He doesn't need to live with you. Actually him being in the US is better because, for the spousal visa, he would have to prove he's living in the US.

With a K1, you also have to adjust your status later on. And while you adjust status you will not be able to leave the US or work. Are you ready to be "locked in" for 6-12 months?

The time difference to enter the US is not much different between a K-1 and a CR-1.  However, getting a Green Card is much. much faster for a CR-1 holder.

The timing difference may have been true many years ago.  Right now, K-1 and CR-1 are both taking 1-2 years.  CR-1 is the far superior way to go.

    Wet signature is not required.

Yes, we have done our entire process ourselves.  I recommend reading as much as you can about the process.  Mistakes can add time and money to a process already fraught with roadblocks.

If we were to do it again, we would definitely avoid the K-1 and do a CR-1.  The adjustment of status part of a K-1 is a huge drawback.  With current wait times, your fiance may not be able to work or travel for up to one year.  The green card can take two years, and removal of conditions is up to four years.  In many states, people without green cards cannot drive.

Sounds like you’ve already made up your mind what you are going to do. Why ask us?  You need professional help and need to quit drinking, IMO. Have you quit drinking?  Will you drink at the “wedding?”  I don’t understand why people spend soooo much money on weddings when they’re already married and have children. The money could be put to better use. Good luck as you two move forward!  I only hope that she will be allowed back in at POE. If that’s what she wants. Most of the people here think it’s not a good idea to travel.

Whether it was 7 or 20 or 27 years ago, what he did was illegal and you had every right to know about his criminal past.  Since he didn’t tell you, you obviously had to find out somehow. Good for you!

I'll add that if your wife enters the USA two years after your legal marriage, her status will be IR1, not CR1, and there will be nothing to do but your choice of renewing the green card in 10 years or becoming a US Citizen anytime between the 3 and 10 years.

Tagging along what @Timona said, you don’t need a lawyer. Save that money.

Send a letter to the address stated on your I-751 requesting to switch to a divorce waiver. In the meantime, start organizing your evidence of a bona fide relationship. When you have the divorce decree, send it in together with the evidence and an affidavit saying that the relationship was bona fide, it just didn’t work out. Ask your ex if he’d be willing to write an affidavit for you saying the same. Sign it, notarize, send it.

You don't need a long explanation of why you broke up. You need to show evidence you married in good faith. Show your co-mingling of your life together stop focusing on the date after separation you should have had plenty already created before then.
So many things you can attach. When you get divorce decree send that in. That's all you have to do. No explanation is required. All the other evidence I would hope you already included in your petition package.

Most important evidence: 1. Joint income tax filing 2. Joint bank accounts (monthly statements since you open account). 3. Joint anything else(gym membership, credit cards, etc) 4. Insurance cards 5. Drivers license or state ID showing same address 6. pictures of trips together 7. Wills, Trust together 8. Lease/Rental agreement

She asked my husband my birthday. She asked me when we were married. She asked my husband if he had done any traveling. She spent most of the time going through all our papers that we brought with us.

Her petition for her siblings is insurance. Never hurts to have multiple petitions.  Sibling petitions take about 20 years...maybe longer.

I just went through the Maryland drivers license pre application process.

Maryland appears to be one of those states that allows  foreigners who cannot show an EAD, green card, or I-94 (yours will expire in 90 days so not likely to be of use) to get a drivers license. Oddly you appear to need an SS card. As a K-1 you can apply for an SS card and SSN and you should do 2 working days after you arrive.

You will also need proof of residency in the state. Your
marriage certificate to a state resident seems to suffice.

So I think you will be fine.
