    Just choose what you want to use, and be consistent in it. You don't want to end up having different official documents with variations of the last name combination.

    I think a lot of people think or hope that they will have a better chance of getting the I-751 approved by going the abuse route, and are making it so much harder for themselves. I think they are confusing the I-751 with the AOS (where VAWA is often the way people go in an attempt to still get a greencard if they divorce before AOS is approved). Reddit is full of posts like this.

    Agree.  I'm not sure why people choose any other option if divorced.  Only a divorce decree and marriage evidence are required.

    Your current case is based on a good faith marriage and is obviously not approvable.

    @MK878 I'm not your immigration or family lawyer. However, it's in your interest to finalize divorce ASAP. Give him whatever he needs and close this chapter. Unless you're splitting millions of dollars or fighting for the kid (which I realize may be the case), it's easier to move on. This will give you final divorce decree which will allow you to get I-751 approved and stay in this country.
     
    If your I-751 gets denied, you can refile quickly a new I-751 with all good evidence with divorce waiver.
    But if you delay it, you may be put in removal. Which is a lengthy process, but may get you deported eventually if you don't get it right.

    Your husband “ sent letter to USCIS “ telling them he is divorcing you BUT as you indicated, he has not filed for divorce…and you know he did that to hurt you, out of spite, anger… You have nothing to worry about , other than deciding if you want to stay in the marriage.
    1. IF you want to stay in the marriage and communication w your husband is still possible, then when the interview comes both of you can go ( u don’t have to be living together at time of the interview if relationship is still on the rocks, by law you are still legally married and USCIS can only look at THE EVIDENCE bonafides of the 2 years BEFORE I-751 filing ). IN this case you respond to RFE w anything new u have ( remember it’s evidence from date of LPR to Date of Filing I-751..don’t worry about the in between time frame ) and say you and husband request for JOINT INTERVIEW to be scheduled…which may happen quickly after that. 
    But don’t worry if you do this and assuming you both agree to save marriage and he changes his mind at last moment . You can show up by yourself at the interview and tell USCIS you are amending I-751 to Divorce Waiver.
     
    2. IF YOU decide to throw in the towel and divorce, then file for divorce asap and ask the court to Bifurcate ( u get a faster divorce status while other issues like custody can take their time). That spiteful notice he sent to USCIS will actually help you in Family Court get a faster status only divorce. )
     
    No matter what happens to the marriage, you have NOTHING to worry about…other than make a decision to save your marriage or file for divorce

    Of course it depends on your local office.  My wife naturalized early this year in Dallas.  Took 172 days from filing to oath.

    I think you need to have a look at current processing times for both processes, from start to finish.  Timelines are far different than they were 6 years ago.  
     
    The petition processing is just one step.  There is another new thread here by a user who is adjusting from a K-1, and was quoted 2026 (by USCIS) for the green card processing.  Do you really want to come to the US and have to wait years for a green card?

    The online N-400 is very simple.  I attached a letter to wife's application under additional evidence to request a combo interview.  Go for it!!  Good Luck.

    You mean your I-765 got approved at lightspeed? Yes, this happens to tiny number of lucky filers. Did they send card for production yet?

    That's crazy. But good I guess, was wondering if it was just some random thing.
     
    I got the approval notice stating: "We have approved your application for employment authorization. We will send your Employment Authorization Document (EAD) (also known as an EAD card or Form I-766) to you separately"
     
    But no clue if that means they've sent it off yet or not.

    Try a walk in first. This is usually possible with biometrics as long as you have an appointment scheduled and the letter.

    He can submit a petition any time.   Hopefully he is familiar with the visa bulletin, and realizes that F-4 visas take >15 years?
     
    By the time a visa number is available, the health problems could likely be worse, so you’ll want to have a plan to pay for health care for the brother, since he won’t be eligible for Medicare.
