Then your path may be chosen already.   Speak with an attorney to understand your rights and discuss all your concerns.   Immediate action is to stop the AOS by pulling the affidavit of support,  if that is the path you take.   There are ramifications if you stop AOS and you must understand how your decision affects the child

Read up about VAWA, I have a strong feeling it will be coming your way.

Well, you need to put your "big boy " pants on and make a decision.   You don't need her cooperation to facilitate a divorce.   Have you thought about marriage counseling
  4. Thanks
Hello729 reacted to payxibka in Please Help!
    Only you can decide

Begin with that. What do you want to do? Do you want to stay in the US or do you want to go back to your home country? Do you just have a pending I-485? Do you want to raise the baby here in the States?

You'll get the letter with interview date once the status changes to "Interview has been scheduled".
  8. Thanks

That's just sort of a placeholder. Some people have been "ready for interview" for 8-10 months...

I'm so upset! We still havent had our AOS in person interview rescheduled. When we had our interview back in March, the interviewer was so rude and my husband couldn't understand her because she was speaking so fast. He asked her to slow down and she didn't. She got frustrated and just ended our interviewing saying he needs to come back with a translator. She wouldn't let me translate for him. She also said she would reschedule the interview but she never did! And we can't go online an request another appointment for the Chicago office! We waited a year for that interview!!!!
Now we've asked for a case update, we've called USCIS and told them for send us another interview appointment. We've even send a letter to the NYC office asking if we can transfer our case there since we will be moving later this year. No response! His work and travel parole expires in 3 months and he has to work to support our family! THIS SUCKS!

Has anyone gotten their green card from K1 yet? I honestly think it is going to take 2-3 years to finish this. We're already 14 months in!
  11. Thanks

Most likely you have to wait for the EAD to get a State ID, it's the same as with a Driver's License.

You don't need to send any proof at all apart from your marriage certificate with the actual AOS package. You likely won't need much proof (if any) at the AOS stage at all, USCIS knows you've only been married a very short time so they don't expect much. So don't worry about that. As soon as she gets her EAD she can get an ID and you can add her, and if you get an AOS interview after that you can just bring the lease to the interview.
  12. Thanks

Get a state ID, (non DL) They should be able to accept her passport Apply for ITIN for time being If she has, get tax transcript that shows you are MFJ Add her as next of kin beneficiary on financials Add her to your health insurance from work Joint checking/savings account statement
Write a letter that the landlord is unable to add spouse till he/she gets a State ID and/or SSN hence you are unable to provide lease information.
  13. Thanks
Hello729 reacted to Ben&Zian in Help
Does she have a social security #?  Some land lords/management companies won't allow anyone onto a lease with a SSN as they can't do any proper background checks or verify someone's identity, which can put others at potential risk.

It's free. Send the I-131 with a photocopy of your I-485 NOA1 to the Chicago Lockbox (if the receipt notice starts with MSC): https://www.uscis.gov/i-131-addresses "Applicants with a pending Form I-485"
Odds are it will be a separate I-512 document:

An RFE can occur at any time prior to adjudication (approval./denial), even after the interview (i.e. missing documents after the interview).

It means you are progressing.   Biometrics is required before they can review the application

    From the I-131 instructions:
"NOTE: If you filed Form I-485 on or after July 30, 2007, and you paid the Form I-485 application fee required, then no fee is required to file a request for an Advance Parole Document or Refugee Travel Document on Form I-131 if your Form I-485 is still pending, if:
    1. You now hold U.S. refugee or asylee status, and are applying for a Refugee Travel Document (see Part 2. Application Type, Item Number 1.b. of Form I-131); or
    2. You are applying for an Advance Parole Document to allow you to return to the United States after temporary foreign travel (see Part 2. Application Type, Item Number 1.d. of Form I-131).

Under these circumstances, you may file Form I-131 together with your Form I-485, or you may submit Form I-131 at a later date. If you file Form I-131 separately, you must also submit a copy of your Form I-797, Notice of Action, receipt as evidence that you filed and paid the fee for Form I-485 required on or after July 30, 2007"
  23. Thanks
Hello729 reacted to payxibka in I am officially the dummest person in the world!
Nope.  As long as the i485 fee has been paid the i131 is no additional fee
  24. Thanks
Hello729 reacted to payxibka in I am officially the dummest person in the world!
Anytime at or after submission of the i485 and you have your noa1 from the i485
  25. Thanks
Hello729 reacted to payxibka in I am officially the dummest person in the world!
Nope.  You just need to submit proof that you filed the i485 with your i131 evidence
