  1. Hello

    My husband came from the Dominican Republic with a K-1 fiance visa and we got married in less than the 90 required days. We are now trying to apply for his adjustment of status. Question: do we have to include the I-130 Petition for Alien Relative? or the fact that we have an approved I-129 and a valid K-1 visa is sufficient to only have the I-485 Adjustment of Status application submitted for him? Appreciate your responses.

    Thank you! I actually called on Friday afternoon to inquire about our case as we were outside normal processing time and a service inquiry was opened. I was given the standard 30 days response to the service inquiry. Saturday morning at 6.00AM I get a text and an email from USCIS saying "we took a decision on your case, please login onto your account". So I logged onto the new website and there was our approval!!

     

    I have to say I had to answer some very weird questions while on call with the USCIS officer. He kept asking me about my fiance and referred to him as my "husband" and he kept asking me if we were married and if my husband was here in the States. These were tricky questions trying to get me to fall and answer yes and as such, lead to an immediate denial. I felt like I was at an interview, the whole phone conversation took about half hour... very weird... this is their new technique now...beware!!

     

    I kept correcting the officer telling him: No Sir, he is not my husband, he is my fiance and no we didn't get married yet as we are waiting for the visa to be approved and we will do so upon his arrival to the United States...and No Sir my fiance is not here as he cannot enter the United States without a visa ...

    Very weird indeed... I felt at first it did more harm then good my call and felt really depressed when they told me 30 more days, and then boom the next day the approval.

    "If USCIS has reason to question the signature it may request the original document or more evidence from the requestor in accordance"

     

    So there is always a possibility that they will need an original anyway. I say why risk it?

    True, we don't want to risk another RFE and as such, delay the NOA2 even further... so will wait for the original letter to come and I will send the original Intent to Marry, just to be safe. Thank you all for the very helpful advice. Much appreciated!

    We both submitted Letters of Intent to Marry. Magically, my fiance's letter somehow was lost in translation and USCIS is requesting a new one for him, the Beneficiary... Ask and you shall receive:whistle: ... We will comply... we have no choice... letter is on it's way from DR and I will send it to California once I receive it. 

  5. Received the RFE letter from USCIS today, four days after issuance. Reason for RFE they need the Intent to Marry Letter from the beneficiary. I know for sure we submitted a notarized Intent to Marry Letter from my fiance together with all the documents when we submitted the application. They either misplaced it or they want a newer one. I have to get my fiance in the Dominican Republic to sign a new letter and perhaps notarize it and send it to me ASAP and I will submit the response. I am relieved that is an easy one and praying we will get approved shortly thereafter. This proves once again that USCIS needs to meet a quota for RFEs. I am 100% certain we submitted a Letter of Intent to Marry for both of us, I even translated it from Spanish, however somehow it was "lost in translation".... oh well....patience is a virtue...we now have to wait few more weeks until we have the approval...what is few more weeks for a lifetime of happiness with the love of my life?

    We are still waiting for the case to be received at the NVC. The NOA2 letter was dated 5/16. The NVC says it could take up to 6 weeks, but I've been seeing where they've been received anywhere from 14 - 22 days. I am just calling everyday!!

     

    Of course, let keep in touch! I am more than happy to pass on information received from others who've travelled this journey before us and my experience.

    I will be following your timeline. We are in the same situation, NOA1 Dec 22. My fiance is from DR. Good luck with everything! Hope all goes smooth at the Consulate and your fiance gets the visa soon. God Bless!

    You will probably be sent to the Consulate in Guayaquil, Ecuador. In any event, your case will be processed at the closest Embassy/Consulate. No need to worry or stress out.

    One of the 2 approvals had recently finished an RFE and got their response into USCIS on 4/13 and are now approved.

    That's so weird how they are processing cases smack in the middle of the month...nothing makes sense nowadays with USCIS...

     

    BTW what does this mean:

    My fiancé got his official divorce decree today and it is a whopping 9 pages FULL of words... the bad part about it is that it is in Spanish. Therefore I must get it translated into english. This is so frustrating because translations are expensive and time consuming :crying:

     

    Does anyone have any recommendations for a translation company to use??

    are there any divorcees from Colombia who can share insight on the proper documentation to prove a divorce is complete and final? My lawyer is freaking me out and making me doubt whether we actually have the correct document for his divorce decree.. She is asking if it is "registered". My fiancé swears that it is finalized and I believe it is by comparing it to the required documents listed on the travel.gov site.... would be nice to confirm with someone who also has this experience.

    I asked for a Tier 2, and after waiting 110 minutes I get my call back. The very sweet lady over the phone asks me my basic info to verify its me and she says hmm you were approved March 6th. Your letter went out on March 7th. I almost busted into happy tears. She then gave me a general timeline for the  next steps and then gave me the State Departments info so I can call at the end of the month to pay the fee and wait for them to send it to the Dominican Republics consulate.

    She says it'll be a little under 2 more months to go and my fiance will be here by Mothers day!!!!
