First of all I took advices from many of the lawyers but they told me to wait for them to respond.

FOIA received and according to the immigration lawyer that everything is good and there is nothing to worry. He told me to wait for the response.

It's Pakistan and yes I visited alot in last few years and I don't have any plan to move there.

Did you read the FOIA? Can you upload here without sensitive and person information?

     Hello everyone,

After consulate interview in 2021 they returned back my petition to usics for further review and today I contacted uscis and they said that they received the petition for review in 2021 but in Jan 2023 they sent the petition to NVC.

Can anyone tell me what's going on because I haven't received any letter from the uscis or nvc

Have you ever contact a lawyer about the “Revocation of Petition” thing?  About the marriage fraud or something like this.

What about request FOIA? Maybe this can show anything that you are missing.

What’s your husband country? Have you visited him more times? Have you ever thought about moving to there?

I really need guidance in how to get my siblings to the USA to join me after impacted by the current war in Sudan?
    urgent help is appreciated

Unfortunately there is not an especial visa for your  siblings case.

You can read about refugee visa, but my advice is if they are in danger the best and fast solution is prova find a near country. US immigration is not a simple and fast process.

Like @Boiler said, if you use a normal process for siblings visa, they waiting time right now is 15+ years.

Just a fact: In 2023 at least 32 countries currently in war and conflicts and not all countries had gained US immigration benefits.

I’m really sorry about your family situation. I hope they can find a safe place ASAP!!

    Good Luck

what??? man, that's too long. I need her soon as my health condition is bad and i need help from her. I tried tourist visa but failed.

Yes, my husband will be a joint sponsor.

Is it she a nurse or something? If you need just a família support for this period , immigration visa is not for this.

Even if she was applying for any other visa (not tourist) Will not take less than 1 or 2 years.

Sorry for that and I hope you get better soon.

  5. 5 minutes ago, Utha said:

what is that mean that visa number will be available in 20 years? but she can come iASAP once they approve the petiton, right?

N.O. . There is not adjust of status too, just for you to know. She cannot live in the US without an Immigration visa.

Do you have a Joint sponsor? Will your spouse be the one?

  6. I didn’t sent any photo.

    On extra evidencies I sent:

My I-751 extension letter (so they could see that I was still waiting for that, in hope to get a combo interview)

    Some trips that we made.

    Some medical bills

And some renovation paper that we did on our home.

My case is already approved and I’m a US citizen now.

I hope this can help you.

    Good luck

    Hi everyone,

Many apologies if this has already been addressed, but I couldn't find it. I just completed my N400 + I751 combo interview on May 12th and the officer told me after my N400 that he noticed I had an I751 pending and said he doesn't have the file but could do the interview. My husband was waiting outside and I asked him if he wanted me to call him in and he said that wasn't necessary. So he completed my interview (what I'm doing, where we met, if we have kids etc) and then said that he has to put in a request for the I751 file to be sent to his office but I passed my N400 and I wouldn't get a green card. This is all fine, and the next day I got a notice from USCIS saying that they received a request to move my file but I haven't heard anything yet. Has anyone had a similar experience and if so, do you know when you found out that your oath ceremony was scheduled? Thank you!

Hi. Mine was almost like this. I get a notice 1 week after interview about my Oath appointment

Everything we do is legal, we will not lie on the applications.  We are married and I would like to take her home with me while we wait for her visa

    Unfortunately this is not possible.

This is what everyone want, be close to their love ones during this long and stressful process but this is not how immigration process work.

Again, like I told you, there is not shortcut. Maybe you think I’m being rude but this is not my intention. I’m not trying to crush your love story! I’m trying to bring you to the reality of this process. If you have the possibility to live with her on the Philippines or anywhere else, this will be my suggestion.

She cannot, per example, apply for a Tourist Visa and live here in the US with you for 2 years (time that the CR1 normally takes). This is not the purpose of the tourist visa.

If she have a nice job waiting for her, you can check if they want to sponsor her, but even this one will not be quick.

The best right now is focus in learn the process IMO. You will find a lot of “shortcuts “ ideas that can create a lot of unnecessary problems in the process.

2 years will flight fast and when approved she can live here with you happily!!

    good luck

  10. … you received a lot of good advices on your last post.

