    Good question. Reason immigrants will chosed to go through hell in marriage because the So called U.S citizen claiming he can threaten them of revoke. I know your worries... you correctly mentioned that you have done wrongs or mistakes and your thought is that if he take it to court for your gc to be revoked he has substantial evidence against you. My advise is.... don't die in a marriage that is not working because of fear of losing your green card. Looking st the comments above they spelled it out clear and I concur that he has no power deciding if your card will be revoked or not. Just keep your evidence for worst case scenario to file police report against him for domestic violence and even if it has to go to court use same evidence and prove that he is abusing you. It's even too late since you have your 10 years green card. He csnt do anything. Don't suffer in marriage because of gc I repeat. I know you are putting love In Defense but the threat is your worry. No to violence or abuse

    We have both made mistakes, however tonight he got my phone and shattered it. I was also trying to talk to him and he went into the bathroom and closed my arm between the door and the wall. I am very heartbroken, I love my husband and I understand I have done mistakes as well, however I am not sure if he could do anything. His family seems to be now against me, it seems they suggested to do this.

    You don't need to file taxes when you were not here. You are still a USC. Talk to the us immigration services. This platform does offer incorrect information often so please don't count on it and do whats best for you

    Hope for the best, prepare for the worst. Thus hope they won’t reschedule until your divorce is final but be prepared with the abuse claim if that is not the case. Most important, be prepared with truckload of Joint Life Evidence for the time you lived together. 
    Personally, I think your attorney’s initial strategy was spot on ( request postponement of interview, make claim of potential abuse and wait on filing the amended I-751. By the way, she saved you from paying for a new I-751 fee.) 
    So stop looking at USCIS website..focus on making an new daily life for yourself. It will be ok even in the worst case scenario..you get a another “bite of the apple “ in front of EOIR.

    My attorney is preparing extreme cruelty. They don't wanna include divorce waiver because it takes time to get the divorce. There is nothing I can do to make them include divorce waiver

    No that's the whole process They won't charge extra unless I am in removal proceedings

    I could have filed for divorce when everyone told me too but I really wanted to make it work. I al so stressed  out

    Yes that's when people are sure that they would be granted the residence I guess so that's when they go for it. I guess when they are not sure, they would refile

    Thank you everyone for your replies. While I appreciate to hear different point of views, and please keep giving me your opinion, I would like if you guys could give suggestions based on experience and taking into account the immigration law and the way it's applied. 
    Now, I would like to mention that the fact that millions of Americans suffer of depression, it's not relevant. Major depression can be a disability, and for these waivers they have to consider the state of mind of the alien before and after the marriage/abuse. Suggesting to have police reports, evidences of physical abuse, etc. violates not only the "any credible evidence" standard that is applied to abuse waivers and VAWA, but also the intent of Congress to protect people subject to abuse. 
    Again, the idea is to check both boxes (divorce waiver and abuse waiver) to maximize approval chances. USCIS will evaluate first my evidence for the abuse waiver. If they think I will not satisfy the abuse requirements, will evaluate my case for the divorce waiver. The law clearly gives me the chance to check every applicable box, and if an officer asks to pick only one, this is a violation on their side, unless I'm missing some memorandum.
    One last thing, to the people that commented change lawyer, etc. The lawyer that is assisting me with the case is one of the most respected in the country for this kind of waivers (prefer not to disclose the name), so again, avoid no-productive comments.
