Kabar reacted to SalishSea in Case sent back to NVC [merged threads]
All denials have a solid reason, and it is not a luck based system.
Pakistan, like other countries with high levels of extremism and fraud, is a rough consulate. Are you originally from there? Has your spouse been married before? Are you first cousins?

Your attorney is not helping you.
Stop waiting and file new I-130. Also FOIA the Department of State for any visa records …
To figure out what/ why the fraud allegations by CO..you need to interrogate your Husband 😂
In the new filing show all previous evidence, add all new and draft a statement recreating all the questions your Husband was asked at the interview…his answers and any explanations for inconsistencies.
Spend time talking w your Husband and writing down the Q &A …ask him if he recalls any particular area the CO seemed interested in …all details count and you can address them proactively in new filing. ..
They took the position that your marriage is FRAUD, so you need to say NO WAY and show them why.
Attorney is not helping you much..by telling you to wait…your file is lost in a Black Hole and no one has looked at it. If by some miracle you end up with NOIR , you can use the same evidence you filed new I-130 with and try to overcome the fraud allegations. ..it’s ok to have two petitions pending at the same time..first one that gets you another interview will be adjudicated..
Post the interview questions or any other info if you want input on what flagged you for fraud.

Generally your husband will be invited to interview again. In your previous thread you said he was denied in Abu Dhabi… so he should interview there. But, if he is in Pakistan now you will have to request they move the interview to Islamabad. The reason we keep asking for reason of denial is because if they didn’t believe your relationship was real your husband will have to show proof you are in a bonafide relationship.
Generally when a case is denied the petitioner is given the opportunity to refute the allegations made by CO… but you seem to have skipped this step. So, I am confused. But, as long as you have continued to visit your husband in person while waiting for the new interview you should be in good shape.

Did you read the FOIA? Can you upload here without sensitive and person information?

If the visa is denied though will you divorce or move to a third country?

OP: VJ is a community that provides insight and help in US immigration cases around the world.
VJ has no way of making decisions in any case, but rather can provide valuable help to resolve issues based on the expertise of some members and the experiences of others.
Shopping around for different answers by providing different versions of the story is not going to get you anywhere with your actual process, but it will only get you confusing feedback based on the information you provide every time.
I know some members may be looking for hope and comfort by providing different versions of the actual story, but it will not change the outcome of the case, because only the appropriate authorities have a say on the decision.
Providing not accurate version of the story might get you the wrong advise

Have you ever contact a lawyer about the “Revocation of Petition” thing? About the marriage fraud or something like this.
What about request FOIA? Maybe this can show anything that you are missing.
What’s your husband country? Have you visited him more times? Have you ever thought about moving to there?

OP, between your previous thread and this new thread, what have you done to address the consulate's concerns that it is a fraudulent marriage?

The published date for responding to I quirked is one week right now: https://travel.state.gov/content/travel/en/us-visas/immigrate/nvc-timeframes.html
it is a good sign if the case have been reaffirmed by USCIS and sent back to NVC for processing.
but you don’t know if that is the case yet until you get a response from NVC.
Good luck

Kabar reacted to Raïs86 in Visa application expiring soon under section 203(g)
Hey guys please I neeed your help me with what is meaing on CEAC website now shows me this below message.
My application was under administrative proceedings and now change to this message.
U.S. Department of State
IMMIGRANT VISA APPLICATION
Expiring Soon
Section 203(g) of the Immigration and Nationality Act requires that your registration be canceled and any petition approved on your behalf canceled, if you do not apply for your immigrant visa within one year of being advised to do so.
You were advised of this requirement over 1 year ago, but we have not received a response from you since then. As a result, your application for a visa has been canceled and any petition approved on your behalf has also been canceled.
Your application may be reinstated and any petition revalidated if, within one year, you can establish that your failure to pursue your immigrant visa application was due to circumstances beyond your control. Please provide a written statement to the Embassy or Consulate outlining the circumstances beyond your control and noting that you still wish to pursue this visa petition.

Kabar reacted to Rocio0010 in CR1(Abudhabi) - Revocation
My question is if the officer could have suspected that you were doing it for financial reasons. If so, what proofs did you submit to prove hem wrong?
-
Kabar reacted to Rocio0010 in CR1(Abudhabi) - Revocation
Proving a negative is very hard. Close to proving that you were never married. For some reason officer might think that you did it for an economic profit.

Thanks for answering - hmm this was my only thought when saw that you knew your second husband as children.
Hopefully the notice of intent to deny will shed light and you can refute each point with evidence - though as has been pointed out it may just result in a decision of ‘you may reapply’ but at least you can then tailor your new application to address these points early on.
Wishing you the best in your immigration journey.

You will need to spend more time together in person if he wants an immigrant visa. Alternatively, you could go live with him.

You didn’t answer others questions.
Did you tried to revoke the petition? Or anyone had the case number and could did it?
-
Kabar reacted to JeanneAdil in CR1(Abudhabi) - Revocation
you have to wait till u get the notice and then answer it with proofs and i don't know how u prove a negative
but getting in touch ??? they may not yet have the packet
i did an appeal , it took over a year and i won my appeal but it said, "marriage is bona fida, u can reapply"
mind u if u do reapply , u still have to show u didn't revoke the 1st CR1 petition / how ????ask the office to send a copy of the message from u that says u wanted to stop the petition
-
Kabar reacted to Marieke H in CR1(Abudhabi) - Revocation
Does anyone other than you have the case number? From your post history, it looks like you as the petitioner requested to revoke the petition. If you did not do this, could someone else with bad intentions have done it?
-
Kabar reacted to Crazy Cat in CR1(Abudhabi) - Revocation
@JeanneAdil knows quite a bit about this kind of situation.....
-
Kabar reacted to portorusa in CR1(Abudhabi) - Revocation
Next step is to contact USCIS (as indicated in the Embassy's email).
Depending on what your intentions are, it might be time to hire an immigration lawyer, as well.
Good luck!
-
Kabar reacted to JeanneAdil in CR1(Abudhabi) - Revocation
Your May post says the CO said "petitioner revoked the petition"
Did u try to do this?
If u sent any message to stop the petition, u would have to reapply
and embassy no longer has your case so getting in touch with them will be no help
case is sent back to original USCIS office that handled the petition
u are looking at getting a NOIR/NOID 6 months at least from the interview date/ that will be in October or after
it will tell u if u need to respond with proofs to overcome or appeal to overcome / both need actual proofs to change the outcome
have u done anything since marriage to show u started to commingle assets ?
or
made more trips to be together?

Kabar reacted to milimelo in Revocation of Petitioner
What are you providing under revocation from petitioner? What’s your wife sending you to include?
