A.R reacted to carmel34 in Abroad spouse need an ITIN
You are correct, everything needs to be sent on paper, with wet signatures, look up W-7 and do more research on how the process works, and the different options for submitting paperwork.  Some send in the foreign spouse's passport in the mail with the W-7 and 1040 paperwork.  There is also a way to get a certified copy of the foreign passport in some countries so the foreign spouse is not without a passport for weeks and weeks.  We used an certified acceptance agent in the UK when my husband and I were there on vacation, the agent came to Heathrow Airport, reviewed the W-7, looked at his passport, certified the W-7, and sent our MFJ 1040 with attached schedules that we had both signed to the IRS.  Some couples decide to file as married separately to avoid the hassles of the W-7, then file an amended tax return later with the foreign spouse's SSN, after US entry, to get the higher refund.  Good luck!

If an ITIN wasn't available then why does the IRS have acceptance agents located in foreign countries.   You received bad info.

VJ estimates are based on data entered by members.  For the official USCIS estimates, check here -- https://egov.uscis.gov/processing-times/

follow the guidelines on the IRS site
and you will need original  marriage certificate along with the tax returns
you should have a POA from her giving you permission to sign her name on 1040
the only time to apply for I ITIN is when you do tax filing in 2021 (ASAP actually helps a lot-don't wait till April 15th)
you send all documents along with 1040 filing married joint if you want the extra deduction
and the 1040 must be paper filing / sites for online don't allow for W7 and documentation that is needed to be sent

    congratulations on your marriage

He can file jointly with his spouse.   He cannot claim her as a dependent

No,  filing single would be wrong, but even that might probably does not have an impact on the immigration process.

and some file separate but the loss is  $12, 200 that he can deduct by claiming the wife

    Hi!

We filed online, I highly recommend. When it comes to photos I created a powerpoint presentation with 2 photos/slide, I added dates and locations (or some short explanations) under each photo. I saved it as PDF and that's how we uploaded it

Correct.  You visited.  You did not reside at the same address.  It's OK.  Most of the members here never lived with their spouse or fiancee until after they got their visas.  It's just a question, not a requirement.

Yes, you will upload it. Eventually it's going to ask you: "For whom are you filing this petition? Select the relationship the beneficiary has to you (e.g., if the beneficiary is your parent, select "Parent")." When you select "Spouse" it says the following:
You selected you are petitioning for a spouse You will need to upload the Supplemental Information for Spouse Beneficiary (I-130A) as a part of the evidence for this application.
If she is currently outside of the US then she doesn't have to sign it, but it still needs to be uploaded. Later in the Evidence upload section:
Supplemental Information for Spouse Beneficiary (I-130A)
If you are filing for your spouse, he or she must complete and sign Supplemental Information for Spouse Beneficiary (I-130A). If your spouse is overseas, the I-130A must still be completed, but your spouse does not have to sign the I-130A.

No. Do NOT put that address in Page 2 of I-130.

Reminder that she needs to fill-out I-130A Spouse supplement: https://www.uscis.gov/sites/default/files/document/forms/i-130a.pdf On Page 1 of that supplement she'll provide her address history.

    No.

That is, no, unless you actually moved there - moved out of your US home/apt, changed address at work/bank/credit cards/utilities (phone bills).

You would enter the address as your wife's address as part of her information.

The purpose of your address history is to check that you have residence in the US and to perform a background check on you.

Put those numbers in so they can look up your file faster. It is recommended you type “None or N/A”.
