    Do the  a Utah County Marriage Ceremonies By Remote Appearance (  https://www.utahcounty.gov/dept/clerk/marriage/ceremony.html ) and file I-130
    She will only be able to interview where she has authorized presence.
     
    Given the civil war in Burma, I cannot advise either of you to go there.
     
    My wife got a K-1 from the U.S. embassy in Rangoon, in 2019. Had Utah Remote Appearance been available, we would have done CR-1.

    What would the resolve? It takes as long as it takes. Getting hung up over how long, is only self torture.

    Thank you everyone for your input. I'm happy to hear they will contact me about further steps rather than physical email to my fiancé.
     
    I spoke to a USCIS representative today and we're trying to escalate the case due to "humanitarian issues". I explained how China (a communist country) does arbitrary lockdowns/covid punishments and frankly how I'm worried about potential war over this whole US-Taiwan-China controversy.  I just want to get her out of China as quickly as possible.

    That is all done online/via email. She will not get a letter physically mailed to her address.

    "After you have completed the steps included on the Fiancé(e) Visa Process , the National Visa Center (NVC) will conduct preliminary processing on your case.  Your case will then be forwarded to U.S. Consulate General Guangzhou for pre-interview processing.  You will receive a notification to complete the required visa application form (DS-160) and prepare the necessary documents.  Once your case becomes qualified for an interview, you will be notified to go to the visa application services website to schedule an interview."

    You two can also meet in a third country and spend some time together. It would be good to meet before she has her interview as you have not seen one another in a very long time. Save boarding passes, etc from the trip

    What letter is this?  Beneficiary doesn't get mailed letters as I recall.

    I went through the K-1 route myself and can't recommend it. If I were to do it all over today, I would choose the CR-1 every day of the week. But in the end it's a personal choice. 

    With that said - YES you can absolutely send in the i-129f petition while being in the US, I did the same thing. It was very convenient to be able to fill out the forms together in person, put wet signatures on everything, take passport photos at Costco etc. This also made it easier for both of us knowing exactly what was in the package, to double check everything etc. 

    I assume even Canadians get an i-94, it's on CBPs' website. Just google i-94 (should be the first link that pops up), insert your travel info and print the i-94.

    I actually have first hand experience with this situation. My then fiancée and I applied for a K-1 while she was in the US on a B1 tourist visa. The process was exactly the same except we input the I94 information and if I recall correctly, it asks if you are currently in the US and we marked down that she was.  Besides that, there was nothing different and it was never mentioned in our immigration process.

    You have 3 options:
    1.  Marry and start adjustment of Status process.  You remain in the US for up to 8 months before you can leave the country.
    2.  Start Fiance Visa Process.  You return to Canada.
    3.  Marry and start CR-1 spousal Visa process.  You return to Canada and visit until you get the visa.

    Google I-94, input info and get your travel record.
     
    Just an FYI, that K1 takes as long as CR1

    The K-1 process takes longer 
    You can be married as early as today,. Definitely by tomorrow.  With a marriage certificate in hand. 
     
    Every alien who enters the USA has an I-94 unless the CBPO made an error.  Have you tried to lookup your I-94?

    Canadians have always been exempt from paper I-94s when visiting for tourism. When I-94s became electronic, Canadians were no longer exempted.

    I don’t see a problem with you submitting the I-129F whilst visiting in the US, just as long as you don’t overstay the time allowed for you to be there and of course if you were to get a K1 interview sooner to go back for that.
     
    Hopefully others that have done this can chime in, but I don’t really see a big problem.

    I am a Canadian citizen engaged to a US citizen. I am currently in the US as a visitor (no visa as Canadians don't need a visa to enter typically). Can my fiance and I start the application while I am here and will I be able to stay the 180 days Canadians are usually allowed while the process starts? I see on the application it asks about a I-94 record number. Do I need something like that if I want to start the process while visiting. I have been searching online for answers and everything is really unclear. If anyone has first hand experience or knows for certain please let me know. Thanks in advance!

    OP, i saw in ur post in January 2022 that u have a lawyer, I think it’s best to ask / tell your lawyer about ur concern. Many people here are giving you excellent input but it seems you are irritated by the way they response. Perhaps ask your lawyer maybe he can explain better ?
