The probation is a gray area. If her asylum case is eventually approved by the immigration judge, she will not have accumulated any unlawful presence. If the judge denies her case, all the days of her probationary status will be counted as unlawful presence. So, she has no status AND is currently in the country lawfully.

An asylum seeker is granted the right to stay in the US while their case is being adjudicated. It's basically permission to be in the US until they have a date with an immigration judge, but that's as far as it goes. During that permitted time, the person must file the appropriate paperwork to request that they not be deported and be allowed to stay legally. They only have a year to do this. I'm guessing the 4 years is how long it could potentially take for that case to be adjudicated.

Did you already know her before she entered the US? When did you meet her? Even if you met her the day she entered the US, discussing marriage (especially in her circumstances) seems VERY hasty..

You can request for a name change on the day of your interview and that can delay the oath ceremony up to 1-2 months, depending on your city/county judicial ceremonies calendar. The name change can be as simple as hyphenating surnames or changing one single letter.

I would give it a week or 2 after green card arrives. You could be pesky and show up at the SS office with your green card and tell them you want to apply.... if its already in the system youll get the number if not fill out application. Squeeky door gets the oil

I agree with this, as a K1 visa holder you are eligible to get a SSN, but the window is very limited. This is what we did. Get the SSN although it will be in the maiden name it will not be any problem to change to the married name later if you wish. Be sure to get your I-94 before applying for the SSN. That can be gotten from the I-94 website online be sure to print out several copies as you will need them later. SSN is most important and its a very easy process the sooner you apply. Some states do require a SSN to apply for the marriage license so you'll have to check your state requirements. The key is start building for your AOS NOW and with a SSN it makes it all the better.

Seems they already applied for the K1. But applying for the spousal now would not be THAT bad considering that with the fiancee visa, they would still need to pay for AOS, EAD, AP and very likely, ROC.
The "risk" of being lectured and even being sent to secondary inspection is always there -AP or not-.
I agree with @Dashinka: the main issue is not entering the US but boarding the plane back.
Problem is that if people avoid traveling on AP, the airlines will never really get acquainted with the document.
I am guessing that now it costs 630usd, there will be way less applications and it will be just for actual emergencies.

I'd argue that you need to always build the strongest case possible. If it requires 2 inches of evidence - so be it. If it requires less - great.
In my observation, people who bring thick files don't get asked much and their evidence often is not looked at. But folks who bring two pieces of paper or nothing with them get asked a lot of questions and / or issued RFEs.
Strong evidence is an insurance that costs a little more to print. If one can afford - in my opinion is totally worth it
One should be ready for everything, including stokes as you mentioned. Because you were prepared your interview went smooth. But if one takes it easy - that's when one gets hard times by IO.

No you won't get denied. You can get passport first, it's totally fine. The benefit of doing SSA first is you don't leave certificate with them. But with passport, you won't have certificate back for some time, meaning you cannot get unrestricted SS card in that time.

You can download SS-5, fill it and bring it with you to SSA to save time. I'm not sure if it can be done online. When I removed restrictions on mine, SSA wasn't open and I did everything online / by post. I had to mail my actual GC to them!!! I'd think if it's still allowed, you'd me mailing naturalization certificate. I wouldn't personally take the risk. I had no choice during COVID, but now I'd walk there in person.
No it wasn't mandatory. But it allowed you to only show SS card and DL to employers and not GC (plus any extension letters)

UP TO 6 months per entry, but that is not a guarantee and also doesn’t mean that somebody can stay for 6 months, leave and come back for another 6 months.
