  1. Hi, I am not the NVC officials and they will make the decision about this based on numerous other factors (income, assets, risk factor, likelihood to become a public charge, etc.) -- but from my personal experience:

    In 2016 and 2017 I made less than $7000 as I was a student at the same time. In 2018 after graduating, I was making over 35k -- but my tax return from 2018 only showed 17k since I had this job for only 4 months before the end of the fiscal year. The NVC approved our petition.

    The rules for how they are going to be measured has not been stated. :( This is part of the class action law suit against Trump, his admin, and the US -- the vague terms of the proclamation. See the law suit below:

    2)  Let the panel physician decide what is needed.  Typically it is tdap,  mmr, varicella and flu (if in season).  Any of the vaccinations can be skipped if medical history or prior vaccination records indicate they already have had

    Regarding your answer to 1, do you mean that when they receive the missing medical they begin processing again? I know for many people 221g/AP is a black box of undefined waiting.

    My Portuguese husband's CR1 interview letter came on October 24, 2019 and scheduled his interview appointment in Paris, France for November 6, 2019 -- less than 10 business days before the interview. We were very grateful for such a soon interview, but this is a big time constraint for the medical. We immediately scheduled his medical exam, which he attended today October 28, 2019, but the medical doctor said there is no way to get the documentation processed/at the US embassy in Paris, France even when we stressed our time constraint. Further, the list of vaccination requirements she had was very different from what is listed online. In further looking online, even different US government websites list different requirements (see links below). The approved medical doctor even had a different list from these.

    So my two questions are --

    1. What happens if his medical documentation is not at the embassy in time for the interview, since they only gave us 9 business days for all of this? Do we go into AP and then what...? 

    2. Why are all the vaccination lists different, and what are the actual requirements?

  5. Hi everybody,

     

    My husband's interview was scheduled last week, and the same day we found out about his interview we scheduled his medical exam (as instructed). The earliest exam they could get him was today.

     

    The medical doctor says they need 10 business days to process his medical exam for the consulate. However, the interview letter didn't allot us much time, so his interview is already next week (7 business days from today). From my understanding, if the medical documentation is not in order/processed/complete by the time of the interview, we're put into administrative processing because the immigrant file/interview files are incomplete.

     

    Is this correct? Does anyone have any experience with this or any advice on what to do?

    From an interviewee standpoint: I don't see how they are going to have this implented on Nov 3rd. Nothing in this administration moves that fast. If you are stressed, get the high deductible "catastrophic" plan now and cancel it once he arrives because that is specifically addressed in the so called "proclamation".

     

    Thank you. Is it best to have a plan where he is already covered by the time of his interview, or is it sufficient to simply show we are looking at these policies and these are our financial resources (which demonstrate we can pay for them by the date he intends to arrive)? 

     

  7. Hi everybody,

     

    I know everybody here is probably freaking out about this just as much as me. My husband got his interview date today (it's going to be Nov 6), so we need to demonstrate he can be covered by insurance within 30 days of entry. I am 23 so I am technically still riding on my father's insurance (as it's much better coverage than that offered by my employer's). Further, even if I accept it from my employer, its enrollment is on a semester-basis (as I am a paid graduate fellow), so I can't even accept to be added to it or to add a dependent or spouse until January. If he comes then, that's great and I can prove coverage within 30 days but it would still technically be $700/month or so after speaking to my employer's health resources department. 

     

    In general, we are unclear on how many financial resources we must demonstrate at interview to prove we can afford the private market for him. We are also overwhelmed looking at all of our options on the private market and what degree of coverage we must attain (what coverage limit, how much we have to make for the consular officers to think we can afford this, etc.).

     

    I started looking at the American Visitor INsurance that @Shanshanjamrock mentioned. 

     

    What advice do you guys have? :(

    if I could be approved in 3 weeks like you , will be perfect ! But right now I think I just have to wait and see ( obviously it’s the rule for this whole process ) 

    the most frustrating is that NVC know what going on but when you call them they are just giving you what you can have in their website . they are in a hurry to hang up .

    They leave us in the “dark”

    some people are lucky some other less ..

    No problem! Yes it seems it’s all about luck at waiting stages (and reading/educating/preparing ourselves in between)! Unfortunately I was unlucky at case creation and it took 10 weeks just to get a case number, so I was surprised and pleased that dq came quickly after submission. Hopefully dq comes quickly for you!

    i have met the 125% above poverty level this year and 2018. I have 2018 tax transcript ready to submit however 2017 and 2016 I made zero US dollars as I was abroad with my spouse. 

