    A tourist visa is for visiting, not for staying in US. So she needs to stay out of US more that she stays inside US.
    If the CBP thinks that she is using the tourist visa to live in US permanently, her b1/b2 visa will be cancelled and she will be put on the next immediate flight home.

    Ok, maybe you're not. Then again, maybe you are. Or maybe you aren't doing it at all.... which is still wrong.
    Have you been looking at Igor's list trying to get an idea of how long your visa will take? That data is taken from the timelines other visa journey members take the time to fill out as their quest for a visa unfolds. This site is AMAZING and offers a lot of guidance and support that you won't get anywhere else, especially from USCIS. Don't just take, give back!
    When you do update your timeline there are some things you can do to, well, not screw up.
    For example:
    When you send in your application, please note that just because it goes to a Texas address does not mean you sent it to the Texas Service Center. It means you sent it to the Lewisville, TX lockbox where it will be sorted out and then sent to the appropriate service center. THIS IS NOT A TRANSFER. The same would apply to other lockboxes as well. This is a mistake that is easy to make if you aren't familiar with the process but it does a lot of damage to the credibility of the timelines, especially for those at the Texas Service Center.
    Also, pay attention to the consulate you select. I see a lot of people that have their consulate listed as "Armenia" when they are not anywhere near there.
    Lastly, just update your timeline! When you enter in your dates for RFE, NOA2, Interviews, approvals and anything else, it gives people with similar circumstances an idea of what they are in for. You know this process is daunting, frustrating, time consuming, and confusing.... wouldn't you appreciate and guidance and help other than a "general processing time estimate" that is not necessarily taking your details into account?
    Unfortunately due to data entry mistakes, Igor's List has become less of a reliable resource for some of us and the time frame estimates on our own completed timelines is not accurate at all. These are great resources if we can get people to participate AND put in details correctly.
    If you have questions on how to do it please ask in this thread! Somebody will gladly answer.
    If you have more suggestions on how to fill out the timeline correctly so we can all make better use of these free tools VJ gives us, please add!

    The OP's timeline indicates that she's between NOA1 & NOA2, so only USCIS is involved at this point. Send a certified letter with return receipt requested, enclosing a copy of the NOA1 letter, stating that you're withdrawing the petition.

    You do not need a new medical if yours was done within a year of filing. You are not required to get a new medical if the processing of your case goes past the year mark for your medical. Also, it is not flu season, so you would not be required to get a flu shot when going to a civil surgeon to get your missing vaccinations and vaccination transcription onto an I-693.

    It is, but it needs to based on something, preferably I-130 petition for a spouse. You need to do concurrent filing of both I-130 and I-485 at the same time and send I-864 and I-693 at the minimum with them.
    Best will be to start reading the guides and form instructions... They're typically helpful...

    I don’t think anyone here on VJ does not feel for the illegal immigrants. But my wife will tell anyone what she had to go thru to get here legally, and so have I many years ago. It is not fair to us legal immigrants to help people for no regard of our immigration laws. They know exactly the law, and they brake it anyhow, under the pretense of bettering there life’s. I know many illegals living and working many years in the U.S. having many children, and getting many benefits. NOT FAIR

    I do not appreciate the fact that you are being rude when I and others are simply trying to assist you.
    For instance in many states, libraries and municipal buildings also serve as acceptance facilities and not just post offices...so please don't try to insult me about learning how to read.
    And stop with the caps; it's quite rude and completely unnecessary.

    Sorry if I am misreading your timeline, but it seems like its only been two and a half weeks since you sent in your petition? If you're already losing your hair, you're gonna be bald by the time you're done with immigration



    If you suffer from depression/anxiety, and provide proof of this for an expedite request (i have no idea if they will approve/reject the request based on this though) you will have to answer "yes" to the question on whether you have any of these medical conditions during the exam. It will not be a hindrance to you getting the visa, especially if you have been treated/are receiving treatment.

    You've been given some really good info - but here is a step that has not been included:
    Your fiance will get off the plane in JFK. First step will be immigration, where he will turn in his packet. Then he will go to baggage claim and pick up his luggage. Then he will have to clear customs (really be sure he knows what can be brought into the country - find the "Know Before You Go" booklet that Customs puts out).
    After he clears customs, he will have to "re-check" his luggage. If you have booked him on one ticket, and the two airlines are affiliates, then his luggage will be checked through all the way to Charlotte - so he only has to find the desk where they re-route his bags to Charlotte. It's usually just outside the customs desk. It was good advice to look at a map of whatever terminal his Ghana flight arrives at.
    If the two airlines are NOT in cahoots (I mean, affliliates!), his luggage will only be checked to JFK. He will have to find the check-in desk for his JFK-CLT flight and have his bagged checked from JFK to CLT.
    As long as he has his passport and boarding pass, that's all he'll need to board his flight to Charlotte. Most likely he will be changing terminals, which means he'll have to go through security again.

    You definitely abandoned your case and are not a LPR, but the agency who decides this doesn't know it yet, which is surely frustrating.
    When they figure it out, your LPR will be taken away. So if you try to use your LPR status, or apply for ROC or citizenship, at some point down the line they will figure it out and your LPR will be officially taken away.
    You could probably get in to the US with your GC for the short term, but eventually it will be found out and you'll be stuck.
    So if I understand, your question is how to go about getting a new spousal visa?
    For everyone else, let me underscore and beg everyone to please apply for AP. It is free, and if the OP had applied for AP then she would be a LPR and not be in this mess. All the price of filling out one form, say 10 minutes of work.

    SHOULD you? No. I think it would be incredibly foolish of you.
    CAN you? Yes.
    Given your history (marrying on the VWP, attempting to AOS on the VWP which was subsequently cancelled) and now attempting to AOS again from the VWP... I would think it's too risky... but then I'm all for doing things the proper, safe, and legal way. Which isn't to say AOS from the VWP isn't legal, it is, it's just not legal with intent.
    Also, "no longer want to be separated unnecessarily if there is an alternative"? You KNEW there was an alternative when she entered. I'm sorry but I don't buy it. It's not me you need to worry about though. So make your choice and live with the consequences (or benefits), whatever they may be.

    What did you apply for? A spousal visa? You cannot file for a spouse for a proxy marriage if you didn't meet after. You were only eligible to apply after you had met her again after the proxy marriage, so 3 months later.
    If you filed for a spousal petition, you will be denied because you did not have a marriage that was petitionable by USCIS laws. In trying to save time, you wasted all this time, because you will have to cancel this (or get denied) and start over.

    I hope he does not get the visa. I don't want my children to get one of these deadly diseases. What is it with people? I mean MORAL purposes? How about the moral dilemma if you come to US and turns out you have an infectious disease? And say one child or several fall ill and even one of them dies? Does anyone have any moral objection to that? Get real, vaccines SAVE LIVES EVERY DAY in this world. Sure once in a while a person has an allergic reaction and yes once in a while someone dies but the numbers are miniscule as compared to the non-vaccinated population...sorry but the anti-vacinnation people don't care about anyone but themselves. They are selfish and self centered.

    This is 100% correct. See this link. One of the world's premier medical journals was appalled at its mistake in publishing the data, and it retracted the paper. See especially the paragraph about the Centers for Disease Control and Prevention herein.
