Oh dear =( can you get something from the doctor to help relieve you somewhat during the interview maybe? or something from the pharmacy like NyQuil. Buckley's is a really good one, natural type medicine but harder to find in the USA at pharmacys.
I don't think they would turn you away just for being sick, I would load up on medicine and push through it if you feel like you could do it. If you don't feel like you could make it even on cold meds then see if you can get the date changed.

The overstay will not be forgiven. The OP is not in the US. If she overstayed and never left, then she would not be subjected to a ban and her overstay would be forgiven.
Since the OP overstayed more than a year and has left the US, she has a 10 years ban. Thus, her visa will be denied and she will need a waiver.
Big difference. This is why the general advice for an overstayed spouse is not to leave the US. Once a person leaves, it's harder to get back in.

Keep screen captures of things like that FB message, if not the message itself. Threats and vitriol on his/his family's part might help give you the upper hand when it comes time to discuss custody issues.

First, he cannot "have you deported". He could write in an report you, but it's not illegal or a deportable thing... so ignore that #######.
Secondly, I would file for divorce as well as an Order of Protection (OP) or No Contact Order. He sounds very unstable... "if I can't have you no-one will" is scary.
I understand him taking the passports, he was probably worried you would hop on a plane and disappear with his daughter. Technically they're his to look after too because he is also her guardian. You could ask the Judge to have him return them but as you're the one that could flee... you never know.
None of us can promise what will happen where divorce/child custody is concerned. There are so many variables. I will tell you that it is in your best interest to plan your departure and divorce filing/OP filing at the same time. If you can show the court that you have stable employment, a safe residence for the child (rather than couch surfing etc) your chances of primary physical custody are greater improved (that's not taking her away, she would just live with you for longer and have whatever visitation with him or vice versa). Tht's not to say NOT having a residence is bad, it just looks better when the Judge reads the paperwork and sees that you're self-supporting. I would see an attorney without him knowing, and have him served with the documents on the same day you move out. That protects you and your child.
Regarding immigration, once the divorce is final you need to file ROC immediately OR during the 90 day window, whichever is first. You will need proof of relationship/bonafide marriage.

There is no requirement to wait for ROC to be finished first.
In fact if you can file for your citizenship then file it. It will force them to complete your ROC filing.

Hi,
Congrats on getting assigned a case number.
In India they don't send you Packet 3 anymore for K-1 category visa. You will receive an email with your appointment letter and date. Plan on your appointment being at least 60 days away if you are going to be interviewed in Bombay. To better understand the documents requried go to http://mumbai.usconsulate.gov website.
At the website go to visas tab and click immigrant visas and click documents. You will have a bunch of documents and also packet 3 and 4. Again just work on packet 4 as it is the same but also your DS230 and DS156 will be there.
Right now your main concers are DS156, DS156-K, DS230 part 1 and DS230 part 2, your birth certificate, your PCC, your passport, all this information is given on the packet as well as your medicals, and pictures and all.

Thanks to you all for the health and interview wishes. My husband and I made it to my appointment today. I've answered the first six questions correctly and passed. My colds are not completely gone so I'll just go back to sleep now and post my full review tomorrow. Hopefully they schedule my oath ceremony this month.

Montreal is a very strict consulate regarding domicile, keep your residency in the US to make your journey easy. Why do you need Ontario plates?
By the time you get your interview you should have pay stubs for your new job, does it meet the income requirements?

1. go to the interview without completing the medical exam and
2. expect to get a 221g about the medical exam and
3. ask for a pass to return to the embassy for tuesday and wednesday (both days, just in case) and
4. go back to the medical place after the interview is finished and
5. finish up with the medical and
6. hand carry the medical stuff into the IV unit, using the pass obtained back on step 3.
That's about all I can think of, for now.

Do not send your passport. Send copys of pages of stamps for travel and the biographical page but not the actual passport. That is a really bad idea.

Why are you waiting? P3 is on the Montreal website with all the information. Print it out, do it, and mail it like yesterday! Its only causing your own case to be delayed. This information is in the Canada forums in a step by step guide for Montreal.

If K-1, CR-1, IR-1 - Kuwait 'letter of resignation ' in hand has nothing to do with the port of entry in the USA. The CBP doesn't ask for it - instead they look at the VISA in his passport.
IMO, Akram is a slave-driver and wants to keep your husband in Kuwait at all costs.
Why is Akram involved, at all ?
