Bayanoparker02 got a reaction from daveycrocket9000 in AOS Joint Sponsor - Household Size?
The Joint Sponsor will fill out his/her own application and count you as a member of household size... Your wife will fill out her own application including YOU.
So, your wife household size is 4( you+her+ 2 childs).
As you need the Joint Sponsor, his/her household size will be 2 or 3(her + you and/or child)

Bayanoparker02 reacted to Ayrton in Rejected I-765 (used the old form)... Some questions inside, pls help.
It's not concurrently because you're filing after. But your EAD will always be free because your have a AOS filed before Oct 2nd. It doesn't matter if you file after that. The fee change would only affect people who file for AOS after that.

Bayanoparker02 reacted to Timona in No Blank policy
1. Never heard of a no blank policy. I left mine blank and had no problem. Others have written N/A and had no issues.
2. If you or you wife is filling the forms and understand English, then leave the translator, interpreter, representative parts blank.
3. If this is your first marriage, then leave prior marriages blank or N/A, whichever suits you. If previously married, then they have to be filled and ultimately, a divorce certificate will have to be included with the petition.
4. Well, list addresses as applicable.
5. You can always come back to VJ and ask if you have more questions, don't be shy. That's what we are here for.
Feel free to PM me if you need further assistance too. Otherwise, post here too.

Bayanoparker02 got a reaction from Bgail in Please help to go through my documents.
1- NO... It's good for you to send it. You ain't losing anything by sending it as you already have it. "Better send something than nothing." They will put it a part themselves if they don't want it.
2- Chicago Lock box is one of the 3 lockbox locations. Residents of Georgia should send it in Chicago.
3- NO STAPLES. READ THE INSTRUCTION VERY CAREFULLY. Paper clips is accepted.
Good luck.

Bayanoparker02 reacted to Duke & Marie in Does the beneficiary have to provide tax transcripts?
If the information isn’t available, put in the figures you believe to be correct and write a statement saying it’s been delayed for whatever the reason is and that you’ll provide at time of interview..
i wrote about 3 statements for similar things (education certificates/military records etc) and the i485/i944 was accepted for processing..

Bayanoparker02 reacted to Liam2021 in i-944 Education
Guys, the i-944 only asking if you have any degree outside US. If yes, just fill in with the name of the school or university and that it. No need to evaluated it. Evaluated your foreign degree is needed if you decide go back to school in US or apply for a job which required college degree.

Bayanoparker02 got a reaction from MariMM in AOS Application Returned
Hey
Just resend everything back like you received it - I probably assume that it was assembled in some kind of weird way.- And in a new plastic folder, you put just the update form they asked you to provide with everything new they updated since the date they rejected your application and put the green sheet in that plastic. You will have to unstaple in order to remove the green sheet and staple them back.
The current version of most of the forms is October 15 and it's located at the bottom of each form. Since they sent you back everything, you will need to provide the new I-944 form with all the supporting documents.
Don't worry about the "Medical form" as it has been open. It will be a proof that they are the one to open it.

Bayanoparker02 reacted to Lil bear in Who pays for your immigration fees?
It’s going to be a decision that each couple makes themselves. If we were in that situation, I wouldn’t be sitting with “ it’s your immigration not mine.. you pay for it “. My thoughts would be it’s “ our” immigration... “ our “ life choice ... “ we“ will pay for it together. But that’s just me.

Bayanoparker02 got a reaction from Vistoria in I - 765 Expiration 05/31/2020 on USCIS
Check out the version of the form too... it's located at the bottom left of the form. You can have a valid form but when it's outdated, they will rejected it.

Bayanoparker02 reacted to juancarlos in Paying AoS with credit card
Yes, that might happen but well, reading the form and form instructions... nothing about that is stated. On top of that I cannot understand why we only could use our own credit card and not our wife's cards.
Hopefully I do not have problems with this,
Thanks

The joint sponsor will sponsor only YOU and possibly his/her child if under age.