Spoiler alert: There is not back door, fast way or nothing like that on immigration process. You will have to apply and wait like anyone else. If you have some amazing circumstances that maybe can convince USCIS to expedite your case you can always try this.

Be careful with shortcuts, this can put more obstacles in your way. Do the correct thing is always the best choice.

If you are impatient you can always move to her country or to a third one that both have the rights to be a resident.

    Good luck.

  11. Is she an US CITIZEN? How can you apply for a US passport for her?

She doesn’t have the rights to obtain an US Passport just because she married you.

About this point: I need some advice on this, he also said I would need to marry her again in the US

Not true! Your marriage is valid in any other country if was made based on the local laws.

Please, explain your situation better because what you are planning is not right

    .

Look the Guides here on VJ and on the USCIS website. You both need to educate yourself about this process.

I have my N400 next week. I am under the 3 year rule, my I751 is still pending and my interview notice makes no mention of a combo interview. I will take the wife anyway just encase

Here is what I plan to take

    Listed on N400 letter

    N400 letter

    Green card

    Passports

    Marriage cert

    Spouse birth cert

Selective service......I came to the US when I was 31 so I am out of the window for selective service.

    Other

ROC evidence package that was originally submitted

proof of marriage since then : Tax returns, deeds on house in joint name, car and medical insurances in both names, bank accounts in both names

I feel like the above is enough. My ROC interview was a breeze so hoping this one goes the same way. That said, is there anything else I should include in the above?

    Thanks

I also didn’t get the combo one but I added my Extension letter for the I-751 on my documents for the N-400. The agent didn’t not interview me for the ROC, he approves without interview. My husband was with me in case my he (USCIS agent) told me that everything was fine and just I just did the Naturalization one.

I hope they do the same with you.

    Good luck

Removal of Conditions does not affect Citizenship timelines. It needs to be done, yes, but I don't see how focusing on it instead changes anything for the OP.

OP, you could always apply for a reentry permit if you plan to spend an extended period of time abroad but be aware that the amount of time you stay out of the US might affect your ability to apply for citizenship and that would potentially delay your citizenship process even more.

    https://www.uscis.gov/citizenship/continuous-residence-and-physical-presence-requirements-for-naturalization

YES! Does affect for sure. @SalishSea is 100% right.

Timeline is from start to finish of the process.

Even if she is pass the interview she will not get citizenship finalized before having the I-751 approved. So the Citizenship will be on hold until the Remove of conditions is done.

@PaulaCJohnny Great. I missed that entirely (removal of conditions). Did you go through that step? If so, how long did it take?

    I am in Tennessee.

And I do not mean travel for leisure. I mean, my parents are getting sick, so my sister will need help in my home country. This is why I am asking about the time I can spent out of the USA each year without compromising my marriage / citizenship. I am just basically trying to find ways to navigate the situation.

The Remove of conditions right now when applying they sent you an extension letter for 48 months (4 years). Some people waited that long. I applied for citizenship and this speeded my case I guess. I did based on the recommendation of others member here and really help my process.

I hope others can comment here soon and give you more ideas. Good luck again and I really sorry about your parents situation.

    Hi all,

I am wondering afer my spouse receives a green card through CR1 visa for my fiancé that he has to move to the US? Is there an official number of days? Thank you!

    Best,

    MJ

She Will not received a greencard. She will, if approved, received CR1 visa that will be attached to her passport. Once the visa is given she will have 6 months (from the date of the medical exams) to enter the US.

Once here (and after pay the $220 fee) she will receive the Greencard. Mine back in 2019 did took 1 month to arrived.

    Good luck.

5 days ago, 2023. Is it a normal thing please. When should we be concerned?

No. You are dealing with an immigration process and for a lot of bureaucracy. Do you have any idea how many cases they deal per day? Thousands if not hundred of thousand!
Like @SalishSea said you will need to take a huge dose of patience because sent the case is the easiest part. Now you have around 2 years of waiting if everything in your case is ok.

Your petitioner will receive a confirmation by mail too.

Good luck and be patient for not get frustrated all day, will be a looooooong journey.

If after an  interview your spouse was denied a visa,  and after a month you email the consulate and request for another follow up interview to reconsider their decision saying you have a new evidence and the immigration schedule another interview, is it a positive thing? Because I know if you are denied a visa your application is returned back to the nvc as said in their email.

Does not happen like this. What was the denial reason? Is this a CR1/IR1 or K1?
