My Fiance filed for K1 visa for me we got approved and got the visa since July. I planned to travel Jan10 to the US as the visa expires Jan21st, unfortunately we had a bad misunderstanding and he does not want to see me. Does this jeopardize my chances of getting a K1visa in the future. Thanks you

Wow sorry to hear of your news. I would think you two went through a lot to get to this point where you are coming to America. I do hope you two can get past the misunderstanding before your K1 visa expires. It is only good for traveling before the expiration date so I am not sure what you mean when you ask if it will still be good in the future.

It has an expiration date. It can not be used beyond that date of expiry so yes... if you don't travel by then you won't do it with this visa you will have to apply for another one. Im really sorry for the troubles... maybe you guys can still patch things up and at least travel here to see if everything will work out. Good luck...

The K1 visa is valid for 90 days upon your arrival, so if you arrive there on Jan 20th you will be able to get married until April 20th.

Apply for K1 visa in future?

You already have K1 visa which is getting expired soon. Get married soon, else you would have to leave the country.

Try to talk to with your beloved one, and see if you guys can make the things work out.

If I'm understanding your post correctly, you are in the US on a K-1 Visa . (Or are you in the US?)

1. If you are in the US LEAVE before 90 days and Cancel the Petition. You can refile later.

2. If you are Ouside the US Cancel your Petition. Immediately!

SAME ANSWER. Then you can legally refile later.

Caution: If in the US, don't overstay.

Why do all this and change your mind. Thats an individual decision.

If you don't plan to marry then don't use the visa. Every visa has rules regarding what your intentions may or may not be when you enter the US. The K1 visa requires that you intend to marry the petitioner when you enter the US. If you don't then you're misusing the visa. If USCIS or Department of State finds out then that could scuttle any chances of getting a visa in the future. The CBP officer who admits you may ask some relatively benign questions, but your answers could seal your fate forever with US immigration. For example, what if he asks "When are you getting married?". If you tell the truth then you won't be admitted. If you lie and give a fake date, and it's later discovered that you lied, then you could be determined to be guilty of material misrepresentation. Intent to marry is required with a K1 visa, and any answer to any question about marriage would be material to determining if you should be admitted to the US.

If you apply for a K1 visa in the future then they won't deny it simply because you had a previous K1 through the same petitioner, but didn't use it. However, you could certainly expect the previous K1 to be a topic of discussion at your next visa interview.

There was a tension argument here before about K-1 Visa purpose. Some VJ'ers think that K-1 Visa is use to getting know each other personally after enter to US soil. If the thing is not worked out, the beneficiary can leave the country before the K-1 visa expires. Others did striking encountered very hard said K-1 Visa is use to getting married in US within 90 days and it states clearly by having Letter of Intent to Marry is signed . I think many people somewhat get confused what is purpose of K-1 visa actually.smile.gif

No you wont have a problem in the future as long as you do nothing wrong and dont use the visa for anything its not suppose to be used for. Now if you want to use it and come here and with intensions of getting married to him but no marriage takes place, then you need to leave before the 90 days is up, and then still you will not have a problem in the future .

Agreed. The K-1 Visa is not TO GET TO KNOW EACHOTHER better or she can come see your house. However, the 90 days is there for a reason. Will it work and do each of the parties fell the same way. In this case, there are doubts. Better they split and leave the doubt behind. If it was Love, there would be No Doubt.

Thanks for your reply. I am not in the US yet I live in England but was going to travel to the US on the K1visa to spend few days and return before it expires. Also if we want to cancel the petition do we call USCIS?
