Both of them require a job offer and an employer to complete the forms and do labor certification with the department of labor. An EB3 is an immigrant visa, a H1B is non immigrant and usually allocated by lottery.
When you asked about EB3, I assumed that this was because a company had already made an offer and started the process. If you are just “checking” different types of visas, it’s probably a long shot that your son will get an offer this way as it is quite an expensive process for the company to go through and they will require very specific skills that there are a shortage of in the US. What are your son’s qualifications?

Well - you couldn’t apply for an Eb3 visa for him, it would have to be sponsored by an employer. But yes if he can find someone who can do that he can certainly have the two petitions simultaneously in process.

Agree but EB3s take time so if you are well into the process with a spousal then do not expect it to be quicker
Presumably the Employer knows? Not cheap to file an EB3

You can have as many immigrant visa applications simultaneously in process as you are eligible for. ( I myself had two side by side at one stage.) You can then choose either to go with the one that completes first, or with the one that is least complicated (for many people an EB3 visa would be less complicated than a spouse visa especially if the spouse visa only gives them conditional residence at first).

Yes thats true use Whatsapp in Brazil is very common and I just was trying to come closer of another Brazilians through the same K-1 Visa process,to make new friends and help because that is a long time process and many peoples feel lost and lonely, Thanks for your words you understand what I am trying to do, just help others and not attack anyone ;).

Thankfully no one is stopping her from communicating in Spanish, since Brazilians don’t speak Spanish. But just so you understand why she offered this group on WhatsApp....... Brazilians have a strong, and I mean very strong relationship with WhatsApp. When I moved to Brazil after marrying my wife I was blown away by it. You can order pizza via WhatsApp, request home internet service, schedule a doctors appoint, order parts and have em delivered, share pictures of your missing dog on the neighborhood groups etc. It so much a part of their life that phone companies even have monthly plans that include unlimited WhatsApp after your monthly data is up, that’s how big of a deal it is. I completely understand her idea, especially since there have been a few things I couldn’t find information on VJ that were strictly Brasil related but instead I was helped by our neighbors daughter who had gone thru process...... which leads me to my last point, not all Brazilians are on VJ. Honestly not many know about VJ, nor do they speak/ understand English.......so there’s a lot of people out there that could benefit off her WhatsApp group.

Não ligue pra as pessoas que não entendem a cultura brasileira. Sou gringo mas moro a 4 anos no Brasil depois de casar com a minha esposa e agora estamos quase conseguindo nosso greencard pra ela. Eu me choquei ao ver como WhatsApp é usado no Brasil pra tudo...... TUDO!! Fazer pedidos de pizza, agendar consulta, saber as últimas fofocas das vizinhas, postar no Grupo do bairro quando alguém perde um cachorro. Nos gringos não temos isso é a maioria não entende (o fato q ainda por cima falou pra te se comunicar em espanhol e suficiente pra te ver o quanto não sabemos de vcs). Em fim, parabéns pela boa ação. Acho boa idea, pois o Brasil não é país de agilizar as coisas quando se trata de documentos....... ficamos quase 5 horas na delegacia brigando com a delgada pra ela fazer o atestado criminal civil pra nos. Então sempre é bom compartilhar pq eu não achei suficiente dicas aqui no VJ quando se tratou disso na delegacia. Abraço.

I just gave $1,000's of dollars of information that most lawyer's don't know about. If you don't want to follow my advice that's fine. Don't turn down an answer to your question/problem if you don't even go and read the information. All you did is repeat your original post. I'm not going to repeat my answer as it still remains to be your best answer. Oy vey!

You do nothing now with the lawyer or NVC. NVC does not schedule your interview YOU do. Here are the links that you will need. Hank's website is excellent for step by step instructions. Guaranteed if you follow you will be approved of course if everything checks out to the CO's satisfaction.

Until laws change, there will always be people who abuse their temporary visas. Very few changes in circumstances should allow AoS. The whole plot of coming to visit, "suddenly" deciding to get married and stay should require applicants to return to their home country to do consular processing. How many couples with a valid B visa here could have easily "decided" to get married on one of those visits and skipped all the wait, all the separation? Yet, here we are... People have learnt to game the system; it's time the system ups their game.

Some VJ users may not understand that Facebook is hugely popular in Brazil, and Brazilians use it for everything at a level I had never seen before. I learned this when my then boyfriend, now husband, posted a photo on FB of us from my first trip to Brazil to meet him. Brazilians use Facebook to communicate with each other about anything and everything, it is a cultural thing so I get it. Now I use Facebook much more than ever to connect with my Brazilian friends and family. It has a really useful translation feature that is pretty accurate too. My husband joined a Brazilian Facebook group here in the San Francisco area shortly after he arrived in the US, and it is amazing to see how much information they share with each other. I think they like to know the identity of users when sharing information, videos, photos, messages, anything from asking advice on finding work to selling cars, adopting dogs, recommendations on restaurants, and it has a real sense of community which is very important to Brazilians.

I guess you should know a couple things:
- Once you get your NOA2, you need to check your country’s specific topic, because every embassy has different procedures for interview and medical exams. So any information from someone that’s from a different country isn’t really useful to you.
- We don’t speak Spanish in Brazil. We speak Portuguese.
- Everyone still reaches for the experts here for official information. The private groups are more for sharing personal experiences related to our specific country.
- I am a September filer and we have our messenger group from people all over the world. Everyone agrees that it was really good to bond with people who have the same visa timeline. We were just sharing feelings and our VJ topic is still active. One thing doesn’t invalidate the other. It just adds to it. You should try it.

Did you get a REF? We started my K-1 Visa process in August 2019 and I receive my NOA2 in November 2019, but remember each case is diferrent from another and you still are in the normal time,to some peoples it takes 2 months for others 3 months,5 months,7 months,etc...as i said each case is diferent to another,you can follow my timeline if you want and we can talk about our process fell free to contact me if you want send me a private message in portuguese and we can talk better .

Hi Jessica, Michella here I am in the same process as you guys and I know that not is easy all this process but to be with the love of our lifes it worth it! if you want I am avaiable to talk about our experiences, I still dont have my interview date yet but I am close too, and I feel so excited and happy did you pick a hotel at Rio already? Which one did you picked up if yes ? Where do you live in Brazil? I am from São Paulo- SP. Hope hear from you soon .

I did, back in January. The hotel itself is very nice. Clean, good food, nice pool area.
My then fiancé was with me, we had no problem walking to the consulate and back!
My interview was scheduled for 7:20, so even though it was before 7am when we left for the consulate, the streets were already busy with people commuting and the businesses were already open. It was not dangerous or deserted at all
