When my husband got a similar 221(g) after his interview for a missing document, the document was delivered the following day. The Embassy in Paris confirmed they received it. The status remained Refused for 90 days after that. In other words, it took the Embassy three months to complete Administrative Processing.

    Hi Everyone.
    Happy Day Today!!
My ex whom I married was finally ordered to be removed!
For those of you who may not remember me, my case involved a spouse whom I petitioned for using the I-130 (received a CR-1) conditional green card) who subsequently committed aggravated assault and was found to be married to someone else in their country, committing adultery and who knows what else.
I contacted ICE & USCIS, they investigated him and sent a Notice To Appear. The judge saw through the sham and ordered his removal.
This all happened in less than one year from him getting into the U.S.
So those that are in these types of situations, just document everything you can and report it.
There are some happy endings after all.
YAY! No more I-864! Woo Hoo.

Beside the arguments. I've been in your husbands shoes. Having to wake my kids up and to pick up their father (now ex). Sleeping whinny, cranky,  kids up and brought out in the cold. (not sure where you live) Then having them just fall back asleep just to wake them back up to get them back in the house and into bed. This is horrible and not something I would ever do again. You don't mention what your job is, but if your husband is thinking the same thing I am thinking, changing shifts may not even cover the cost of daycare. Plus with Covid daycares are limited capacity and you run a greater risk of exposure to the kids.

I know you feel like he only asked to leave the older one home because you felt like it was because he's not his child. I'm sorry you feel that way but in your own post you say he has to wake the child and he probably deals with a cranky possibly crying child. This is hard on both of them too.

Examine your income and the cost of daycare if you change shifts. Then do it again with taking an Uber both ways and just one way. See if it is worth it before giving up your job.

Once you do that show him on paper if it is double and discuss it. I agree with counselling as it looks like he lacks communication skills and this may help.

    1. No

In 130A you should leave blank or write « See Part 2 ».
    Good luck!

portorusa got a reaction from Lexushim in How soon mother can become a citizen after she applies?
First of all, your friend Z should not rely so heavily on the visa expiration day provided the current pandemic and how quickly the situation changes globally.
Even if the plan to arrive on May 1 works, Z will be eligible for citizenship not earlier than 3 years after the arrival date (provided the visa is CR1/IR1).
Then the wait to actually become a citizen (nobody can say for how long to wait).
Then even if Z applies for her mom’s immigrant visa on the day of taking the oath, there will be about 1 year or more before Mom can arrive.
So we are talking about the year 2025 which is five years from now, optimistically speaking.

portorusa reacted to FamousJerry in 10 Year Green Card Approval!!!!! Our Story
We had our interview today in Chatsworth California. It was a quick process for us in the interview. We walked in took our oath to tell the truth and sat down. He told us he had already looked over our case and ran my wife's background check. He said it was going to be approved easy as we have a 2 year old daughter together. I asked if he needed to see my employment letter and my taxes or our photos. He just smiled and said not necessary as we have a child and he can see we are really in a relationship.

He asked my wife if she was a terrorist or a sex trafficker and that was about it. Or apt was at 845am we were called in at 845am and w.ere out the door by 930 and it was that long because we talked about my job  (i have a uniques job and he had lots of fanboy questions lol) and i had question about how the pandemic delayed the process for the USCIS.

All in all this process for us has been easy and smooth sailing once we were face to face with someone from the government, K1 interview was 10 min, POE was 1.5 min and now AOS was 30min. We feel extremely lucky and blessed.

Next step (in 2 years 9 months ) citizenship!!!!!

    portorusa got a reaction from bel044 in CR1/IR1 -> AOS > I-485 interview
My husband had his I-485 interview yesterday and was approved on the spot!😃
Background: We abandoned CR1 consular processing - at the last stage, i.e. post-interview abroad. My husband was visiting me on VWP when corona arrived and we decided to switch to AOS and filed in April.
The I-485  interview lasted about 30 min. and went smoothly. The officer (a woman) was very knowledgeable, experienced and extremely nice.
Apart from regular questions (on when and how we met, the first visit time and duration, husband's biographical info, previous marriages/divorces, children, the date of last entry to the US, and security questions on terrorism/prostitution) there were questions related to I-944 form. Initially with our AOS package we included only proof of medical insurance and proof of absence of credit score. The officer asked  about husband's educational background, work history, military service abroad, knowledge of English and our assets/debts as a couple. "Are you working now? Where?" but she did not ask how much he earns in the US nor did she ask for any proof of his work here. She asked if he had a SSN number (yes) and put it in the computer. She asked if he applied for any public benefits (he did not) and was satisfied with the answer. She never asked for my husband's credit score/credit report.
There was a full understanding that we were adjusting his status from VWP due to pandemic, and that we switched from consular processing. The officer said she did not need I-864, taxes for 2019, children's birth certificates or proof of medical insurance in the US because all that info was available in the digital file. She asked to show her what we brought to prove a bona fide relationship (of which we had plenty). She accepted those bearing our two names (bank account statements, credit cards, auto insurance, utility bills and a motorhome title). She was not interested in our photos together, proof of communication, or proof of many trips to see each other (hotel receipts, border passes, etc).
At the end she said she was approving his I-485, congratulated and explained that as the marriage was more than 2 years old, no removal of conditions was necessary and that 3 years later my husband could apply for US citizenship. She told to expect a green card in the mail within 1-3 weeks.
We did not expect such an outcome and were in shock and bewilderment. In fact, we had been mentally prepared to a postponed approval due to our case circumstances because our file - including some original documents - is still in Paris...We thought the USCIS would have to ask the Embassy in Paris to transfer the case back through NVC and that it would take weeks if not months. Turned out everything was already here in the digital form and was considered by the interviewing officer.
Only back at the parking lot I realized I forgot to ask for I-151 stamp for my husband's passport.
What was most confusing: The officer never asked for I-693 results (still with us and in sealed envelope)! That means all the time and $$ spent on obtaining it here were in vain. Oh well...Maybe she accepted the medical exam results done by my husband in Paris a year ago?

    Green card received yesterday, woohoo!
Exactly 1 week after the AOS interview.

As to removing the note “Authorized to work by USCIS” from SS card, well - it is not that easy... I called a local SSA office hoping to get an appointment but they explained that due to pandemic and not a “dire” need, if we need to get another SS card without the note, we have to mail them ORIGINAL passport of my husband and his ORIGINAL green card accompanied by SS-5 form. If we feel uncomfortable to mail the originals (we do), we have to wait till they reopen their offices to the public access. Next year sometime...
