Understandable. The process is stressful on its own and this unexpected mistakes make it even worse.
    Things will be fine. ☺️

The simplest thing to do is actually attend the interview, bring all your documents including your GC and explain the situation to the IO.

This is a good question. For all those piling on the OP for not doing dna, he did say it was voluntary not required, so maybe an error of judgement but the “you didn’t give them what they wanted” statements maybe a bit harsh in context. Remember most people (1) do not hang out on VJ all day (2) would think a lawyer knows what they’re talking about.

from OP’s earlier comments I am not entirely sure he understood “refile” means do everything over again for a brand new petition, but hopefully he realizes that now. And yes dna to help eliminate doubt this time is advisable.

And I am telling you you're wrong.  You need to have the funds UP FRONT.

There is no sponsorship as there is for family preference visas.

I'm glad I could help! I know next to nothing about ESTA but now I know that if you apply on the weekend, you'll get a delay.

You know, you were absolutely right! I forgot it was the weekend yesterday - that must have been why it took extra time. I checked lots of times today, and yes.. now both applications are finally approved! Around 29 hours after submission. Covid travel is nerve-wrecking. Especially when you haven't seen someone in a long time, and it could all hinge on a single piece of paper.

Thank you so much for helping to calm my nerves, millefleur. Spasibo!

PS: If anyone else finds this post at some time, I wanted to say that when the payment details are missing, it doesn't mean a thing.. It is now updated with information and shows as being paid today at 3:34pm (even though I did the payment and my credit card was charged yesterday). All three fields were blank until the application was finally approved. Not sure why this doesn't show earlier, as the fee is non-refundable. Just thought I'd share this in case someone is wondering the same thing.

Found this: "If you apply for an ESTA on the weekend, you may expect the application to be processed within 72 hours or three days."

Maybe it's something as simple as that. Hopefully you will get an approval soon.

As long as you already have a valid US passport, that will be your proof of citizenship without any issues. It should be accepted just about anywhere as proof. I would save the money, and not worry about the actual certificate.

I already answered your question about updating it: go to a Deffered Inspection Location and verify the error with CBP and have them update it from their end and then file a new I-90 with very clear cut la guage about your marriage date, date of entry and their own policy about 2 vs 10 year cards.

The CBP officer should have updated it then and there. But now your husband has been recorded by CBP as entering on a CR-1 when they should have recorded him entering on an IR-1.  The exact status that a person is recorded entering the US with is extremely important and all government agencies will argue that it is the traveler's responsibility to ensure all information is correct. USCIS is not the same as CBP. They do different things and are run independently from each otber but work together so you should also go to a Deferred Inspection Location to have CBP update it on their end.

FYI: I've been to a Deferred Inspection location once because the agent stamped my passport as "B2 Tourist/Visitor" when I was actually entering with my F-1 student visa. I didn't realize until I got home and my school's international advisor told me to go to the Deferred Inspection office because obviously I was not a tourist at the time. I went, they changed it and all was fine.

Side note: why is the site showing ads with a really gross image of a person's hand with holes and worms coming out of it?? I'm here to help people, not get grossed out?! 😬

Only USCIS can update the card to IR-1. I-90 is the proper method, USCIS is just refusing to understand the situation it sounds like.

Edit: I also recommend making an Infopass appointment and talking to someone face-to-face at USCIS, if possible.

Ok this is the reason for the confusion. He should have gotten IR-1 since CR-1 is only for couples married less than 2 years on date of entry. Technically, the border agent should have caught it and updated it or your husband should have asked for it to be changed to IR-1.

Before you file a second I-90, you probably need to go to a CBP Deferred Inspection location to have CBP update it from their end too. List of locations here: https://www.cbp.gov/contact/ports/deferred-inspection-sites

Was the payment successful ? If it was, you will receive an email with a receipt number.that’s your receipt number, you can check status with this number.  No need to wait. No info pass needed. If the payment isn’t successful, just consider reapplying

El Escocés reacted to millefleur in DCF Frankfurt with US job offer for non-US beneficiary?
USC needs the job offer. I don't think it would count as a humanitarian reason if a German citizen had a job offer, especially since Germany is a safe country. Also, you've already filed the I-130, so nothing you can do realistically now but wait it out. Does your job offer include US visa sponsorship? That might be the only possible alternative here.

El Escocés reacted to millefleur in B tourist visa while married to a US citizen possible?
Hard to say. I've been in this exact situation (American living abroad for years and I had a proper work visa and job and everything) and the US consulate/embassy does not consider anything about the American spouse. It's kind of frustrating but the applicant is the one who has to show the ties. Since there's hardly anything asked about concerning the American spouse, I have no idea how the USC spouse can show ties to the foreign country they live in. It seems to me as soon as they see that the applicant is married to a USC (regardless of where USC lives), chances of denial shoot way up for a B visa.

Still worth trying as you never know, it sometimes depends on the nationality of the applicant. Applying for a B after you already submitted an I-130 petition would make it even harder to overcome intent to immigrate. Just things to be aware of.

My condolences  . I saw your post earlier this week, I'm so sorry that you were unable to be with her during that difficult time and that other people played down your worries and frustrations. This process is so unfair, you should have been able to be with her. I pray that you and your family are able to find some healing after all of this, please take care of yourself.
