Unless I read it wrong, I assume that what OP is saying. Of course, many know it has zero difference.
Anyway, for 2 months and his wife has not applied, I am not sure it is considered a real medical emergency situation at all.

No grammar lessons from me, this is an immigration related site, and we don't sugarcoat, and US immigration doesn't have room to avoid harshness. Intent to enter on a tourist visa with intent to get an EAD is a no-go, and there is no middle ground based on this site's ToS.
Thus, "no" is not equal to "not likely" in immigration parlance.

India is not on such a list.
Neither India nor Pakistan are MENA nations (they're both in South Asia), but of the two, only Pakistan applicants tend to be the focus of such terrorism-related AP checks.

There is no 'not likely' for 1 and 2. It's simply a "no" to both.
Entering the US on a tourist visa with intent to immigrate is considered fraudulent. And there is no EAD while living overseas. OP has to bide his time in India while his visa is processing and interview in Mumbai. Once F2A or IR-1 visa is issued, he travels to the US and enters as an LPR.

People are questioning your lawyer's actions because of the way you wrote your post... Words/phrases like "top lawyer", "99% success rate", "Trumpland" tend to rub people the wrong way.
BTW- If you don't like Trumpland, why are you trying so hard to get residency? My suggestion is to forget Trumpland and go back to your country. You'll be much happier. I'm sure your country's president (or dictator) is a swell guy.
