Hi good day,

I need someone to help me, im a permanent resident since 2006 and have decided to go to America, have never lived permanently for more than 6 months in the U.S. since I have my green card, by the way I have 2 children who are U.S. citizen, so my question is: I have been with the father of my children for 8 years, but are not married, and I want to get married ask as green card holder, it is possible, are in the U.S. as a tourist, what should I do?

Do you still have a valid green card? Is your future husband a US citizen?

coming the the US on a visitor visa with the intentions of getting married is fraud. It isn;t a visa to get married, it's a visa to visit.

ur husband can come on a visitor visa and you can get married but he would have to leave before the date on his i-94 card is up, during this time you can apply for a green card for him (process is around 2.5yrs now) during this time if his visitors visa is still valid he can visit for short periods once he can prove that he has the intention to return to his home country

A foreign national cannot legally enter the US on a tourist visa with the intent of getting married, that would be fraudulent use of the visa.

Read above - totally incorrect. You can legally enter on a tourist visa to get married, you can't enter with intent to stay.

Of course you can enter on a tourist visa and get married, nothing illegal about that. As others have pointed out, you cannot enter the US, marry, and then stay and adjust status.

I arrived at the US a year ago on VWP, got married to my LPR husband at the end of June, had a wonderful honeymoon in the US, and then returned to Germany at the end of July and went back to work. All perfectly legal.

My F2A/IR-1 journey:

USCIS:
4 August 2011: I-130 sent (while husband permanent resident)
8 August 2011: Priority date
16 April 2013: NOA2

NVC:

7 May 2013: Case number received, DS-3032 sent

15 May 2013: AOS bill received and paid

16 May 2013: AOS package sent

17 May 2013: DS-3032 accepted

20 May 2013: IV bill received and paid

21 May 2013: IV package sent

11 June 2013: response to IV checklist sent

13 June 2013: Case upgraded to CR1

2 July 2013: Case completed

28 August 2013: Interview - approved!

21 September 2013: POE

18 November 2013: Green card received

Of course you can enter on a tourist visa and get married, nothing illegal about that. As others have pointed out, you cannot enter the US, marry, and then stay and adjust status.

I arrived at the US a year ago on VWP, got married to my LPR husband at the end of June, had a wonderful honeymoon in the US, and then returned to Germany at the end of July and went back to work. All perfectly legal.

You are correct, I was not complete with my explanation, I did not include the intent to immigrate.

I would think that they would refuse admission at the POE for anyone declaring intent to marry upon entry.

I would say the scrutiny at the POE and the chances of getting denied entry would be much greater, but it does happen.

There were multiple occurences here at VJ when people declared it and were not denied.

Exactly. I also told the officer at POE that I was coming to the US to marry. He asked me a couple of questions but did not want to see any proof of ties back to Finland or Germany, and did not even ask to see my return ticket.

I'm extremely confused. You are a green card holder since 2006 who has never permanently lived in the US? Well, you probably aren't a green card holder anymore or soon won't be. Your fiance ... are you asking if you can petition them for a GC or if they can petition you for a new GC? What is their nationality and where do they live?

OP, we need more info to help you:

- How long since you last were in the USA? Do you still have ties there (valid drivers license, furniture in storage, cell phone bill etc)?

- Are you saying you want to marry a US citizen, or is your fiance from your country?

- Are you currently in the US as a tourist, do you hold a tourist visa and intend to get married on it, or what?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
