Stories like these makes you wonder if it isn't easier to be illegal.

i also asked the same question after reading the story. i feel like they make it difficult for those who are trying to do the right thing. and dare you slip up in your immigration journey....and you are doomed. you will need to pay butt loads of money to some immigration lawyer.

As a military wife who did DCF I can't help but wonder what were they thinking? There are military bases in Germany where he could've gotten assistance. Consulates are also ready to assist - those american citizen services appointment times. And yes, an ordinary person CAN successfully complete the forms and mail them off - not rocket science.

The sad thing here is that they didn't even look into what it would take to get her here legally until after she'd already left the country on a VWP Overstay and was detained trying to enter again.

Seriously, the system didn't fail them, they failed by depending on assumptions.

The point is that the US government is effectively stealing money and deceiving its citizens into thinking that the process works.

Legal family based immigration is fundamentally broken and needs to be fixed NOW. Someone needs to slap the State Department for forcing anyone to go to Juarez, Mexico.

The difference between the U.S. and Mexico is that illegal immigrants there are thrown into a wet prison cell for a couple of years before being deported. Another difference is that Mexico has second class citizens, literally. Foreigners also need a Fideicomiso when buying property in Mexico.

The U.S. slaps illegal aliens on the buttocks, Mexico kicks their teeth out.

Viva Mexico?

There is no room in this country for hyphenated Americanism. When I refer to hyphenated Americans, I do not refer to naturalized Americans. Some of the very best Americans I have ever known were naturalized Americans, Americans born abroad. But a hyphenated American is not an American at all . . . . The one absolutely certain way of bringing this nation to ruin, of preventing all possibility of its continuing to be a nation at all, would be to permit it to become a tangle of squabbling nationalities, an intricate knot of German-Americans, Irish-Americans, English-Americans, French-Americans, Scandinavian-Americans or Italian-Americans, each preserving its separate nationality, each at heart feeling more sympathy with Europeans of that nationality, than with the other citizens of the American Republic . . . . There is no such thing as a hyphenated American who is a good American. The only man who is a good American is the man who is an American and nothing else.

Here's were I lose my last bit of sympathy for them.

"Marina entered the country on a 90-day tourist visa, which she overstayed while Giesey tried to scrounge up the more than $1,000 in fees required to get her a green card. In 2009, Marina and Michael returned to Germany. Marina stayed a little longer to have some dental work done, and tried to return to the United States by herself in July of that year. She was detained for five hours by customs officials who said she didn't have the legal status to enter the country."

This guy can't "scrounge up" the money to AOS his wife but has enough to fly everyone to Germany for a little vacay and some dental work?

I feel bad about the whole situation and the things, unfortunately some ppl think once they are married to USC, they can always play around the regulation and they would be fine.

That’s exactly what they did, not only enter the country illegally with intent to immigrate and then start the business as well.

Understand there was rush in situation but they had option or DCF or his wife could had moved after couple months after completing the legal visa formality.

Pity neither of them bothered to visit JAG for advice, or read the necessary visa paperwork. Tough situation, but it's of their own making.
