My parents were denied at the port-of-entry on 27 July 2010.

The officer told them their US visa were voided when their extension of stay in their previous visit were denied.

As a result, the office wrote "revoked under 22CFR 41.122(H)(3)" in their US visa.

Also, they were asked to leave the country on the first available flight.

On their passport, the office wrote "Application for admission withdrawn under 212(a)(7)(A)(i)(I)".

Recently, I am applying for my parents GC and our I-130 petition were approved.

Now, I am in the process of completing the DS-230 form.

On Form DS230, "Q42 Have you ever been refused admission to the United States at the port-of-entry?"

I am wondering whether the answer for the above question should be Yes or No?

Anyone have the same experience out there?

05/31/12: Received email notification from USCIS

08/06/12: I-130 Approved (email notification)

09/06/12: DS-3032 form & AOS payment invoice (email from NVC)

09/07/12: Status of AOS payment made online was changed to PAID

09/10/12: I-864 & DS-3032 sent via Fedex Standard Overnight

09/11/12: I-864 & DS-3032 received by NVC

09/21/12: IV payment invoice (email from NVC), DS-3032 & I-864 accepted

09/25/12: Status of IV payment made online was changed to PAID

10/08/12: DS-230 sent via Fedex Standard Overnight

10/09/12: DS-230 received by NVC

10/23/12: Case completed

10/30/12: Received email notification from NVC that the case is completed

11/21/12: Medical exam appointment

12/06/12: Interview date (Approved!)

12/10/12: Collect passport and visa

Similar question was asked in I130 form i.e., Q16 "Has your relative ever been under immigration proceedings?"

- No

- Yes

- Removal

- Exclusion/Deportation

- Rescission

-Judicial Proceedings

That time, I managed to get advice from the attorney and he told me to fill NO because my parents were considered withdraw of admission. I did and the I130 were approved without any problem.

So, this time, for DS230, I wonder whether I should give the same answers.

Immigration proceedings is different. That is deportation or removal proceedings which your parents weren't under. They were denied entry at POE so be honest, because USCIS has a record of it anyway.

Let me ask you? Were your parents denied admission in the US? I'm sure your answer is YES so why you will put NO?? When it's time for them to have their interview do you think they wouldn't know?? It's easy to lie but very difficult to deal after a lie is found! Go ahead and put NO...in the end of the day we just give advices and you will do whatever comes out of your mind because you want your parents with you!But it might no happen if you lie or not!
