    The few I have noticed being approved recently had been filed 2 years ago.

    That is all we got, file now and it could be very different.

    I have not seen that many but they have been around the 2 year mark, what the future will bring I do not know.

    Hi, we submitted everything on February 25th after receiving second RFE on February 20th. Original submission August 28, 2021 and received first RFE on November 16, 2021.

    The embassy in Budapest agreed to expedite our case once they have received the documents from the NVC - any idea how long the wait might be to receive an interview date?

    Original submission August 28, 2021. Received RFE on November 16, 2021 for missing 1099 form. Received latest RFE on February 20, 2022 for explanation of why I do not have a w-2. Fingers crossed for this one...

    In my case, I uploaded a written statement saying that I would acquire the forms once my interview has been scheduled to ensure that they are current and up-to-date. They accepted that August, 2021. Best of luck!

    I see - did you use a lawyer to prepare the form? If they were good, could you please recommend?

    ws1889 got a reaction from Redro in CEAC - All documents accepted, but received message to submit evidence of income (already done) - what to do?
    Hi, I called and they told me that I would have to submit a statement explaining the absence of W2s - as you mentioned. She also said that we would go to the back of the line...

    Yes, that appears to the be problem - so we will resubmit the forms as they have requested. However, now the problem is that both sponsors are marked as 'accepted' in CEAC - therefore, I cannot upload any documents as the option has been removed. Not sure what to do other than call them back and explain the issue. Still wish that they would allow me to visit embassy to explain issue, as they've already agreed to expedite the case.

    All documents now show as 'accepted', but they are saying there is insufficient evidence of income. I work outside of the US, so therefore all of my income is foreign and doesn't count (despite me making well over the poverty line and having suitable assets to appease the 5X requirement). Joint sponsor is retired but also has considerable assets.

    First RFE, NVC only asked for 1099 from joint sponsor - which I promptly uploaded a missing 1099 from bank interest. Now they are requesting proof of my income, proof of joint sponsor's income, and another joint sponsor. Frustrated and demoralized from the entire process... hard to plan your life around a moving target like this. I anticipate the answer already... but... any suggestions other than wait?

    Same for us... It shows the original date the forms were submitted (for those accepted) and the new date for the newly uploaded form.

    It's no problem - I'm glad I can help! So many people have helped me in this forum, so glad to pay it forward.

    When you log in, you'll see the box for the AOS and the Applicant Information. There's a hyperlink for status. For example, if yours says 'incomplete', then select that. Under "required docs", it'll probably request whatever you're missing. You can also click 'add an additional document' under additional documents. Also, my mistake was that I did not upload the 1099 for my joint sponsor (I only uploaded their tax return) - so basically, for all tax returns, you have to provide all W2s and 1099s.

    Hope that helps!

    That's my thought exactly! In my case, it wasn't even the tax transcript, just a single 1099 form! Hoping that you also do not have a delay.

  23. Confused
    ws1889 got a reaction from Pinkrlion in I-601 and overstay - any leniency for those who were waiting on forms?
    Hi Everyone,

    I've detailed the dates for my case below. I'm curious if because I was waiting on the forms for the duration of the overstay, will the USCIS consider my overstay as being less than a year in a petition? This would make a big deal for us because obviously, the overstay penalty for a year or more is 10 years and less than a year is three years (which has been completed).

    Another point to make, I was in possession of a student visa that expired in July, 2018, but I don't know what the status of it was. I believe my school may have cancelled it when I finished my classes in December (I graduated early).

    Dec 14, 2016 --> Completed classes at university
    January 14, 2017 --> returned to Hungary to visit a family member
    Jan 27, 2017 --> arrived in US on tourist visa (returned with US husband (married '15)) - planned to sell possessions from college and return home. (all questions answered truthfully at border and issued visa waiver)
    Approximately February, 2017 --> discovered I am pregnant
    February 13, 2017 --> Submit I-130
    April 26th, 2017 --> tourist visa expires
    May 15, 2017 --> walk in university graduate and receive diploma
    July 19th, 2017 --> I-130 approved
    Approximately July, 2017 --> I-485 submitted
    Approximately December, 2017 --> I-485 rejected (accidentally used an outdated form - I filled out the I-130 and the I-485 together and waited to send the I-485 (a mistake, I know)).
    Approximately January, 2018 --> prepare to send out I-485
    February, 2018 --> husband received job offer abroad - we decide to not send form and move abroad.
    July 15, 2018 --> leave USA
    Approximately July --> notified of 10-year travel ban.

    Hi, thank you - that's good advice. It's complicated because I currently have a high income foreign position, but my income in this current position cannot be factored and my assets have just hit the appropriate threshold for USCIS according to my family size.

    What you've mentioned regarding the minimum is interesting - I hadn't heard that before. I think in that case, I will probably get a joint sponsor just to be safe. I appreciate your comment.
