Hi everyone. Is anyone who filed for i-485 application under VAWA back in August 2017 still waiting for the interview notice or for the interview to be scheduled?
Also, if anyone can advise - my case was initially denied and reopened recently in Feb 2020. But, my attorney was unable to provide information regarding I'm back to the line as normal or my interview timeline gets pushed back further to the back of the queue?
Do I need to make a case inquiry with the USCIS? Any suggestions?
If anyone knows or has any information, I would really appreciate it if you could please advise me or share your experience. Many thanks!

If your spouse is a U.S. Citizen you don' t have a priority date. NYC local office takes over 14/16 months to set up an interview.

Now you are out of the situation and working, please focus on your own well-being and your child’s. Make sure to keep proper records and document everything. If you have a competent family law and immigration attorney, they will give you solid guidance. Now, the next step is his move. If he doesn’t want to be found and even served with divorce papers, then hopefully he will leave you in peace. If he’s not active in his child’s life, I hope he doesn’t file papers seeking sole child custody. More than the immigration part the divorce and child custody (family law) aspect takes a huge toll on you, emotionally, psychologically & physically. I understand what you are going through with this manipulative bully because my ex too is a very educated, well off and well connected person and it’s ashtonishing how easily they are able to get away with their lies and deception based on how others perception of them (that the not as a threat). In my case though, the judge was eventually able to see trough my ex’s manipulative and bullying personality, it took almost 4 years, though. If you can avoid court and settle out of court, that causes the least damage and suffering but it depends on what he wants and his demands and if he is fair and reasonable he is to you. Don’t worry, if you have backing from your psychologist/therapist and findings in their report to substantiate the control and power dynamics and emotional, psychological or physical abuse, you will be fine. Don’t fear and hope you make have the conviction and self confidence to move forward with your life & give your child a loving and nurturing home environment. If he’s happy with visitation or only interested in that, I’m assuming he won’t want to go to court to seek sole custody just to punish you for leaving him. Some men will detest the idea of having to pay for child support, spousal support and spend lots of money fighting for sole custody due to their own bruised egos and to spite you rather than out of care and concern for their children. No. I just got an email alert/notification that my I-485 application has been reopened and that I will be scheduled for testing/interview over the coming weeks. I spent all day complaining to USCIS - and, although they never made a mistake over the phone, I dont think that it's a coincidence that I got this status update via e-mail 4 hours later. Moral of the story: Persevere! Don't give up! Complaining works at times!

dont worry you will soon be approved..you are still within the normal processing frame..just pray to God for mercy and luck that your vawa case itself should be approved and goes smooth..luck really matters in this immigration journey..just take your time and stay around on this forum most people on here help ourselves ..so just calm down..

I used a lawyer for my vawa lawyer fees were $2,500 ... abt EAD renewal it was perfectly submitted to right address.. my lawyer knows his work.....

@namastenyc that is just my opinion. But this situation should be taken seriously..you need legal advice not one based off of feelings and thoughts..ask Sandra to direct you. My advice was based on previous threads..and I believe I've read Sandra mention it's easier to file another!💁

take a screenshot of USCIS website where it shows no status change. Also, file MOTR and explain you have never received an interview notice. They should open your I485 again

My situation was little different. I went for the interview that was based on marriage. We waited there for almost 6 hours. USCIS did not find my file therefore officer told me to go home and they will reschedule my interview. Instead of rescheduling they denied after 9 months.
it tool almost 35 days for them to reopen the case. they put me in the same line as before. Ask your lawyer to send them a letter to reopen the case.

Vermont takes 2months to ship the file to the NBC after Vawa approval and the NBC takes 30/60 to ship the case to the local office.You should set up an appointment with infopass to inquire about your case ,contact your congress person to inquire on your behalf and file an e request as well.

@HopeN VAWA petitioners need for privacy and confidentiality is also protected by both Uscis policies & Congress. You are not depending on him for your legal status. You are simply saying asking uscis to read your vawa petition and consider your claim for a diff immigration remedy based on abuse that occurred while you resided in the US through your marriage. So, your vawa petition is separate altogether and it does not have anything to do with his legal status or tied to his in any way as he is not sponsoring you.

No, don’t give up so quickly. It takes time.
First step is to gather all your documents and prepare the paperwork esp collecting evidence is your top priority. Letter, chats, emails, text msgs, phone records, apt lease, photos, tickets, travel records, national IDs or passports, birth and marriage certificates, engagement and wedding photos, shared rent, cell phone, utility, or Internet bills. Affidavits from friends and family members.
Next, find an immigration attorney and therapist that you trust.
If you feel overwhelmed, can you reach out to someone in/from your community who is/speaks Russian? You can find them through yelp and schedule a consultation via Skype etc.
Find someone with good reviews who is trustworthy and reliable. They are also more likely to have connections with therapists and psychologists and give you a referral.
I think you should first do some research and book an initial consultation. Most times it’s free. Then, go from there. See how you feel.
The payoff will be worth it.
The therapist should be able to gather information from you and produce a report that he/she will share with you later on because as a client, you should keep a copy for yourself. Take as much documents as you have with you and give as many concrete and specific examples as you can recall. Provides him/her with examples of events/incidents that occurred which affected you the most with dates and location (according to your timeline from when and how you met hom
abd how the relationship evolved and how things finally ended between you too).
Since the therapist is private rather than court appointed and you have chosen the therapist, it is your right to ask for and keep a copy of the report he/she submits with your application.
I agree it will be more difficult since you are in a diff country/continent altogether. But, don’t give you up so fast. I think you should try and see how things turn out.
Also, the rules for reporting and guidance on confidentiality between the therapist and patient are likely to be very diff in Russia vs. America.
If I are in your place, I would find a Russian attorney who speaks my language and understands my needs and ask them if they can suggest/recommend any therapist etc.
Try and schedule a consultation to find out more and ease your mind. Then, see how you feel afterwards.
In NY, there are a lot on Russian immigration attorneys based in Brooklyn & Queens. I personally don’t know anyone, though, otherwise, I could be of more help to you. Best of luck to you, though!

Don’t take a chance and wait for the vawa to be approved and to receive a new work permit under c31 category, the currrnt processing timelines are way too unpredictable.
The safest option is to just file an application to renew your EAD under c09 category instead.

I would say discuss with your attorney and inform him/her that you prefer to file the
I-765 application to renew your EAD by yourself. The primary reason being the legal expenses associated with going through an attorney.
