there is a BIG difference between Australia and Nigeria..I mean HUGE difference. Nigeria has just about the highest incidence of fraud, if not THE highest. Plus the petitioner is female and far beyond child bearing years, a big part of the culture in Nigeria...really you are comparing apples to oranges.

With that age difference, in one of the highest fraud countries, the chances are just about zero of getting a K-1. There is no need for anyone to sugar coat the fact that it won't happen. Even if you get married and file for cr-1 you will still have a very HARD uphill battle. Good luck.

Seriously, that was an expensive vacation. She was not legitmately eligible to apply for AOS in the first place though she may have pulled it off if she had gone to the appointment. She will receive a lifetime ban and will not be able to claim asylum...it's FRANCE!

How would anyone know what you may have left out of your case information? All you can do is wait to see what the RFE says and respond to that request.

It's normal. The decision was made. The activity past the decision is mail out the card, put your file away, whatever.

No LIVE trace means there are old crimes that have expired. The USCIS want to know about every crime, expired or active. You have to be honest and tell them about everything. It's up to them to decide if it's relevant or not.

I have a concern that you haven't researched what you're embarking on thoroughly.
Instead of giving you an easy answer, my perogative, I ask that you go back and study the guides to make sure that you haven't skipped all the pertinent details that you need to know. This is such an easy but important question tha tyou should really no the answer.

All you seem to care about is passing the USA visa requirement. I on the other hand am focusing on the OPs personal health. A medical Doctor prescribed the OP a TB regiment = FACT. They just don't place folks on TB regiments until after an XRay indicates otherwise. You're making the Philipines to be a backwards country, it's not, it's a progressive oucntry with seasoned Physicians. OP stopped taking her meds on her own accord = FACT. Gowon recommends, prudently I may add, that OP goes back to her Primary Care Provider and discuss her stoppage of prescribed medications = FACT. You argue otherwise and wants her to just keep on going and potentially spreading the germs = FACT.

I never once said OP has TB. I merely suggested that she go back to her primary Physician to discuss her condition since per OP, the prescribed medications for TB that was given were no longer being taken.
Only a selfish person would find anything wrong with someone seeking proper medical care.

You've got a guy here who didn't even care enough about what he was supposed to do to keep a copy of the request. And we have his story of what he thought the request was. Then, he shows us his answer to what he thought they wanted (it was sort of a condescending response too - I think - not really written in a way to get what you want). Then he's PO'd that he didn't get the approval he wanted.

Being denied entry on the VWP won't affect the K-1 route. It will only mean that you might have to stay apart longer than you want.

Your being denied on a tourist visa will have no affect on a K-1 or Cr-1.

First off, did you even read the instuctions to the I-129F petition? It clearly states that one of the requirements is that you must have met (physically) at least once within the past 2 years. You should never have filed in the first place. They didn't even look at any evidence you sent them once they saw that you had never met. I can't imagine what kind of proof you sent in for somebody you've never met. Most of us who met our fiancees usually has sme worries about having enough proof, but never meeting?
Nigeria is one of the top fraud countries. I assume you are now aware of this fact and you would still attempt to bring over a person who you have never met? I know you believe all that "God knows best" stuff, but you are setting yourself up big time. You seem to be a perfect mark; somebody who seems to be somewhat naive and blindly accepts whatever happens. If this guy plays you, you will probably be here telling us how it was God's plan.
How did you meet? Who made the first contact?
What kind of work does he do? Have you seen any proof? (I will not give my opinion on what I think he does for a living; yes, it's a generalization, but lets be real)
What is the age difference between you two? Are you fairly close in age or is he much younger? If the latter, that should be a red flag for you.
I already know that nothing anybody here says will change your mind (most people have to learn the hard way), especially since you think God will protect you, but I hope you are not back here in a year teling us how you were used.

I'm not only baffled, but confused in so many levels; I admit it. So, your pastor, not an immigration lawyer, gave you instructions on how to handle this incredibly frustrating AND expensive process. You have A LOT of reading to do... and that's just for a "reality check." Then go ahead and read about the process. Praying will not get you approved. Being obedient to the rules will.
Lagos is in the top 5 most fraudulent countries, regarding immigration. You must prove your "fiance" is well intentioned and your relationship is real.

I disagree. Reading this thread without having seen the others, I assumed OP was a typical fiancee anxious about his petition, and had actually encountered "doomsaying" from VJ members based on his conviction. Poor OP, I sympathize. However, after reading the compilation posted by "Columbo" my opinion changed - OP wants to get to the US by any means he can find and feels he has found a way to use the girlfriend to do so. Now I don't feel bad for the OP. I just feel bad for the girlfriend.
OP didn't say "I'm in love and want to be with her at some point no matter what it takes" (like most of us). Rather, OP said he wanted to get to the US for his job, and because he was unhappy with his life in the UK. Now he sees a way to use his girlfriend to make it happen. It was "Columbo's" post that made this clear. So yeah, he did prove something.

I don't really think anyone is judging the OP based on the conviction. They are basing it off of things the OP has said in previous and this thread regarding his immigration intentions.
