canadian_wife got a reaction from OldUser in Do you recommend the K-1 visa or the K-3 visa more?
Sadly no, it is a long process to buckle up and start reading the entire process for Canadians.  Like what will you do for health care once you move to the US?  The only consulate that does visa interviews is Montreal - are you prepared for that travel?  Do you have your long form birth certificate and vaccines updated?

    Good luck

Oh dear, you cannot tell people to stop posting, you read/reviewed the TOS right?

I believe you are very skilled, I do not think it is acceptable to demand cases from a public site, when then are so many nuances involved.

    Good luck

I'm sorry, but entrance to the US is never guaranteed for visitors.  The CBP knows better and may have been trying to placate you.  Please understand this important aspect.

Out of curiosity, why did you overstay?

I am sorry for your situation.  But I think the consensus here is.

1 - discontinue your catholic charity lawyers.
2 - work with your doctor and focus on your health and ways you CAN travel.  Covid should not be preventing travel, even cancer patients and HIV+ patients travel.
3 - It is time to stop dwelling on what happened in the past and it is time to get to work.  Your current path is not feasible and the consulate (even if USCIS approves the petition) is unlikely to approve the visa in my opinion.
4 - of course the lawyer told you it was possible to appeal your current situation. He would like more money to do it for you.  Then if/when the visa is denied, he'll simply walk away with your money.

    Good luck

Sadly, the cat is out of the bag.  From your description, it is likely the CO thought you were paying him for the recording session and thus unauthorized work.  But if you have previously done work together in the US, and you have paid him - he has worked without authorization.

What is the wait time for a B visa interview in S. Africa?  I know for many countries that it is tremendously long wait.

To answer your question - I was denied entry twice to the US and then admitted as a tourist.  But what has changed since the last interview?

    Good luck

The answer to these question is the truth - nothing more or less.

So what WAS the purpose of her trip when she was denied her tourist visa?
What HAS changed (aside from being married as Skyyy stated)?

And it is unclear, are you interviewing for the Cr1 or a tourist visa?

You should wait for an RFE.

If the mental health records were not part of an arrest record and/or getting finger printed, then you most likely will be fine.

At the embassy level, they may ask to see the criminal records. If the drug case is still pending in court, e.g. there is no disposition, then you probably will have a problem getting approved at the embassy and USCIS level.  Any idea how long it will be before the trial and sentencing?

Since you asked for advice, marrying someone with mental health issues and  has unresolved active criminal drug problems is a huge red flag for getting married.

Not the point of this topic, but have you thought of a marriage or fiancé visa?

The point of this post is about a work visa.  First you'll need to find a job in the US that is willing to sponsor you for a work visa.  What formal qualifications do you have besides a coursera certificate (not sure that carries tremendous weight in the job search arena).  So start looking for jobs in the city/region you wish to relocate to, determine if those positions will sponsor you for the work visa, then get the company's lawyers to start the process for a work visa.

This sounds awfully like you are intentionally planning to spontaneously decide to remain in the US after you enter on a non-immigrant visa.
