So if we filed MFJ and didn’t send our W2’s  & used a joint sponsor do you think it’d be a problem with Nvc? The joint sponsor submitted tax transcripts and employment letter.

If I were to submit the w2 now (submitted December 27) would that send us to the back of the line? 😩

I'm not that familiar with the joint sponsor process.

However, I would advise against adding anything when you're so close to a review. The missing w2 might not be a problem or NVC might raise other issues.

Submitting a document now would reset your date of submission (send you to back of the line). And you won't know if you're missing something else.

15th December Submitted Docs and AOS/ds260

Got a rfe email on 13th Feb for my husband’s W2s from 2018

even though 2018 transcripts were uploaded and they contain the same info *facepalm*

so waiting for the case worker to review the additional info submitted as my husband uploaded his W2s on 14th Feb.

Im just hoping it’s not another 8.5weeks for review of one additional document 😭

Being rejected after such a long wait is heartbreaking. Our submission was on Dec 17th and we're waiting to hear back from NVC

According to NVC W2s are needed when Taxes were filed jointly.

If you filed jointly: If you filed taxes under the “married filing jointly” category, you must also submit your Form(s) W-2 or schedules(s) from the most recent tax year.

It might be due to weather? It's snowey and icy here in upstate NY today, NH is usually on a similar weather system 💁‍♀️

They might open after 12 unless the advisory is extended.

Thank you for your answer 🙏😃

i know that the time depends on the embassy , and I already looked at the récents wait times to have an idea .
my question was , is there any change on this recently  ? Because many times I referred to other cases and mine was completely différent for the  wait time ( way longer my time line can prove it lol )

Not that I am aware of. I'm still waiting on my DQ so I haven't started worrying about things past that just yet. 😅

Have you taken a look at this thread? It might be helpful.

Hello everyone and happy Monday !
i hope this week will bring a lot of DQ’s! 🤞🍀

ok , I’ve been DQ in 01/23/2020 ans I am “still” waiting on my IL .

country for interview is France and of what I read some people received their IL in 1/2 weeks .
question is . Is there a backlog now , even on that ?
don’t know what to expect 🤷‍♀️

Time from DQ to interview depends on the embassy you will be interviewed at. I would suggest looking for others who will be interviewing or have recently interviewed at the same embassy as you. Their wait times will give you an idea of how long your IL will take.

The wait will be longer if your embassy processes a lot of cases ( US embassies in Canada and Mexico have wait times of around 6 months from what I have heard ).

    Hello everyonehttps://www.visajourney.com/profile/286866-mattyuktous/

I submitted my documents to nvc  on december 4th 2019 I got reply back on January 28 that they rejected one my affidavit and they needed w2s  And more stuffs but they accepted civil documents an everything else I resubmitted it again on Feb 4 of this months does anybody knows how long it will take for them.to reply the second resubmition?

Look at @LilyJ's signature. She was missing one document, just like you, and she resubmitted on Dec 18th 2019. She has not heard anything from NVC yet.

    According to NVC:

Current case review time: As of 3-FEB-2020, we are reviewing documents submitted to us on 4-DEC-2019.

According to NVC they are 9 weeks behind. Adding 9 weeks to February 4th should give you the expected response date for your case (assuming they don't speed up or slow down).

It might not seem logical. However, as far as processing times go, NVC does not treat second\third\fourth submissions any different from the first ones.

Hopefully this answer was more satisfactory than the one I gave earlier.

Ah ok - I thought so too - and I'm not crazy (yet).

    Thank you Ghostfoxgoddess!

It seems like they have revamped that part of the website and broke it. The new submit documents page says "To determine which cases NVC is currently reviewing, please refer to the NVC Timeframes page on the right navigation bar. " The page it links to does not show the times. Hopefully they'll fix it soon.

(pragmatical question... I cannot find anymore the link to NVC website where they give the timeframe for reviewing cases... can anyone post the link here ? many thanks :))

Here is an archived version ( archived Feb 4 2020 ) of the link:

    https://web.archive.org/web/20200204175709/https://travel.state.gov/content/travel/en/us-visas/immigrate/the-immigrant-visa-process/collect-and-submit-forms-and-documents-to-the-nvc/step-6-submit-documents-to-the-nvc.html

The archived information will probably stay current until midday Monday (or Tuesday) when NVC updates the page.

Resubmission puts you at the back of the line. Currently NVC is processing cases submitted 9 weeks ago. You should hear from them sometime in April.

From what I've seen on the forums though, NVC don't always tend to say the same things across the board and logic doesn't seem to be their strong point.

I'm sure we can use the regular I-864, but my question was about why the NVC have told people not to use the EZ, especially since LilyJ said it was people who did actually qualify for the EZ that have been told this

I qualified for the EZ as well but I chose to use the regular form. As you stated, NVC could find a reason for us not being able to use the EZ.

Haven't heard back from them yet. Really hoping they approve all our documents 🙏

Has anyone ever said what the NVC's reason was for asking them to replace the EZ with the regular I-864? We're planning on doing the EZ because I won't have a joint sponsor and my husband isn't using any assets. We can always change to I-864, that's not a problem, but I want know why because knowing the NVC they'll tell us to switch to the EZ if we do file the regular 864, and will tell us to switch to regular 864 if we file EZ 🙄

The 864 instructions don't say it can't be used by those who qualify for the EZ. The EZ is harder to screw up as it requires less details. However, it carries the risk of being rejected if you use it when you are not supposed to. In my opinion, the regular i864 is the safer choice if you're comfortable with filling out a longer form and reading the longer instructions.

  13. Current case review time: As of 27-JAN-2020, we are reviewing documents submitted to us on 25-NOV-2019.

Current case review time: As of 3-FEB-2020, we are reviewing documents submitted to us on 4-DEC-2019.

Her foreign address if that is where she lives at the time of filing the return.

I will refer you to what the IRS says about getting an ITIN. Read the details and follow any links because guessing won’t cut it.

    https://www.irs.gov/individuals/how-do-i-apply-for-an-itin

Form W-7 Instructions. Pay attention to the identity documents that are required.

    https://www.irs.gov/pub/irs-pdf/iw7.pdf

    Form W-7 https://www.irs.gov/pub/irs-pdf/fw7.pdf

I'll be reading the documents. Just wasn't sure about what ID number to put on the statement requesting she be treated as a resident for tax purposes.

  15. @panamerican @Wuozopo

Thank you for the responses. My wife does not have a SSN (we'll be applying for an ITIN when we file our return). I'm thinking her passport number should suffice instead. A certified copy of her passport will be sent along with the return as it is needed to apply for the ITIN (Form W 7).

Also, I'm not sure if I should use her foreign address or my mailing address in the statement. She's still in Pakistan waiting on the CR1 process.

Wanted to chime in again since our taxes were accepted by the IRS and our state of residency yesterday. We used H&R Block Deluxe and I paid extra for a tax pro to review everything and help us e-file. It was $29.99 for deluxe federal return, $36.99 for deluxe state return, and $59.99 for the tax pro review. Total of $126.97 which was well worth it to be sure our hefty refund was accurate.

We were able to do MFJ and file as resident for tax purposes for her as she is technically non-resident (no green card, does not pass substantial presence test). This required us to complete form 2555 to report foreign income (available on the online H&R Block service) and then answer questions to exclude the income (no tax treaty with Panama, but her income was only $7440 so we were able to exclude all of it). Her tax home was considered Panama (she was born there).

I completed the special election statement (I can share mine if someone wants an example), both of us signed and dated it, and I sent a scanned copy to my tax pro. She said she would mail it in for us, but e-file the rest of the return. I wanted to share this part specifically because I was under the impression that I would have to mail the entire return, but no.

    Good luck to everyone else!

Just the person I was looking for 😁

Can you share your special election statement please (redacting any sensitive information of course)?
