Do I report foreign income on U.S. taxes?
JeanneAdil replied to Katzlat's topic in Tax & Finances During US Immigration
tax treaty with Canada has u paying the income tax to Canada You report it but file form 2555 to exclude the allowed amount For tax year 2024, the maximum exclusion is $126,500 per person. If two individuals are married, and both work abroad and meet either the bona fide residence test or the physical presence test, each one can choose the foreign earned income exclusion. Together, they can exclude as much as $253,000 for the 2024 tax year. https://www.irs.gov/pub/irs-pdf/f2555.pdf -

JeanneAdil replied to SolRebel's topic in Effects of Major Family Changes on Immigration Benefits
Ordinally Arizona does not have abondonment but in the case, he left you in major debt as you say, gather that info to take to the divorce lawyer and go for the separation in Arizona What is considered spousal abandonment in Arizona? 13-3610 - Abandonment of spouse; classification. Husband Moved Out
JeanneAdil replied to SolRebel's topic in Effects of Major Family Changes on Immigration Benefits
so very sorry this has not worked out for u way back in September 2023 you said you would not help him with AOS from now on let your head control as the heart is broken So, now he thinks he can move in and out/ he can't change the locks get a separation served on him let him pay for the divorce he may find out he has to pay you support as usually the man does here in the USA AND DO NOTHING TO HELP HIM WITH ROC LATER he will find out he can do it with a divorce waiver and he may find out the officer does not favor him in that interview read thru you I 864 and know your rights as its mostly a commitment to the government if he uses means tested benefits it does say the following: A. Provide the intending immigrant any support necessary to maintain him or her an income that is at least 125% of the Federal poverty Guidelines for his or her household size that is on page 8 of the I 864 itself At this point understand it may take years to get back to normal so take it slow and learn to protect yourself again, so very sorry, it has not worked out for u -
Is there any backlog for SA ? Timeline? (IR1/CR1)
JeanneAdil replied to AlwaysStressed's topic in Africa: Sub-Saharan
we are over 20 years and i made 5 trips and spent 10 months there to help i stayed busy here and visited family often as they live far away / i think holidays were the worst the time difference made me stay up late to talk so sleeping was not normal i also joined a gym to work thru the stress and volunteered my time with the handicapped adults Three things that allowed me to go for months 1. retired 2 set up all bills to pay online so i didn't need to be here 3. didn't have a pet at the time I registered with US embassy (as suggested ) in Morocco and with police chief in his city -
Green card December of 2024 he must wait till 2027 anniversary minus 3 months so he can petition September 2027 /not knowing the exact date i can not say when in September

Is there any backlog for SA ? Timeline? (IR1/CR1)
JeanneAdil replied to AlwaysStressed's topic in Africa: Sub-Saharan
yes, 6 years for immigration as our age difference was a big one k1 2009 denied CR1 approved in 2015 the time away is hard , really hard but once your spouse is here, the time will go fast married now 15 years / he is a citizen i think the hard part of all this is that you bypass the normal dating and romance of being in same country /the fun part before settling down to married life and the commitment of the partnership along with the workload involved., So i say in your long chats, forget immigration issues and keep it romantic and understanding of the long distance you deal with / don't dwell on immigration as it will bring you down and u need to keep the hopes and dreams alive. I never let Adil know how upset i was with the RFE we did and how mad the process made me. i cried and he didn't see it. My dream was alive even when spirits were low -

JeanneAdil replied to AlwaysStressed's topic in Africa: Sub-Saharan
never compare to another's post or timeline the person interviewing in one country might have been born in a high fraud country \ OR petition was not complete and they had to respond to RFE We do not see the numbers here for South Africa as high as other consulates and that also makes a BIG DIFFERENCE QUIT stressing and just spend the time talking online and keep the romance going this is a pain in the butt i know , ours was 6 years as we had a big age difference but we made it -
also says 2) Unconsummated: A proxy marriage that has not been subsequently consummated does not create or confer the status of “spouse” pursuant to INA 101(a)(35). For IV cases, a party to an unconsummated proxy marriage may be processed as a nonimmigrant fiancé(e). A proxy marriage celebrated in a jurisdiction recognizing such marriages is generally valid another marriage in the United States is not necessary if the applicant is admitted to the United States under INA provisions other than as a spouse. See 9 FAM 502.7-3(B) for additional information on fiancé classifications. under https://fam.state.gov/fam/09FAM/09FAM010208.html 9 FAM 102.8-1(D) Proxy Marriages