    Do I put a big fat 0 in box 6b /6c and just send in the 2018 transcripts? Will This look bad or does it matter?

    I’m not sure if this will look bad per se and can’t really speak for an NVC official, but in my own experience I had less than 7k income in 2016 and 2017, as I was a student. I only had my current job (which is well above this current financial requirement) starting in 2018 for a year and one month or so at the time of submission (and approval) at NVC. The general rule I’ve seen online is to meet the requirement for 1-2 years at least, but again everything is up to the NVC officials and whether they believe this is sufficient income to support your situation.     I don’t understand how they work . 
    they are officially working on the 3rd of September but some people who filled after get DQ in one day when some others are waiting for months . I lost my counts and I don’t know really when we can expect and answer from them , or when we can expect to move .. it’s sooo frustrating!

    It’s really unpredictable and in my own experience I’ve never had the date estimates they post online be accurate for my case (as I submitted very end of September). Quite frustrating, as some people get approved in days and others in months, as you said :( I was approved in about 3 weeks, and this was before they were processing cases submitted on my date according to their website.

    It’s better to be safe and have everything as new as possible to avoid resubmission delays, but I’ve seen some people submit older documentation without needing to resubmit. Unfortunately I’ve seen people submit new documentation and still be asked to resubmit. It’s really hard to say :( I’ve seen people upload everything and then replace a document after the fact (but before review), and again unfortunately I’ve never seen any consistent information on whether this resets your submission date or not. Sorry I couldn’t be of more help. If it were me, I’d say err on the side of caution and save the few days rather than a few weeks of potential resubmission waiting :(  best of luck

    Only thing I can say is i went through a lot of threads reading what small mistakes set people back and tried to avoid them. But honestly it seems like it's just random, I'm sure a lot of others did everything right too and are taking a longer, nobody really knows it seems. 

    There’s definitely a random regard. People submitting before me got reviewed after me, and I’ve seen people get reviewed in a day versus 6+ weeks even with no resubmissions. When I was waiting for my case number, it took ~10 weeks but others got theirs in a week. It’s hard to believe it’s all chronological. I wish it were speedy for everyone.

    I want to play it safe, but this seems like a country specific thing? I saw on the NVC website that police certificates are good for 12 months but it seems some countries have their own expiration date on them (3 months for example). We submitted before the expiration date but realized it “expired” (by country standards rather than NVC standards) while waiting for review.

    If I submitted all of my documents but want to update one after reading about some troubles people had, does that reset my submission date and start over my wait thus far? I’m sure this has already been asked in previous forums so I apologize! I couldn’t find the answer

    It is important to note that occurrences such as these, even if discovered after use of the K1 visa, can cause serious problems. If, for example, the spouse were to have attained citizenship and then it was later found that they were ineligible for the K1, this could in theory be grounds for removal — because they entered the US on fraudulent terms. I would hate for this to be the case for anyone :( 

     

    You can be considered “too married” for a K1 visa, so it is strongly advised to never have any sort of marriage celebration before entering the US, since K1s require you to marry within the US.

     

    I’m sure the additional time apart from your spouse is very hard, but consequences for these actions are not out of the question, even years down the line. And nobody on VJ will advise you to lie or conceal information from a consular officer — misrepresentation is fraudulent. I advise you to apply for a CR1/IR1 visa and follow the rules, although this is additional time apart at this point :(

    My Portuguese husband is working on his DS-260 for his CR-1 visa, but we are confused how to list given names vs. surnames based on differences in naming convention between Portuguese and English. The form instructs to list middle names within the "given name" box. However, in Portuguese, middle names are listed with 'surnames'. This means that in his passport his 'surname' lists his middle and last name. The same convention was applied to my name in our marriage certificate (where my middle and last name are listed as surnames). 

     

    Because the DS-260 gives these instructions but also states that the information must match the passport/travel document, what should we do? 

     

    Edit -- we also want his last name to be his only last name in the US, and we are worried if we are obligated to list his 'surname' in the DS-260 as "Middle Last", then both of those will appear as his last name on the green card and visa.

    My husband and I are working on his DS-260 for the NVC stage of his CR-1 visa. We are really struggling to come up with some of the employment history needed, since the form requests any jobs in the last 10 years. For one job and one internship (which were both brief) many years ago, my husband does not recall the name of his supervisor. What should we fill in regarding the "supervisor name" and "surname" boxes?
