WHY USCIS isnt approving I-130 MUST READ

??? I think you mean that you hope the trend reverses. Otherwise your I-130 approval (and mine) will take longer. I believe the point of the original post was to highlight why I-130 approvals were going so slow at the present time.

Here's to hoping that they start working more intently and exclusively on I-130s in the near future.

You make me laugh, :rofl: . You are so frustrated, you are judging all the time.You speak about the reality, but please don't be UPSET for nothing. I think that in real life as you mentioned before you must be human, to be understanding,to help the others as much as you can, to have a believe. Each people have the right to an opinion and I have told you mine. By the way about the five months goal from USCIS as you have already seen in the other post's and spreadsheets a lot of people have been approve earlier than 5 months and a lot of people later, but the hope of every VJ filler is to be with the loved one asap and this is hope and also reality life. :thumbs:

What does USCIS stand for..all the same place just different place they handle part of the file or case.

Same as the department of Justice, department of State..department of defense .....

all the same government.......just different agencies doing different things

...and like what everyone has been trying to say, USCIS DOES NOT ISSUE VISAS. THEY EITHER APPROVE THEM OR DENY THEM. :whistle:

Dude, you obviously don't understand how the U.S. government works. I am in my 36th year of working for the U.S. Government and I can tell you that many times the left hand doesn't know, and many times doesn't care, what the right hand is doing.

Most men can easily leave children with ex's taking care of them and trot off to another country and be with their loved one. It's not so easy for women here on VJ who meet and fall in love with a man who can not travel to them while the woman is raising their minor children. Besides if you have minor or teenage children, these children do not want to uproot their lives and trade their USA life in for a country they know very little about or does not understand the language. Besides their biologocal fathers would not sign for them to have passport to leave the country permanently.Women are not in good positions to leave everything like some men can. I am not saying you have children oo have done this but you need to be understanding and sensitive to the fact not all are lucky as you. Can we just leave our $21 plus jobs and stability behind?....

Im not frustrated in writing this, my husband came through a high fraud interview passed and will be here in a few days WITHOUT AN ATTORNEY and I did everything by website and friends here at VJ. A lawyer can't do anymore for you than what you could do for yourself, in my opinion.

No, USCIS neither approves or denies visas. They approve or deny petitions. Approved petitions allow beneficiaries to apply for visas that are either approved or denied by Consular Officers who work for the Dept. of State.

Facts are cheap...knowing how to use them is precious...

INS is not a new name for USCIS. USCIS is the new name for the old INS.

USCIS doesn't issue, approve or deny visas. They are involved in many visa processes but it is important to realize they don't make decisions about visa issuance. They approve petitions. It's not the same. US State Department and US Citizenship and Immigration Services are both agencies of the US goverment but DIFFERENT agencies.

It's critical for people going through the family based immigration processes to understand these disctinctions.

Immigration is run by the government but does not issue visas.

USCIS (DHS) basically gives the State Department permission to issue a visa which is outside of it's realm of jurisdiction.

The government is not all the same. For example FBI is not the same as the USPS and they are still government. So dont lump everything together its not all the same. Even if they work together!

The National Processing Volumes and Trends graph does show a recent increase in volumes of pending petitions. However, compare the numbers to the numbers of pending petitions for the last few months of 2008. Overall, even if we seem to wait for too long because we are anxious to get our petitions approved, we might still end up waiting less than people who sent their petitions a couple of years ago. In life you can choose to see the glass half empty or half full... Why get upset? There is nothig we can do to change the number of USCIS workers adjudicating I 129F and I 130, so we are better of waiting for our turn with a positive attitude.

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

Am I the only one who read the OP and thought, "temporary protective status visas are probably more important than spousal ones"? When you jump into this process, you have to realize that YOU'RE NOT THE ONLY ONE WAITING. OMG! Get over it and have some patience!

Just be happy you aren't waiting in line for an interview for a spousal visa at the embassy in Ghana. That line is over a year long. That's right - people with processes that closed in December, 2009 are still waiting to hear the glorious news about an interview. My husband isn't even in the line yet - almost, but, not yet. Now that's something to complain about - and we have to no avail. But, we all hang in there because it is what is and our marriages are worth the wait. :thumbs:
