Can someone advise exactly what department in USCIS to call and how I should approach them?

I would call ICE first (details at the bottom of the page) and they'll let you know what else to do. Let them know the amount of evidence you have and the information on her fiance. How you'd been together while processing her K1 for that guy and you don't think he knows that she is scamming him either.

Lucky for you - there's not any AOS on the two of you, at all (Adjustment of Status)

the I-134 you signed is a non-binding document, unlike the I-864 that's submitted with the adjustment of status paperwork.

So ya dodged that bullet.

She's already here, from what I can tell.

Sure, report her to ICE...

Send a POSTAL LETTER into

1. National ICE office

2. Local ICE office inside the local USCIS office

3. US Embassy IV Unit in Columbia

USCIS really won't do anything unless she's out of status, past the expiration date on her I-94.

She can't legally adjust status without the K-1 petitioner (that's you) going forward with filing the Adjustment of Status paperwork, after marriage.

I'll guess she'll go underground in a bit, as the noise level increases.

Agreed. Though Darnell is highly respected here maybe he overlooked some posts and how this happened in the first place. The OP Cannot be the Petitioner. The beneficiary seems to slick for that and is aware of what she is doing.

I don't see how this is an immigration issue at all.

Colombian scammer fishes for guy to send her money. About 99% of men immediate realize that this means a scam, but that 1% is willing to send thousands of dollars via Western Union (2nd. hint with a sledgehammer) to the scammer. This has nothing to do with immigration, but with education and the lack of common sense of a guy who got a few expensive private lessons.

Next time you want to get laid, call a professional or go to a bar and spend a few thousand dollars there on some mighty fine Lady. If you're looking for a wife, step away from the computer.

OP, you are not getting any sympathy or support from the cast of characters here. But I say, send off a letter to the USCIS with her identifying information, reporting her as misrepresenting herself to you, a US citizen. She lied and defrauded you out of $1000s of dollars. If any of us was to do that to someone else, that would be a felony punishable under US law. I don't know why the peanut gallery here is so supportive of a Columbian scammer. Good luck to you, and make her answer some questions come her interview day with the Consulate. Your letter will stay in her file, and she will get a comeuppance! Good luck!

We agree. So the OP should go on record and let the USCIS know. Something called "character" comes into question, and the new fiancee has a right to know what he is getting into. Pffft!

She duped me. I never followed through with the petition because I didn't get all the info I needed from her. The other guy filed the visa.

As others already said, yours isn't an immigration issue.

You (probably) won't see her or your money (definitely not) again so move on and get a life. Lesson (hopefully) learned.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
