We're getting our N-400 application together. I just want to double check that based on filing for the 3 year rule I only need 3 years of tax return transcripts as evidence?

That would be our tax return transcripts from irs.gov for 2012, 2011, 2010, right? I don't need any others?

Thanks for the reassurance Inky! I just went to the website and ordered the tax return transcripts. It says it will arrive in 5-10 days. That really was easy!

Thanks for the reassurance Inky! I just went to the website and ordered the tax return transcripts. It says it will arrive in 5-10 days. That really was easy!

They come pretty quickly usually too. Got all 3 at the same time in about 4 days after I ordered them.

You are correct but its always good to have it with you even if you are not applying based on the 3 year marriage rule.

Wait a second. I mailed a N-400 for my spouse (LPR) two days ago. We have been married for 4+ years. She's had a Green Card for a full 3 years now.

I looked through the Instructions for Form N-400 and there was no mention of tax transcripts. Is this going to present a problem?

The way I read it was tax transcripts were an option of the documents showing you're still married. When you leave the US for more than 6 months then that's when they're required. Refer to Form M-477. Edited by cassi9879

Tax returns OR tax transcripts are listed on the checklist. http://www.uscis.gov/files/article/attachments.pdf

They are also listed on the other sheet the USCIS mails you. After you have applied.

They are listed under DOCUMENTS REFERRING TO YOU AND YOUR SPOUSE.

- they are also listed under trips. But before that its documents referring to you and your spouse.

This form also lists tax returns http://www.uscis.gov/USCIS/Office%20of%20Citizenship/Citizenship%20Resource%20Center%20Site/Publications/PDFs/G-1151.pdf

Bring them if you are filing on 3 or 5 years.

Oh no. I overlooked this Form M-477 Document Checklist. We are filing based on "3 to 5 years," and I only sent in the bare minimum - photocopy of Green Card, two 2x2 photographs, and a $680 check.

Did not know about needing my birth certificate, marriage certificate, tax returns/transcripts, etc.

You will get what is called " YELLOW LETTER "

Requesting you to bring documents you did not include. Its like an RFE but you don't mail it you collect it and hand it over at the interview.

Happened to quite a few of the February filers.
