Fiance probably submitted it in August vs March. Unless you have a delivery confirmation receipt, you won't know when exactly he mailed it. NOA1s are usually coming within 3 weeks of them receiving a petition.

milimelo reacted to aaydrian in VISA DENIED...NEW LIGHT
Considering that you knew before hand that recently smoking 'weed' carries a one year ban then I don't think you should be disappointed. Did your fiance admit to using or did the doc find marijuana in his system?
You being denied as well because of a lack of a bonafide relationship between you and your fiance should be an eye opener. Not saying that there isn't a genuine relationship between you both but this is a good opportunity to look at your relationship under a microscope. Maybe have an 'outsider' (someone who is objective and you trust) look at your cell messages and or IMs and tell you their impression of your relationship. The fakeness of your relationship may have come across to the CO due to how your fiance answered his questions eg: too confident/rehearsed, not confident enough, hesitation, nervousness, not knowing basic must know info, vague answers, answering 1 question different times with different answers, story not adding up. Your fiance's denial may also be due to the relationship comming off as a 1 way relationship eg: too many trips in one year to JA by you, too many Western Union receipts (for such a short relationship), the amount sent via Western Union, the converstion in the chat evidence (you're obviously more into it than him/he's professing love very soon after knowing you) etc. Take this one year a chance to see if your relationship is true. Don't rush into anything.

I don't think you understand what you have done/are doing.
It's like you are caught driving a stolen car and tell the officer you'll just return it. You have already broken the law by lying on the birth certificate, I expect from your posts you have already submitted this falsified document to USCIS. It's essentially a FAKE birth certificate and they could assume that you were going to try and falsely claim USC for the child. It doesn't matter what you do to explain away your lie and deceit, you still lied on an official document for stating your husband is the father when he is NOT.
Your son is not your husband son. He isn't eligible to be petitioned for a visa because he's the child of a USC, per the fake birth cert. He's not eligible for USC because he's NOT your husbands son. You are making your lives harder by not fixing this now and doing it the right way.
But by all means follow your own path. I expect a lengthy delay for you fixing this problem, if not all out denial for lying to immigration.
**Edit - I understand your reasoning for doing it. If it didn't involve immigration it might not matter, but it DOES involve immigration and sometimes USCIS aren't nice about people lying to them (doesn't matter that at the interview you're going to explain, you've already lied to them and then , in their opinion, are going to try and "explain away" the lie).

I am trying to help you. You made a reasonable mistake. I am trying to show you the difference between two situations; one is more favorable to you than the other.
Situation 1: You fix birth certificate, then your husband petitions for his stepson. The US Embassy will never know that you provided false information on the first birth certificate. No need to explain anything to the US Embassy. Easy, regular situation because the US Embassy only has the correct birth certificate.
Situation 2: Your plan of submitting a false birth certificate with an explanation where you admit to providing false information the Philippines government. You now have given proof to the US Embassy that you have lied on a legal form provided to your own government. Admitting that you provided false information and explaining it does not undo the fact that you provided false information.
I hope that you can see the difference between the two situations. Look at your situation through the eyes of a critical and suspicious consular officer reviewing your case who is not your friend. Don't think of him as your friend who you can explain things to. He may not care about your explanation. He may not even allow you to explain.
    Good luck to you.

It could also be 540 if you do the simple math of 18 months @ 30 days....
I guess that the question here is how many days have you spent outside the US in the last 3years? That is what matters for your application.

nope, sorry. Is possible to get an ISO, but you (or the one using the telephone)
    must be adamant.
The CSRs are braindead, and it's their job to get you OFF the phone, giving useless information. Just because a CSR said something to you or your husband, is absolutely NO REASON (at this stage, with a denial pending) to believe a CSR.
    How's it going, so far?
CSRs cannot see the same things an ISO can see, on the computer system, as ISOs have higher access.
I am sad you are having this much trouble about it, really.
Get an ISO, Monday. Sort this out. There's a hope that things can get redone without cost, but you must engage with an ISO, on Monday.

OP - You lose all sympathy when you say that you are better than other people because you are functional and that everyone else is a scam because they are "rich." It seems to me that you have done an adult thing but you are not an adult. You both dropped out of college, your husband is deportable, and you have no way to get the fees to rectify this if you cannot borrow from someone and get a co-sponsor.
I think I answered you very diplomatically in your other thread, and you did not reply, but started a new thread.

milimelo reacted to NY_BX in K1 Visa with a substantial age difference
Friends, if none of you had gone through a MENA/ Africa consulate please becareful giving advice that may or may not help the OP. MOstly everyone here has said age is not an issue. True, in most of the countries your SO migrated from. That is NOT the case of the OP. She is petitioning an SO from a MENA country. It is reason enought to raise a huge red flag. Again, not because of age discrimination, no. Because the vast mayority of fraudulent cases come from young men scamming a lady outside child bearing age. That is the most common tactic from MENA/ African males to come over: these young men take a USC lady for granted and GC in hand they flee- abandoning their spouse. So, the issue in itself is not the age gap, but the common traits of a fraud victim. The OP has 3 traits already, that we know of: being outside of child bearing age (well-established), 4 kids from a previous relationship- one of those kids being around the same age as the beneficiary, having previous relationships (divorced?).
All this said, true- all she has to do is show strong proof and that may overcome the age gap issue. Other than that, she MUST be prepared to be scrutinized. Moreso, her SO will- more than likely- go through AP.

milimelo reacted to Harpa Timsah in Legally entered on B1 that expires soon, how to renew inside US?
Sorry, your plan is not legal. Your B2 visa renewal will be denied. A B2 visa is not for immigrating. Now that you are here, USCIS understands it is overly bureaucratic to make you go home to come back, but if you leave, you lose his chance and have to get a spousal visa. A stated above, you cannot enter the US on a non-immigrant visa with the intent of immigrating.

I really hope things work out for you.
What did she say when you told her she had to go home and you would refile?
People here are not trying to insult you or her , but here we see stories daily that mimic parts of yours and generally someone gets hurt and it sounds like if this went south, that would be you
If this woman really loves you, great, but, in knowing her for only 6 months and only knowing her while she was married , how can you know her intentions were/ are pure? For myself, I would not talk to another man in an intimate way if I was married, even if I was unhappy. I believe it is not right. I also would not want to jump straight into another marriage if my first was failing, even if I had to leave the US. Marriage is meant to be forever. You are not supposed to be thinking, well I have a 50/50 chance... At least at the start, right? You are supposed to think, I am the 50% who will make it, without a doubt!

You cannot just enter with that old card, you will need to apply again based on whatever category you fall in (family, employment etc.)
