10 year IR1 green card given after AOS from K1

Hi everyone,

 

I received my green card today, after a successful AOS from my K1 visa. I was expecting to get a 2 year green card with conditions attached to it, but I have actually been given a 10 year card which says IR1 in the category space and I understand that this is unconditional. I don't want to run into any problems down the line if this has been given to me in error and I should have reported it or something... is it common to just be given a 10 year IR1 card for some reason, as opposed to the 2 year conditional one?? If anyone has any thoughts, please let me know. If it's a totally normal thing, I'll just celebrate extra hard!

It says 

Card Expires: 01/23/28

Resident Since: 01/23/18

 

I was expecting a 2 year card, but this has arrived instead. If this is something that happens sometimes after a K1 AOS, then I suppose it's fine. I just don't want to jeopardize anything in the future if this is not right.

That's what I was afraid of. Is there any chance I've been given a 10 year unconditional card on purpose for some reason? As I understand it, I simply won't have to go through ROC with this card in my name. But obviously, I don't want to get into any trouble if this is absolutely not correct and not something that they do sometimes with K1 AOS cases.

i think it is great they issued you 10 year card but i don`t know whether it is mistake or not.  You can schedule an appointment with the local field office to see what they say just in case.

NO! This was an error that needs to be corrected!

 

You will need to make a service request to change the card.

If you were married for at least two years on the day your I-485 was approved then you should receive an unconditional 10 year green card. 

 

If you were married fewer than two years on the day your I-485 was approved then you should have received a two year green card.

Thanks everyone - you've all been helpful and confirmed what I was fearing. I've got an infopass appt for later this week, and hopefully it will be an easy thing for them to fix. After they lost my original medical results, I thought I was done with USCIS for this part of the journey... apparently not!

Oh no, we only got married last August and I filed the I-485 3 weeks after the wedding. So I'm sure I'll be saying goodbye to my lovely new 10 year card and getting a 2 year one instead.

Then yes, you would file an I-90 on the basis of a USCIS error. 

 

There is no filing fee under that category.

File an I-90 to replace that green card then request an I-551 stamp on your passport when you visit your local USCIS field office at your infopass appointment. The stamp will be your proof of lawful permanent residency for employment and travel purposes until you get another card. Your new card should arrive several months down the road. Your I-90 will be free since it’s not your fault.

This unfortunately isn’t going to be an “easy fix” at an infopass. You’ll have to file an I-90 for a replacement card and send in this current card with the filing. It will take several months for a replacement card to get sent, so you’ll need to get an I-551 stamp in the meantime. The good news is since this is a USCIS error,  there’s no fee associated with your replacement filing.

I think the visa officer has the discretion to issue GC with a 2  or 10 years validity. My friend got it with 10 years validity though he was married for less than a year when they applied. I think it depends on how satisfied the officer is about the evidence provided. 

 

PS: His wife was a GC holder and they were both in the USA for the interview.

There is a french blog about a woman who got the 10 years GC right after the k1 visa aswell and she just kept it.. Apparently it's from having great evidences, a smooth case and the officer being satisfied with.. I higly doubt they would make such a "mistake"
