    If older man/younger woman/girl marriage was banned then they'd have to delete the Philippines board on this forum.
    Regardless, it isn't the opinion of anyone here - including myself - which is going to matter in this case. If the OP was legally married in Morocco and can demonstrate a bona fide marriage then the child would likely be able to receive an immigrant visa.

    You need to file I-131 advanced parole with your AOS paper.
    It will take about 3 months for I-131 approval, once you have that in hand, you can travel outside and come back to US.

    I disagree with that.
    OP seems angry already about the insurance issue, so it seems like a really valid suggestion to me. I have an aunt for years who would love to move to America and just adores it here but won't even consider it because she doesn't want to pay for private insurance. If there ever was a situation in which health insurance and health care were bankrupting us, I'd turn to my husband and say, we are moving to back to Europe.
    I think it is a really valid concern and one that shouldn't be taken lightly. You being upset at my very pragmatic suggestion is your personal opinion on the issue and I'm allowed to have my own coming from a family of immigrants and having considered these things and done DCF myself. As I stated, one of my close relatives has made health insurance their primary reason for not moving, so yes, there are people who do this.

    Today I am very sad. One of the survivors of domestic violence that I helped here was mundered,her new husband shot her last nigt and she passed away a few hours ago. I don't think I posted here about another girl murdered last year too,but this time I can't be silent,people hAve to understand how dangerous is to get married to people that they barely know.
    I am not here to blame the victims because abuse is a choice made by the abuser,but people have to stop with the bs to get married after dating someone for 2/6months or getting married after seeing the person once or twice,of course people that dated for long time are subject to violence as well,but 80% of the survivors that I helped had a short relationship before getting married.
    Abusers follow a patern. I WILL try this weekend to open a thread about "red flags".
    When a victim posts here about being abused please never say to the victim things such as "talk to him when he is calm", "talk to your pastor/priest",or " we have here just one side of the story " etc these stupid statements are dangerous, the right thing to say is "leave the abuser now, call the cops, seek refuge in a safe place ". Visa Journey is an open forum and everyone can express what they want but we need to be more responsible when we know that someone is being abused.
    I don't remember her nickname here on VJ but R.I.P my dear. Today the heaven became more special with your presence.
    I don't even know how I am going to work today.

    If you can't afford it there are likely subsidies. Your children will need health insurance too.
    How do you expect living paycheck to paycheck and not having that extra and not purchasing health insurance to afford a, let's say 100,000 hospital bill?

    You guys are not looking at the whole big picture... He went to the interview- so what. The interview date means nothing. Its just part of the visa process. The date of your interview means nothing in terms of approval or date benefits were extended to him... If you want to get picky- I suspect he did not discuss with them in the interview the fact that his wife was gravely ill.. I could be wrong, but I suspect it may not have come up. People dont usually die suddenly from ovarian cancer; or any form of cancer to be honest. Cancer is a slow killer with many symptoms. I doubt he went to an interview on March 24th and had no idea she had cancer and she passed less then 3 weeks later from it on April 14th... Whether he discussed this with the Officer at the interview or not? I dont know. It doesnt matter at this point. Perhaps if he did they would have advised him better on what to do and what not to do- but at this point it doesnt matter....

    The only date that matters to USCIS is the date his visa was actually issued which is June 7th. This is AFTER his wife was deceased and he was NOT entitled to a visa on that date. He did not notify them of the change in circumstance and it was his responsibility to do so. The USCIS/embassy does not monitor every USC to make sure there is no change in circumstances like a death that automatically converts 130s to the 360... The wording can be confusing- but technically the 130 for the CR visa gets revoked (or canceled or rejected or whatever you want to call it) at the embassy level and then sent back to USCIS who does whatever paperwork adjusting they do to it and reset by them into a 360 widow form.
    The issue here is that he actually used the visa to travel to the US.

    If you read the FAQ which I posted above which was taken from the embassy website it clearly states that the underlying 130 petition is REVOKED when the petitioner dies making your visa invalid.

    He USED the visa to travel to the US. This is a BIG issue. He traveled on a visa that he was not entitled to. So while there is another visa that he is entitled to, one can not simply say- well thats okay we will just adjust it... There are ramifications for doing what he did. It is similar to someone entering on the K visa when they are married. The USCIS does not simply take the approach of - oh you used the wrong visa? psh thats ok, we all make mistakes.. No. Its called visa fraud. They have a dim view of it. He needs an attny to sort out this mess.

    Intentional or not, he entered on a visa he was not entitled to, that should have been revoked. He needs to speak with a lawyer. In my opinion he should NOT go to USCIS infopass or attempt to file for ROC. He should speak to an attny and find out how to proceed. He does want to and does NEED to alert USCIS to his error, but he does not want to put himself into a pot of hot water with out having assistance and a clear idea of how to solve the issue. USCIS infopass is not designed to provide assistance to people on how to fix errors or provide legal advice.

    Could be due to disproportionate concentration of people with serious medical conditions in that individual market / state.

    Too many old, pre-existing conditions people buying health plans while young healthy people not signing up.

    Also, insurers can't cross state lines due to local and state regulations codes ..etc?

    We are our choices. As an advocate for victims of domestic violence I would say if the victims decide to act just when something is happening then most of them would be dead.I don't see a victim of a scammer different than a victim of DV because at end they are abused in the same way just in different forms.
    We don't have to wait for something to happen to take action, it's wise to see the red flags and act asap,it's in your hands

    Perhaps that is because what you want to do is notpossible on a VWP or B1 visa entry. What you are proposingis not common. It is, however,also not an exception -- it is not possible, You are right in that there arehousands of IT people who enterthe US to do specific activities -- some with the appropriate work visa (usually H1 or L1), someon B1 for an activity that qualifies (e.g., gathering program requirements for software development that will occur outside the US), and some get through and work without authorization to do so. The 2,3,4 people from the same company you cite as evidence that it's possibe or they would have been caught are not necessarily entering at the same POE or, if they are,arenot necessarily all going to the same immigration officer. Or, they might not be describing their intent to work properly. Or, you are mistaken in what you think is happening.
    Bottom line -- you cannot do contract work in the US on a VWP or B1 entry....at least not legally.
