canadian_wife got a reaction from PaulaCJohnny in Wife Deported three years ago can she apply for waiver to get a visa to Visit
A lot will depend on why she was deported and if she was given a ban as well. Can you please provide more information?

canadian_wife got a reaction from Mike E in Lacking the usual evidence of genuineness of relationship that most applicants have. How can I get some?
We didn’t have most of that either. Montreal knows about the ease of travel to the US and the different rules we follow. But I agree, time to start taking pictures, getting those receipts in the same place, a day trip to Niagara in the Lake and stay in a B&B. If you want to win immigration points it’s is time to start playing their game.

Well, you have my answer and the answers of other experienced members here. But as you can see, you are not the first to ask.

You will want to post this in the Canada forum, as this is a common occurrence based on domicile.

Typically, no, this is no where near enough for Montreal,
There is a whole thread on US domicile in the Canada forum

From the USCIS website
So yes, there is a rule. She cannot work without work authorization. Very simple and straight forward.

There is no guarantee because the US citizen does not have a right to bring a spouse here. That foreign spouse may be abusive, a terrorist, a criminal that hurts children. That is why there is a process to ensure the safety for all parties involved. THAT is why it is not a guarantee.
I know it is frustrating, I've gone all the way through this process. Now that I am on the other side, I understand the necessity of this process.
Best of luck

There is nothing for you to do now except research the different visa paths. Your fiance will do the heavy lifting in the early stages. Please review those guides at the top of the page to learn about the processes. This is a DIY site (heavy on the Y)

canadian_wife got a reaction from Crazy Cat in In search for advice to get married
No need to apologize, we are just trying to help. I stole this from Crazy Cat, I hope it helps you.
Every couple has their own priorities, and each couple must decide which visa is better for their situation.
K-1
More expensive than CR-1
Requires Adjustment of Status after marriage (expensive and requires a lot of paperwork)
Spouse can not leave the US until she/he receives approved Advance Parole (approx 6-8 months)
Spouse can not work until she/he receives EAD (approx 6-8 months)
Some people have had problems with driver licenses, Social Security cards, leases, bank account during this period
Spouse will not receive Green Card for many months after Adjustment of Status is filed.
A denied K-1 is sent back to USCIS to expire
CR-1
Less expensive than K-1
No Adjustment of Status(I-485, I-131, I-765) required.
Spouse can immediately travel outside the US
Spouse is authorized to work immediately upon arrival.
Spouse receives Social Security Card and Green Card within 2 or 3 weeks after entering the US
Opening a bank account, getting a driver's license, etc. are very easily accomplished with GC, SS card, and passport.
Spouse has legal permanent Resident status IMMEDIATELY upon entry to US.

This is an entirely true statement. Although it may be 'pretty low' for many consulates, Montreal is extremely strict about domicile.

canadian_wife got a reaction from Chancy in Visiting My Fiancé While At The End Of I-129 F Processing
There is no flagging as far as I know. Why would 'they' flag you and who are 'they'?
If the I129F is approved while you are visiting that is great! No need to rush back.
Just remember, each attempted entry into the US is up to the CBP.

Make sure you arrange proper medical care in the US prior to your final move, as you will lose your provincial health care once you become a US resident and move on your Cr-1 visa.
