my fiancé is coming over here in the US nxt month and we're planning to get married in august but a friend of mine said that we have to get married after 60 days of his arrival here in the US otherwise the USCIS will deny him when he applies for an adjustment of status... is there really a 30-60 days rule of getting married

for a k1 visa? help please!

There is no rule, and your friend is completely wrong. A K-1 visa is specifically designed for someone to come to the US to marry and immigrate.

No, you are getting bad information. For a K1 you must get married within the 90 day window. Can be day 1 or day 90. Cannot be day 91 or beyond.

K-1 visa you must be married within 90 days unless there is some sort of emergency then you can try and file for an extension but they are difficult to obtain. If you are planning a wedding and its past 90 days get a civil marriage before 90 days just to make sure you don't miss the deadline.

Like R said, any time in-between, example, in 2 weeks after arrival she got (applied for) social card, In one month got married, filed AOS before the 90 days was up just to be safe. The IO noticed our promptness and commented it was good to do it that way.

First of all, if your fiance is coming to America to marry you, he needs to have a K1 visa which is a 1 entry permit into the united states. If he doesnt have a K-1 visa when he enters and you marry him then you will be applying for adjustment of status after you marry. However, i am sure if you come up with a wonderfull love story to USCIS that your fiance strolled on in to the United States with the intent of Marrying you and he did not have a K-1 in his possession that will probably raise an eyebrow. Lets just confirm he has or will have a K1 visa and will be using the K1 to enter the US.

Then as said earlier day 1 to 90 is ok.

If he is entering on something other then a K1 with the real intention of getting married there could be major problems.

You have filed for a K-1 visa right? You asked this in the K-1 visa section, that is why everyone is responding to you re: K-1, but you have no timeline or any information so no one can be sure.

If you do not have a K-1 visa and your fiance(e) is planning to come to the US on a visitors visa and then you plan to adjust his/her status from a visitors visa to a legal permanent resident- that is not allowed.

thanks everyone! and yes, my fiancé just got his K1 visa last week and will be coming here very soon(thank Goodness!) I just got worried hearing what my friend said to me as I already planned of setting our wedding date for August 8...

When your fiance comes through his POE, after inspection from a CBP officer, he'll receive a i-94 form with the date of entry to the US AND they will also add the limit day on which you should get married. You should get married by that date.

Beware of this, because even though we all know we have 90 days to get married from the time we set foot on US soil, it's happened before (though rarely) that the CBP officer set an earlier date on the i-94. So, just make sure to read that piece of documentation as soon as he arrives.

For example: I came through the POE on April 23rd, 2012 and our deadline to get married (written on the i-94) is July 21st, 2012.