Expiration date is irrelevant and the version of the form is the only thing that matters

Bayanoparker02 reacted to Villanelle in I-485 HELPPPPPPPP
I understand the reasoning used by @Bayanoparker02 - Many people (mistakenly) think that if you check of yes to certain questions the form is going to be denied no questions asked. That is simply not true. There are certain things that can prevent you from being eligible for adjustment of status. Checking off the incorrect answer does not change the facts. It actually causes more issues because at the bottom of the form where you sign you are signing under penalty of perjury that all the info is correct. If you have to answer yes to a question and feel you have additional things to say about it you can use the part of the form for adding additional information or wait for it to be addressed in the interview.
If its an issue that can NOT be overcome then there is nothing you can do to overcome it. If it can be overcome then you are always given the opportunity to overcome it - either during the process or through an appeal. Even when you cant overcome it they give you an opportunity to.
As an example- my first husband had a lot of issues I did not know about. I was very young and naive about immigration in general. After many years I encouraged him to apply for citizenship as other members in his family were doing such. He was reluctant but finally applied. We went to his interview. It was very strange. When we got there they put us in a separate waiting room with a private guard. (?) Then the Officer came out and made an odd comment that my husband didnt 'look like such a scary guy' and said I was welcome to come in to the interview and told the guard he didnt have to come in and could just wait in the hall. So I went in with my husband. They chatted for a bit and at the end the Officer said he could not approve him right now due to his criminal record. He gave him an RFE type sheet asking for paperwork for an attempted murder charge- something I had NO IDEA about since it was before we even met. The Officer presented it in a way that made it sound like just show us the paperwork and we can then approve you. When we got home I looked into it a bit and the truth is no matter what paperwork he presented he would not be able to naturalize. Not now, not ever.
@Johnny6751 Did you post this in the correct sub forum? Are you doing AOS from work or student? Or did you post here because you were a tourist at one point? Is your AOS based on marriage? Unauthorized work is not an issue if you are spouse of USC. If you are not it can be an issue preventing you from adjusting. Otherwise I agree with all the answers @Duke & Marie listed. Another concern when you have unauthorized work is if you have been paying taxes (usually they are paid with an ITIN). It can also cause issues depending on how you worked (if you used false documents or ever claimed to be a USC vs just getting paid under the table).

Bayanoparker02 got a reaction from Crazy Cat in I-485 HELPPPPPPPP
@ra0010 in that part I would have said "NO" and then find a good way to respond when I will be in front of them...
@Johnny6751 When filing your forms, you have to be very cautious. Even if you did something, always said you did not especially in PART 8... when you said YES, it makes your case more difficult than it is. Your only affirmative answer should be about violating your non immigrant status in that part.

Bayanoparker02 reacted to Penguin_ie in Negative attitudes in the forum
I wanted to address the negative attitudes we have seen on the rise recently in the upper/ immigration forums towards those who ask beginner/ simple questions, or have unusually fast or slow VisaJourneys.
First, there is a tone difference between the Progress forums- which are mostly for support and cheerleading, and the Info forums, which are mostly to have questions answered. While all our forums are supposed to be welcoming to all and friendly, this is especially important in the Progress forums, which are not to discuss politics, or be negative towards those fortunate to have their case dealt with quickly, or critical of those who voice sadness about their own slow progress. These forums are there to uplift eachother!
Secondly- in the info forums, you may get bad news. When a question is asked, our members are encouraged to answer truthfully, even if this may not be what the Op wants to hear, because it is important to be informed. However, the emphasis is still on being welcoming and friendly. If you need to give bad news, do so gently, and stick to facts; constructive criticism of the Op's plans ARE allowed, but the emphasis is on constructive. No need to dwell on mistakes (or tell members they should be on 90 Day Fiance- that is a personal attack and automatic suspension), or illegal actions in the past- instead, encourage and explain legal options for the future. And ONLY legal options- as per our TOS, VJ does not support, condone or encourage illegal (immigration) actions, and such posts will be removed.
Ultimately, we are here to help all members, old and new, easy cases and complicated, those who write a fact filled bullet point post and those who are panicking and don't make much sense in their first post. Yes, sometimes questions can be easily googled, or answered via a search of our forums. But if you feel that way, just scroll past- no need to criticise the OP for asking the question.
