Hello,

I have a question, my who father who is a natural born USC was abducted from the US by his mother (a case of parental abduction) at the age of three while his father ( my grandfather ) was sleeping. so he only has 3 years of phyiscal presence out of the 5 years required. Is there a way for me to obtain citizenship through my father even though he doesnt meet the required physical presence? I am 23 years old now. In the US of a student visa.

If anyone has an idea please do write me.

Did he return to the US at any stage? If not then no. You cannot obtain citizenship through him directly.

He will need to return to live in the US (if he hasn't already) and sponsor you for a greencard and then 5 years from getting that you will be eligible for citizenship.

I thought the OP's father is a natural born citizen and a child born to USC OP should be eligible for USC. Why not?

there's a requirement for 'boots on the ground' time in USA. I don't think the father qualifies.

To pass on US Citizenship if a baby is not born in the USA, the USC parent must have spent 5 years in the USA, at least two after the age of 14.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

As others said, you need to live in the country for a certain time before you're eligible to pass it on (unless the kid is born in the US of course). For example I have UK citizenship but I can't pass it on either because I haven't lived in the UK for long enough. I would have to return there and live there BEFORE my kids are born. I am also Australian and have lived there for most of my life (excluding time here in the US of course :P) so I can pass that on no matter where my kids are born.

Like everybody told you already:

1. Your father can apply for you to receive a greencard

2. after living in the USA for 5 years as a greencard holder you can apply for US-citizenship

The only way he could do that now is if he decides to take up residence in the US. He can then file an I-130 petition on your behalf for you to apply for a green card. After five years of living in the US on a green card, you may apply for US citizenship.

He can't file an I-130 for you unless he's planning to live in the US, since family based immigration is based on uniting families.
