  1. Going on a solo vacation doesn't mean you don't live in marital union with your spouse.
  2. Do you have an APPROVED I765? APPLYING for I765 does not allow you to work regardless if you have an approved K1 visa. You CANNOT work without being approved for I765.
  3. A K1 I765 Category C09 allows a K1 to work only after it has been approved not submitted. A K1 I765 Category A06 is obsolete because it takes much longer than 90 days for approval. You applied for C09. Approval takes several months currently. You can look up the timeline at the NBC on the website.
  4. Your J1 requirements would have had to been fulfilled BEFORE you were granted a K1 visa to enter the US. Since your timeline is completely BLANK, we cannot determine your immigration situation. Since you have posted this in an AOS from K1 visa forum, your question and comments do not make sense that you will be asked this at your AOS interview. No you won't. You already overcame that at your K1 visa interview abroad. You wouldn't have been granted your K1 in the first place.
  5. Ensure it is a photocopy of the original copy stamped or sealed by the county clerk or a photocopy of the certified copy of the original stamped or sealed copy. My county clerk sent me copy that was not stamped or sealed in error and I had to request the correct full original with the stamp (or seal).
  6. Keywords "if applicable". It's not applicable to you because one cannot file I485 and the accompanying I864 ONLINE. It is currently a paper filled form only. Respond to the RFE by mail.
  7. You sent repetitious tax forms. That's a no no. Your household size could be wrong too. Post a screen shot of yours.
  8. Status updates are shotty at best. Do not rely on the website at all. My I485 still says case received and I've had my GC for over 3 years. PS. The current estimated wait at LFO Miami for I485 is 15.5 months. Learning how to use the website to watch your time line will save you a lot of stress. https://egov.uscis.gov/processing-times/ PSS. Your time line is blank!!!! Please contribute back to the website by filling in and updating your timeline with changes.
  9. Travel to other countries is completed with a passport of citizenship. Depending on the country of travel TO and depending on the country of citizenship will determine if visa needed. Youll have to Google that country amd look for requirements for the citizenship country. US immigration documents are irrelevant unless speaking of Canada and Mexico, USA's neighbour's. AP and GC are for reentry to US.
  10. Possibly, two separate applications, two different adjudicator. Great! Book it to take place after the 30 days (but before the RFE response deadline), incase they say you don't need to redo anything. Then you can cancel it.
  11. Is his DS3025 marked as complete? Did you submit a photocopy of his DS3025 with his I485? It's a possibility the transfer from CPB to DHS of your visa packet wasn't complete so it was lost. It's also a possibility that there was something filled out incorrectly on his form so that it unclear that he was a K2 and is eligible for the medical "exemption". It's also a greater possibility that the doofus who is working on your package doesn't know much about K visas. At most, you can ask for an Infopass at your LFO and try to speak with an officer. At best, you should bite the bullet and just get his medical redone by a CS and an I693 filled out. If the RFE deadline is outside of that expected return phone call from USCIS, you should wait until then. You could book a CS appointment to take place after the 30 days and just cancel it if you need to.
  12. At my K1 AOS interview a few years ago (June 2019/ ATL), my USC sponsor was grilled extensively about his current employment and income totals. He was asked for an updated I864 and 6 months current paystubs (which we had brought) and was asked to perform math calculations to extrapolate how much he would earn by the end of the year. (We were $12000 above poverty level). Expect to be questioned and able to provide an updated I864 and current financial proofs to back it up.
  13. Are you sure it's an RFE? Does it just say deficiency notice at the top?
  14. I 797 is the notice of action for any immigration process. I797 does not indicate what application.
  15. Please fill out your timeline as required so it can be determined if this is the correct forum. You have not indicated what application you are currently waiting for and your timeline will tell us that so we can answer.
  16. Is it really an RFE or does it say Deficiency notice at the top (scan the whole sheet please)?
  17. Did you look at your EAD card? Is it not a combo card and marked on the bottom that it can be used as Advanced Parole? Or did you make the mistake of expediting your EAD?
  18. This info is completely false. The OP is a K1. Their medical forms were sealed inside of the K1 visa packet. The OP ended up giving their OWN copy of their medical documents (their personal Ds3025 and Xray CD) to CBP when they didn't need to. OP, all you need to do is email your panel physician asking for an additional personal copy of your Ds3025. That's all you need to do.
