    With that on his record the chance of him landing a good job is slim. Good jobs require background checks and Moral character checks. What will he do for work? Can you be the bread winner? He may get frustrated with the way things are going and return to a life of crime. Spending 6 or 7 years in jail changes a man and not for the better. Think about your future. I have 3 daughters and spent 33.5 years in law enforcement. He has a lot on his plate just to get back to normal. Getting married should be last on his list. Do yourself and the people who love you a favor. Do not pursue this man. I think you'll regret it.

    Yes, definitely not a simple crime. Young people can commit dumb mistakes but this kind of crime is really bad and I bet you that was not his only crime in life.
     
    So, He has been incarcerated for 6 years and in 6 months speaking with you he wants to marry. If this is not enough red flags for you I don’t know what can be. 
     
    He can definitely be an amazing person in your eyes but he is living isolated of the world and everything right now will sounds magical! Be really reaaally careful, financially, financially and emotionally. Get a lawyer and get a copy of all his records. This is not a DUI thing.  Be extremely cautious.

    Not an expert on it but for those with pending ROC, I’ve seen reports saying that their spouse waited in the waiting room or outside the office. IO can have them come in.
     
    With the pending ROC, yup, I would definitely bring your spouse and just have him as close by as possible. Hopefully your office allows him to wait in the waiting room.

    You have not waited long enough. 
    Noa1 can take up to 30 days from when it was received not sent before you are even eligible to contact the lockbox.
    Calling is discouraged. This is not a reason to call them. 
    Your shipping status days or was received. 
    Again, relax.
    PS. No you cannot cancel it just because you made many errors. You have to wait for RFIE / RFE.

    Sounds like you are really young. Am my right?
     
    One super important thing that you need to start to research and understand is the limitations of a ex fellow person in the US.
     
    Maybe you are not seeing this right now but a relationship where you prefer towards ridding it from others isn’t a good sign.
     
    Please be really careful because not just this relationship sounds very new but also the consequences after this can be harder than you think.
     
    How long have he been incarcerated? What as the charges? How old are you both?
     
    This is not judging you! I’m just trying to make sure you understand how life can be without pink glasses.

    How would he be able to afford that much time off as a tourist?   That will be the question CBP has.   B2 holders are not permitted to work at all in the U.S., even WFH/remotely.

    He cannot adjust status through you as he does not have a current I-130 priority date...per the March 2024 Visa Bulletin,  To adjust status, he must have a current priority date, and he must remain in legal status until he adjusts status.   If you were a US citizen, it would be different.

    The previous people I've seen on here who have married prisoners and then filed the Spouse visa application have done so because their partner was going to be in prison for a long time - years -and they wanted to be there in the US to be able to visit on a regular basis. 
     
    In your case, as he's getting out in a year, I'd give you the same advice I'd give anyone who has begun a relationship with someone online and from another country - give yourselves a lot of time to get to know each other in different circumstances. First face to face - and then in your case face to face outside of the prison environment - meet his family, meet his friends, see if your goals and futures are compatible, see if your living habits and needs are compatible. 
     
    THEN... make the big life-changing decisions about marriage. Work out what his prison record means for his travel options, will he ever be able to go to Switzerland with you? If you have children with him in the USA then you will have to commit to living there until they are adults if he can't leave the country. 
     
    This is what I'd advise to anyone in a relationship where there has been little in person experience of each other.

    Filing a standalone I-212 should happen AFTER the I-130 is approved and AFTER the IV fee has been paid with copies of the receipts provided at filing .

    Without an APPROVED I-130 there is no means for applicant to pursue re admission .
    I-212 cannot be conditioned on ‘ IF my I-130 gets approved ‘ 
    No matter how strong your case, approval is not guaranteed 
     
    Because the denial states a consular interview is required , therefore implying  Visa Refulsal with Inadmissibility charges is also required. it worth researching for the specific section of law for stand alone I-212. 
     
    Your time to appeal is limited so get TWO new attorney consultations to review the denial before filing I-290 B appeal

    IT may be necessary to refile the I-212 after the I-130 is approved…so you can have current attorney do it for free. …

    @bitsofbrandon did the lawyer look at the documents leading to your partner’s revocation of F1 visa 5 year bar and request the FOIA record of your partner before advising the 601 is not required? 
    If this is so, I would follow the advice of the person you paid or have another attorney look over the paperwork to make sure everything is correct.

    Sorry to be honest but her changes that he could get a Tourist visa is really low, even more if she will not be the one paying for everything, if she does not have stronger ties to her country. Single, young women from South America normally are high risk because a lot overstayed their visas.  
     
    Looks like you both are looking for a “testing dating” visa. There it’s not such thing. 
     
    I advise you, if you work from home or can find a job like this, to before applying for any immigration visa, spend a lot of time together.
    I’m not saying that this is your case but unfortunately a lot of people rush the decision to apply for a immigration visa, because they want to be together as soon as possible (and could not get any non-immigrant visa), and this is not just frustrating but also really expensive. Immigration is a long term commitment!
     
    Mexico is also close and she can move closer. The F1 visa is just a excuse to be together because she can study English in so many other places.
     
    Other things that you can do to help your relationship is to learn about US immigration and to learn Spanish (if you still don’t speak!).

    Children under 18 may need a Letter of Consent to travel internationally without both parents.
     
    the main concern at embassy interview and at CBP here in the states is human trafficking and the need to protect those most vulnerable/ this is a concern for embassy to approve even if she turns 18

    Firstly WVP/ESTA is maximum 90 days stay, not 3 months.
     
    If she has not yet applied for ESTA she should do that asap, no point even thinking about anything else until she has that approved.
     
    Is she not studying? 3 month away from PH is a long time for a student aged person. I would assume that would be her strongest tie to PH?
     
    If she is traveling by herself, for the first time, then she will need to convince them in PH at the airport to let her travel as there is the possibility of being offloaded. She should have to hand documents to show who she is visiting, such as copy of your passport, AoS that her expenses will be covered etc. PH is very strict when it comes to allowing young females to travel abroad alone for first time.

    Unless you have a good reason to expedite… I wouldn’t try. “Because I want to see my boyfriend” is not a great reason and could greatly increase a denial.
