to just return home and continue with life there….. none of the agency would make any such comment unless they have solid proof of fraud in the case.

If the marriage was deemed only for the purpose to obtain the greencard your brother and his wife are not living together…. Which essentially is a visa fraud.

Well if it was an arranged marriage, and they didn't love each other, and never even lived together, then it WAS a fraud marriage. Not much chance he will be allowed to stay in the US. If he decides to stay and goes all the way to being deported, he will pretty much never have a chance to come back, for at least like 10 years. If he leaves now, his chances are still very slim of getting another visa here, but yes, at this point, he doesn't have much choice except to go home.

I know it's hard to hear, but he came on a visa to get married. If the marriage is fake, then it's fraud, and he isn't allowed to stay in the US.

But he's not going to be allowed to stay in the US, even if he became a student. Now that they suspect him of fraud, there isn't much he can do. Hiring a lawyer would just cost a lot of money and he would still not win probably.

His best option is to wuthdraw the application an go home.

The entire purpose of family based immigration is to reunify families. The US granted your brother a visa to come live with his wife. He is not doing that, so it is visa fraud.

If he proceed, he will suffer the consequences of deportation and a ban from the US.

College is not possible without a green card or student visa.

A lawyer cannot help when your brother does not have a real marriage.

Depressed because ? Was his intent to live with his wife or just go to US ? Only thing he should do is leave US - this whole case screams fraud (arranged marriage ?) Fortunately is his position he has no way of legally living in US.

I agree with this statement 100%. This is the reason USCIS is so hard on real couples.

As for the OP, your brother is committing visa fraud and should leave the US as his petition will be denied and he will be arrested and deported. A lawyer will not help. A lawyer cannot assist in any illegal activity. You already admitted that your brother only married this woman to come to the US. Which she was probably paid for. So he should just pack up and leave the US.

Come on people, you are jumping on that situation because they stated, that they never loved each other. It was an ARRANGED MARRIAGE!!! Happens sooo many times here (many other VJ'sdibs the same because it's normal in their culture!) & you can't expect them to love each other ... They have to learn to love eachother. But as soon as somebody can scream scam or fraud you are in. But I do have an opinion about it & have to agree with most of them, that your brother should return home. It's not worth fighting for something that he's not able to win. I am so sorry about his situation!
