    What kind of Florida taxes? Florida has no state income tax...... She needs documentation showing that she is taking concrete steps toward returning to the US...such as looking for a place to live, seeking a job in the US,  talking with schools, etc.  Does she own any property in the US?

    I agree with above comments. This scenario is akin to a person submitting an application to sponsor Spouse A, but divorcing Spouse A, and bringing Spouse B  to US using Spouse's A application. It just doesn't work.
     
    There is no technicality that can be remedied, it's misrepresentation and the visa laws don't substitute sponsors/applicants like that.

    The CR-1 visa holder becomes a legal resident when he/she enters the US.  That date becomes the "residence since" date...the Green Card is valid for 2 years after that date.

    The reason you send to USCIS is in that 1st step ,  they review the documents to make sure all is correct/  their job 
    the case should not go any further without  an RFE to  correct the errors

    If you get an RFE, you will only have to send the required document (It will be mentioned in the RFE Notice) which document will be sent to USCIS.
    If you receive a rejection notice, then you will have to fill out new application form with correct details, and start the process again.
     
    Rejection --> New Application + Timeline Restarts 
    RFE  --> Delay in processing (Normal time required to process K1 i129F Application + 90 Days due to RFE)

    Hi Muzammil,  My wife just told me about your situation, Since i assumed based on your application timeline, you are in Pakistan..following are the document you will require to change or correct your date of birth on your birth record/certificate.    Birth Certificate of NADRA (with wrong date of birth) Matriculation Degree CNIC Father’s CNIC (not mandatory but just incase) Union council birth registration certificate (if require you must have it as well) If its issued by Nadra take it to any main or district nadra office (Not a Kiosk) some Union Council do it too ( if you have good contacts with them)    after you get your corrected birth certificate, make sure to get it attested from Ministry of Foreign Affairs Pakistan - Also from your local Notary and or Union Council    Now you USCIS application scenario,    if you got NOA1 per your timeline, heres a few things that you might come across   RFE - Request for Evidence (which is what i'm thinking), where you will require to submit your corrected DOB Cert.  Application Rejection - Due to records not matching (because of the form i129f application you filled will have your date of birth) hence USCIS will ask you to submit your application again from the scratch. "it might sound scary but its actually only due to records mismatch"  
    Now this all may sound horrific, But honestly its all a process, As long as you fix your record and do as USCIS instructs you to with accurate and correct details your application will be approved i.a.

    You may also want to keep or obtain some evidence of the official birth record from the hospital to confirm the birth date, just in case. USCIS won't know which birth certificate to rely on as the correct date.

    DOB should match, that is one indicator of your identity. You should get your IDs and Passport to match your date of birth.

    There is no 90-day deadline for filing AOS.  Also, the criteria for overstay is not dependent on whether AOS was filed or not.  Anyone who entered on a non-immigrant visa is considered overstaying if they remain in the US after the "Admit until" date granted by CBP or their approved Duration of Stay.  Filing AOS does not erase the overstay, but grants the applicant "authorized stay" even while they are out of status, as long as their AOS is pending.

    A marriage must be consummated ("finished") by both parties being in the presence of each other during or after the ceremony before USCIS will recognize it for immigration purposes.

    You must prove that the two people have met together within 2 years before filing the I-129f.

    I thought there were issues K-1 Visa holders were experiencing with prior travel bans, I'm not sure any of it was resolved or not. But, it's probably safe to travel before May 4th, especially since you don't know what the airliners will do and/or border patrol at entry to US. Better to avoid all these issues if all possible.

    Hi, we got interviewed last week. We were interviewed together, but I heard that it's up to the USCIS officer to decide the day of how they want to interview.  My husband got asked all the questions really. He was asked on how we met, how long we were engaged, married, etc. That was the longest narrative question we were asked.
     
    I was handling the documents and evidence we brought. You definitely need to bring originals of all documents, and copies of your IDs (including any EAD/AP you received) front and back. Hard copy of pictures, they keep some. We brought a ton, but they wanted the ones where we had no masks on. Also, ones where we had our families in. We were asked to identify the family members in the pictures, as well.

    One more thing, I just recalled. Remember to bring your latest Tax Return / Tax Transcripts with supporting documents. They take that.

    My husband had an international driver's license, and had to start from beginning in US (i.e., starting from learner's permit, taking driver's test and then getting regular US Driver's license.) Approx. 2 month process total, could've been quicker but getting an appointment was troublesome.
     
    So, answer to your question, yeah, just wait until you get to US. Though, I should qualify, I"m not 100% sure for whether Canadian driver's license are an exception here.

    Yes, it turns out we sent an illegible copy (i.e., some portions got cut off) when looking copies submitted. We went ahead and submitted same thing, but a clear color copy (both sides), and it worked. My husband received his combo/card, and we are awaiting interview date.

    Option 1) Fight the USCIS determination that you are not free to marry due to the existing partnership. Be prepared to reference specific aspects of law...meaning likely needing an attorney.
    Then be prepared for scrutiny of it again at the consulate...and you have no real recourse if they don't find in your favor again.
    This will likely add some decent time and a pretty penny to the process.
     
    Option 2) Legally marry and start over with the spousal visa process.
     
    USCIS would not ask for a marriage certificate for an I-129F, even if they knew you were married. They would only ask for a divorce decree, or other document demonstrating that the union was legally dissolved (death certificate, annulment, etc.).

    You may have to contact the Canada embassy to see if they can issue you a certified birth certificate. If you already are a Canada citizen, they should be able to produce this for you.
