    Update:

November 15: NOA receipt notice, Nebraska Service Center

We haven't received anything in the mail yet. I checked the USCIS online account and found PDFs of NOA, as well as the notice previous biometrics will be reused. Both were dated November 15.

It's also showing the "case is being actively reviewed by USCIS" message dated November 15. And there's a message from November 8 that they received our package. Text notification was sent five days later.

@top_secret Good luck! Thanks for starting this months thread. We're working on my husbands packet right now.. I think our 90 days starts this week. We're hoping to get it done in the next week or two. I am so over the immigration paper work... I can't wait until we can just file for his citizenship, so we don't have to do it anymore (which he might get before getting this 10 year green card... or so I think according to the processing times.) Does anyone know how they decide which service center to send the I-751's to?

Just had our aos interview (adjusting from k1) yesterday. It was the longest 30 minutes of my life.  The officer said  give him 1 or 2 day to review the new evidence we gave him, and then he’ll make his decision to approve or mail us a letter if he needs more information.

2 days before our interview, my husbands EAD and I131 were approved! So at least he can look for a job meanwhile. This will be a combo card right? We applied at the same time.

Just wanted to update my fellow 'adjusters':
We had our interview last Tuesday and were recommended for approval. The card should arrive in the mail this week
It's been a long and difficult journey but now we can finally look to some normalcy in our lives again. This forum has been an invaluable resource to us!

My husbands status never showed bio appointment was scheduled. It was actually weird how it happened. We got a REFIE in the mail one day And the status updated online saying they asked for initial evidence. Then 2 days later we got a biometrics appointment in the mail telling us to go in a month from them, but nothing Ever showed it was scheduled online..

The next status online showed that they received our RFIE answer, and it never updated to show his biometrics we’re taken. I think as long as you have a paper official letter from USCIS you’re good, the online statuses don’t really matter as much because they get delayed or never updated (that’s my personal opinion  though)

Lrjohnsona reacted to R. Wolfe in Got a biometrics appointment for a cancelled AoS?
We filed the Adjustment of Status and it got rejected because the payment failed.
So we refiled and that's been going along fine.

Last week we got both a Request for Evidence (more tax forms) and a Biometrics appointment letter.

The issue is that the Biometrics letter has the applciation number from the previous, rejected,  AoS (MSC#########) on it.
I haven't been able to get in touch with a human at USCIS and the appointment date is approaching.

My question is whether we should go to this appointment.

Is there any chance that the Biometrics appointment could be for the current AoS? Would they schedule a Biometrics appointment while waiting on an RFE?

I'd really like to be able to just update the MSC number to insure that this Biometrics data goes to the current application so things will process ASAP, but I also fear messing things up further and incurring additional delays or fees. Any ideas or help is much appreciated. I will continue to sit on hold with USCIS as time and phone charge allow.

Lrjohnsona reacted to mushroomspore in Bomb drop...in-laws want to immigrate to USA. HELP
My parents (more specifically,  my mother) has made "jokes" about me petitioning their immigration to the US after I become a citizen. It has never progressed to any serious discussion but nonetheless, it is a majorly hard-cold NO from me. You're an adult. You're allowed to say no. "No" is a full sentence. You're allowed to enforce whatever boundaries you have to with your in-law's for the sake of your mental health and that does not make you selfish. Trust me, I went through therapy for 1 year (as a full-grown adult in her 20's!) and it took me that long to untie myself from those feelings too; I felt like a bad person for wanting to say "no" to my strict/overbearing parents, even after I had moved away from Canada and to the US. But that said, since it's your wife's family, it's really on her to enforce the boundaries. If you want her to grasp how serious this could be for you guys, one idea would be to go together to an appointment with a lawyer and possibly even a marriage counselor to drive home into your wife's head how uncomfortable you are with this situation and how it would affect your marriage/lifestyle.

Just wanna add....your wife would be able to petition her mother right away if your wife is now a citizen (which it looks like she is). But your wife's sister will be waiting, at minimum, 1 decade. Most likely longer.

Most likely Tax or birth certificate translation, did you send 1040, w2s for tax year 2020?

Mine was tax year 2020, I didn't send that as I had not filed taxes yet and the deadline had not passed yet when I sent the AOS package. So my RFIE is that!

I got it all ready but I haven't sent it yet because I am double verifying everything. I learned that 864 requires the `total income` and not the `adjusted gross income` when using I-864 from the RFIE letter

    From the instructions:
"For purposes of this affidavit, the line for Total Income on IRS Forms 1040 and 1040A will be considered when determining income. For persons filing IRS Form 1040 EZ, the line for adjusted gross income will be considered."

I think I used the adjusted gross income hehe another mistake.

Resubmitted AOS package (Original submission was March 11th, got rejection notice May 11th for wrong payment) with updated I-485 mailed it out May 13th. Arrived in Chicago May 14th. Received NOA1 via texts messages for AOS, Travel, and EAD May 31st in evening. Check not cashed yet, but it will be eventually. It seems my case was processed faster than other because of the rejection notice. They sent me a bright yellow paper to return with my packet.

No we just have to wait! We're at least a little more relaxed now that we have case numbers and know the USCIS has our case.

    Good luck to everyone! Cheers!

I'd take it out. They say they don't want it anymore after the 9th. I filled ours out, but I'm not sending it. (It was mostly just explanations of why various records are unavailable, and he would've had some negative marks so I'm super glad it's gone.)

Or I guess if taking it out would mean you'd need a new envelope, I'd probably just let them throw it out, personally.

We married on 2-19-21 and are just now getting to filing this.

Does anyone have any suggestion or a thread they can point me to regarding the order in which we should do it when considering a name change, as well?

Do we change the legal surname first?

    Do it after?

If anyone has experience with this please share it.

    Thank you!

    Thanks for sharing your experience!

OK. Here is my story: We had our interview in Milwaukee! It was scheduled for 8:00 AM and 8:10 the IO opened the door, called my wife's name and when we both approached, he asked me to wait 15 - 20 minutes because he wanted to have the interview with her and the translator. The TV in the waiting room was on and I killed the time watching  infomercial of vacuum cleaner!  After 40 minutes, at 8:50 he called my name, he asked me some questions about our relationship (how and when we met, my wife relationship with my kids, etc). He was writing down every single word that I said comparing what I said with my wife's responses. Then he asked me to see some evidences that we live together, (he kept copies of a few water/electric bills, proof that my wife is the Beneficiary of my 401K, life insurance). I pulled some extras, but he said those wouldn't be needed because he has already in the file. Then he asked me to see some photos but he did not keep any photos either. When we submitted the 485, we added a bunch of photos. In 10 minutes my interview was done.

My wife was not approved on the spot. In the afternoon, the status online was "Case must be reviewed". However, this morning, I woke up with an email from USCIS saying "New card is being produced".

BTW we did not have any attorney throughout our immigration process.  Literally, it was a DYI process.

For those who read this post and are still waiting for your interview, good luck!
