@prettylilraindrop You will receive extension letter soon after filing for ROC. Typically it takes between 2 and 6 weeks. You will need this letter AND expired green card to travel.

They will issue it before biometrics and any RFEs.

Thank you so much for this information. What would work as evidence of the marriage? I have joint bank statements showing we had a joint account, pictures etc. What else would be needed?
  3. Thanks
prettylilraindrop reacted to da95826 in Getting divorced on temporary green card
No, absolutely not. You have a conditional green card and you remain a lawful permanent resident even after divorce.

Collect evidence that you enter into the marriage in good faith to submit with an i751 divorce waiver application.

You will be required to show you lived with your spouse as a married couple (lived at the same address) some evidence you should save: Joint Lease, joint bills, travel together, photos together… also showing co-mingling of money (shared income, spending, and savings) ; joint tax returns, joint bank accounts statements, joint insurance --health, life, auto--...

Be prepared to file an i751 waiver application as soon as you get a divorce, or file a joint application if you can reconcile with your spouse.

Sorry this has happened to you. You have rights to stay in the USA if you wish and to file to remove conditions on your LPR.

Hi everyone, unfortunately my husband of almost 2 years has cheated on me. I’m obviously heartbroken, we were together 6 years, known him for 9. I am now trying to think practically and protect myself.

I got my conditional green card in February of this year so it doesn’t expire until 2023. Does this mean if we get divorced I will need to leave to country? What are my rights and what do I do to stay in the country (if that’s what I decide) after divorce? I’m completely clueless so please give me as much info as possible as well as prices if possible.

    thank you!

prettylilraindrop got a reaction from Lemonslice in travelling to Uk from US- positive for covid
Hey guys, so I don't know if anyone can help me. I had covid in December, I'm fully vaccinated (since the start of May) but I'm now having some minor covid symtoms. I'm really hoping it's nothing, but I am due to travel to the UK from the US 2 weeks today, so I am terrified. All I can read on the website is that you HAVE to have a negative test before travel. Is this still the case if you tested positive 2 weeks ago? I know the usual quarantine after testing positive is 10-14 days so this confuses me. Especially as you can sometimes test positive for months after...

I really am worried as I haven't seen my family in over a year now and I would just hate this to mean I can't go.  Any advise or knowledge would be appreciated. Thanks guys!

I don't think you're understanding what I'm saying. According to the CDC, passengers are considered no longer contagious and able to leave quarantine after 10 days of symtoms/ testing positive. For entering the US you have to show a negative test result OR proof you have recovered from Covid in the last 3 months. I am not saying people should be able to travel after having JUST received a positive test result, obviously, but I am saying if it has been over the 10 days, they are considered no longer infectious, therefore should be able to travel? I have seen numerous reports of people testing positive weeks, even months after having covid. These people are no longer infectious, so it doesn't seem fair that they can't travel.

It's also not just a vacation, I haven't seen my family since last March because of Covid and have been closely following all recommendations in terms of travel and Covid in general. Only now do I feel it is safe enough to do so after my family and I being fully vaccinated (which I know isn't fool-proof), plus the probability of there being another spike around winter time is high so it's either go now or who knows when.

    @prettylilraindrop

Some offices are giving appointments. Try your local office or even others you might want to drive a bit to get to. From their Covid info page—

I need help with my Social Security Number (SSN)
We are prioritizing requests for in-person SSN services for:
Individuals age 12 or older applying for their first SSN card. Individuals who need to update or correct their SSN information (such as your name, date of birth, or citizenship) to obtain income, resources, or medical care or coverage, or other services or benefits (for example filing a tax return, applying for housing, or seeking an Economic Impact Payment). If you believe you qualify for an in-person appointment, call your local office. You can look up the phone number for your local office by accessing our office locator. Please note that appointments may not be immediately available, depending on local health and safety conditions and staffing.

prettylilraindrop reacted to Ayrton in Green card arrived in new name- now what?
Having maiden name on the SSC is probably not going to be an issue for the DMV. You have a marriage certificate which is a name change document that is dated after your social was issued. So you will most likely be able get a permit.

For taxes, unfortunately you last name on the return must match the last name on the social security if you're filing electronically. If you file by paper, you might be okay just putting the married name.

I also had to change my name on the social by mail and received everything back. It took about 2 months because of a mistake they made, but I have everything back. If you really need to update the name now, just do it. Make copies of your green card and send the original with a SS5 form. They will return it to you within a couple weeks. And you will also get a SSC without restrictions.

Pictures during special occasions: birthday, valentines, christmas, easter, etc.  Cards from those holidays and birthdays could also be used.  The more the merrier.  Bury the interviewer with pictures LOL.  Head to your local CVS or whatever and develop your pictures form your phone (it's surprisingly cheap).  Then go through them and date it and put a short description on the back.  It could be a fun activity for the both of you.

Just use your logic—- What can I show the officer that a fake greencard marriage probably wouldn’t have?
Joint accounts, same address, testimony from Mom, photos with friends and family. And of course your marriage certificate (not license) that shows it was registered in you county records or the records of wherever you married. You’ve got this.

I had the same problem. applied for SSN with immigration paperwork. Never got anything ...
Applied direcly with my work permit, but SSN had been declined because "no in person appointment possible until you get a job" ...
for me it was crazy ... I needed a SSN to have a background check , just a nightmare
I had to call many times for weeks to have an appointment scheduled because of my professional situation. They finally gave me an appointment after 3 months

We actually received my husband's SSN the day after we received the approval notice, and prior to receiving his physical EAD card.  It can take a while, it can also be issued quickly - there is no rhyme or reason to it.

All of the bans clearly exempt spouse of US citizen. You can travel to UK and back since AP travel is very low risk.

The reason most employers ask for SSN is because having legal employees without SSN tends to be rare. The way payroll is set up caused delayed paycheck in JFH's first pay period:

The SSN field can be left blank since you don't have one yet. An example of working without SSN:

That is incorrect: https://www.twc.texas.gov/news/efte/employees_without_ssns.html "It is certainly legal to hire someone who is authorized to work in this country, but who does not have a social security number"

prettylilraindrop reacted to HRQX in I-797 as temporary EAD?
It does apply to initial EAD but the I-797 must be an approval notice: "For the notice to be acceptable, it must include a Notice Date from Dec. 1, 2019, through and including Aug. 20, 2020, and indicate that USCIS has approved the employee’s Form I-765, Application for Employment Authorization."
You don't have an approval notice yet. What you have is the receipt notice.