it actually says (35) The term "spouse", "wife", or "husband" do not include a spouse, wife, or husband by reason of any marriage ceremony where the contracting parties thereto are not physically present in the presence of each other, unless the marriage shall have been consummated. and definition of consummation is The consummation of a marriage, or simply consummation, is the first officially credited act of sexual intercourse following marriage https://uscode.house.gov/view.xhtml?req=granuleid:USC-prelim-title8-section1101&num=0&edition=prelim

News media feds on what i call gossip CBP look for things like drug carriers, unreported money, unreported large purchases in the foreign country and when they stopped the one green card holder in the news, she had a criminal charge of embezzlement. so, none of the above, the green card should carry her though with just the same questions we all (even USC's) have to answer

Processing times reducing
JeanneAdil replied to VJRICK's topic in Removing Conditions on Residency General Discussion
The misleading part of this is that USCIS offices are only step 1 and the other 2 steps are NVC and embassy interview and with all the different wait times depending on the embassy, there is no way for them to calculate the timeline average for any petition And don't forget this # as 80% includes naturalization which is the fastest to complete and done by USCIS -

but embassies and immigration officals are already reacting to it and it was announced 6 days ago that he was finalizing the order this ban does affect EB visa Impact on Employers and Employees The ban is expected to affect many employers and their employees’ global mobility. Nationals of the restricted or banned countries who are outside the United States when the ban is announced may be unable to return, even with a valid visa stamp. Employees or business visitors from highly restricted countries will face rigorous visa application processes. Additionally, U.S. companies may need to restructure their global workforce, potentially losing international talent and facing higher business costs.

The Federal Bureau of Prisons does not permit conjugal visits so, getting married at this point is mute according to immigration benefits as you need to consumate the marriage for him to file a spouse visa Gilligan (1974), the United States District Court for the Northern District of Ohio held that prisoners have no federal constitutional right to conjugal visits .. You can visit according to the Federal Prison guides but i would not marry and start the immigration till he is out and has a job to support the process there are 2 cases on VJ that have married prisoners so you can search in the search bar on top right in blue bar to find them and see how have done all this

Embassy in Cameroon may have hold on this type of visa till they know if Trump's proposed ban will affect it Countries listed in the “YELLOW” category would be given 60 days to address concerns from the administration or risk being moved to the other categories: Angola, Antigua and Barbuda, Belarus, Benin, Bhutan, Burkina Faso, Cabo Verde, Cambodia, Cameroon, Chad, Democratic Republic of the Congo, Dominica, Equatorial Guinea, Gambia, Liberia, Malawi, Mauritania, Pakistan, Republic of the Congo, Saint Kitts and Nevis, Saint Lucia, Sao Tome and Principe, Sierra Leone, East Timor, Turkmenistan, and Vanuatu. This statement means if Cameroon does not address concerns from the Trump administration, the country could be moved to orange or red (higher risks list) So, what is your news media reporting about this issue?

B2 Visa Extension
JeanneAdil replied to JodiDeverra's topic in Bringing Family Members of Permanent Residents to America
your mom can apply as a green card holder but you must be in your home country while the petition is processing for F2b Yes, a green card holder can sponsor their unmarried son or daughter who is 21 or older for a green card (adjustment of status or AOS) through the F2B visa category, but the son or daughter must be outside the US on a B2 visa and not have entered the US with the intention of seeking AOS And you will need to leave (if granted 6 months on B2 ) by May and the extension would not be processed by then/ it takes time and some stayed here waiting for the extension and found themselves in an overstay when extension was not approved
