So pretty much I guess since there is more applications coming in that’s what’s delaying the process .. makes sense . Thanks for the info I guess there is a lot of fake news going on about how the new administration had something to do with it lol

After 2017 processes are taking longer , for example k1 visa used to take 6 months now almost a year . Waivers used to take 8 months. Ow 12-18 months . I believe the new administration had some sort of impact on the process .

Please you have to be very strong for your family and yourself . I don’t know exactly your situation but it doesn’t seem that all is lost . Put your energy in fixing this problem by getting the correct documents and getting married again and file as a spouse . Time goes by very fast and working on the process again the right way will make time go by even faster. It’s a very tough situation but you did not fail anyone , you didn’t do this on purpose , it seems you were confused and unaware of what was happening , honestly it can happen to anyone . Now you have to be strong for your family and yourself .

If your first marriage was not legally dissolved before Oct 2016, your current marriage is invalid.  If that is the case, I think your only option is to remarry your current wife, and refile a new petition...from scratch....I see no other way.....if I am reading your post correctly.

EDIT:  Make sure you have the proper paperwork showing the previous marriage was legally terminated...

If you have a waiver application pending for a K-1, I would suggest waiting to see how that process goes first, maybe try an expedite for the waiver to speed it up a little.  He will still need a waiver if you abandon the I-129F and start an I-130, so that route could take 2 or 3 years.  Plus you'll need more visits to see him to show a bona fide marriage.  Can you move to live with him while you wait?  Some have been successful with an expedite for a waiver based on the petitioner's financial and emotional hardship.  Good luck!  I hope you are able to live together soon.

Yes and yes. However a lawyer does not speed up the process at all and there have been many instances where lawyers have actually held up the process by making mistakes or giving their client inaccurate info about the immigration process.

Yes, it depends on the country. No, a lawyer will not speed up anything in fact I have seen where lawyers have slowed things down even got some petitions denied due to bad advice or missing documents.

Elsalove2016 got a reaction from Lemonslice in Administrative Processing
Administrative process could take up to 90 days . Try contacting the embassy via email and ask them about your status . If they kept his passport that should be a good sign . It’s probably taking a while because Morocco is kind of notorious for visa fraud .

Is there a way you can contact the embassy through email and ask details about your case ? If they told you they want your passport that most likely it’s a good sign that you will get your visa . Maybe they are just verified that the documents that you submitted are legit . Best of luck !

What have been the aproval rates for waivers that have been processed in 2018 and 2019 . Any experiences ? I know it’s taking way longer than before for them to make a decision , but I was wondering if the approval rate has changed too . I know each case is different

Visiting will be great but with the baby my expenses have increased and spent all savings and extra money to pay the immigration lawyer  , to travel to his country the ticket is very expensive . I’m trying to plan a trip sooner or later because the baby is growing and growing and he is missing a lot of moments that will never come back . All I hope is time goes by fast and by the summer we should be together .

Have you thought of visiting him? Look up Skyscanner and pick your dates - nothing like spending time together to stop the clock of separation time. Visits are allowed while the waiver is processed.

I don't think that information is accurate. Our lawyer has been doing this for a long time, and he says it's a completely different story with this administration. It's horrible. Where did you get the 6,000,000 number? The government doesn't even process that many people a year in the entire immigrant/naturalization pool.
In fiscal year 2017, the United States issued 9,681,913 nonimmigrant visas and 559,536 immigrant visas. According to a preliminary report, 533,557 immigrant visas were issued in 2018.

Roughly 500,000 are processed each year, not 6 million.

Hopefully, it will be 12 months and we'll hear in March!  We've been married two years already and living on separate continents. Hopefully by the summer, all of us will be very happy! xx

When I first was going to apply for his waiver people and even the lawyer were telling me 8 months and even that I thought it was a long time !!! And now this time frame it’s just so crazy it’s torture . Like I said though right now they are working on cases that were sent oct 2017 , so if you sent your case in March you should be hearing from them in about 5 months and me in 7 months 😩😩😩😩 good luck to both of us in gods willing . 🙏🙏🙏

My husband and I are in the same situation. The waiver processing used to be 4-6 months. With this administration it's 12-15.5 months. We submitted our waiver last March 2018, so we are getting closer. It's very frustrating! Good luck to you both.xx

When I apply for the waiver for my fiancé due to his criminal record back in his country . The lawyer told me it was going to take around 8-9 months for uscis to make a decision , but today he  is telling me it’s taking  12 months or 15 months . Did the new administration had an impact in the time frame that immigration applications are being processed ?? Also for those who have submitted a waiver , I called uscis today and they told me that they are working on waivers that were sent on October of 2017 , so if you sent in a waiver in October of 2017 you should be hearing about the decision really soon .

Elsalove2016 got a reaction from Abies in Why did my fiances case got sent back to USCIS after his interview in Kabul?
From what I have read , most of the time the reason why the visa gets sent back it's because they didn't believe the relationship was real . It could be many reasons why they didn't believe the relationship such as , age difference , might think you guys are related and just doing it for adjusting status , haven't seen each other too much , etc etc , also some countries are harder to grant  fiancé visa you might have to get married and sponsor him as a husband .

Funny that I can't find any news articles about this?  One would think if there were "massive layoffs" from any government agency related to immigration CNN or MSNBC would be reporting this every 10 minutes and blaming President Trump for it.
