    Gotta break the habit. Mini-B is too wee! He'll be alright. Time to use his imagination now. Do you have one of those indoor places with trampolines where he could be taken during rainy days? Here, they are not too expensive, provides entertainment and exercise.

    - People don't show up to work and I have to cover
    - Still need that vacation with the cool looking water and drink with umbrella
    - Some people think we are their personal assistants
    - Back on a diet to lose this baby weight once and for all
    - Gofundme for the much-needed vacation? I bet that family Nola knows would probably do something like that.
    - Mini-C woke up at 12.30 AM, cried and screamed for 20 minutes, worried the ####### out of me and went back to sleep... Little ones have nightmares too, si man!

    No. His old AP was due to a pending I-485 that is no longer pending. As such, it is now invalid. Even if it arrives, he left the country without an approved AP. His AOS application will be deemed abandoned. On what basis can he enter the country without a valid AP or visa? You can try, but again...on what basis would he enter the country? I could be wrong, but I think the attorney is hoping that AP will be issued because USCIS might not notice that he left the country yet. Then is hoping he can enter on that with CBP also not noticing / USCIS not recording his AOS as abandoned yet. This is sketchy at best and fraudulent at worst. The moment he left the US without a valid AP document, his abandoned his AOS application, and he needs a valid travel document to re-enter.
     
    Assuming he has not accumulated 180 days or more in unlawful presence while he was in the US, he won't have a bar. As such, he can qualify for another visa (i.e. a CR-1/IR-1 spousal visa) without a waiver.
     
    Unexpired AP* (still not valid if the I-485 was closed).

    Can I clarify one point please !!
     
    Coming to the US from another country with the pre-determined plan to to get married to a US citizen is absolutely, 100% legal.
     
    HOWEVER... planning to remain in the US beyond the time allowed by your non-immigrant visa (tourist / work / student) and / or filing to adjust status as a result of that marriage while remaining in the US will almost certainly be considered visa fraud and open you to a high level of additional scrutiny if the application even gets to the adjudication stage.
     
    As has previously been mentioned, there are multiple visa options open to you but none of them will allow you to marry and remain in the US for the entire process.  In most cases, visiting the US from another country is still permitted during the visa application process but care should be taken to not be seen to be abusing this right.  Your USC fiancee / spouse will also be free to visit you in Canada per the rules and regulations set out in her tourist visa.
     
    Trying to bend the rules or work the system to your advantage will likely cause you more trouble and time than deciding on an approved immigration path and working around its inherent restrictions.

    What country is your fiance from? As Pana indicated, some embassies, such as the UK embassy, allows self-sponsoring. Some other embassies, however, don't allow co-sponsors. So this is crucial information so that we can help you

    I have some extra zucchini at home and was thinking about making zucchini-banana bread.
     
    I haven't experienced any of the above yet but, with the current climate, I've been practicing everything that will say if anyone decides to launch at me for speaking in Spanish. Sad that I even have to consider that.

    Actually, it's the intending immigrant's responsibility to file for AOS. Always has been. The USC's responsibility is to support them in their effort and provide a completed I-864. It's is not the USC's green card or status at risk...the intending immigrant's is and it's their responsibility to ensure it is filed for in a timely manner.
     
    While very rare, it is technically possible to AOS even if you are divorced. However, the USC spouse must still be willing to complete the I-864. Without being married, there is usually no compelling reason for somebody to take on that kind of financial responsibility for up to 10 years. It's a decision entirely in their right to make - or not make.

    My husband can't afford any of it (filing AOS or therapy.. He spends everything he makes on his son because they're separated with his mom and he tries to compensate not being there for his kid, with buying him all kinds of expensive stuff he points at.
    Also, he doesn't consider us to be family since we don't have kids. He has told me many times that I'll never mean even 1\4 of what his son means to him, so I just live in the shadow of his son.
    My husband doesn't want to spend time with me, all our time spent together is going to grocery store and like once in 2 weeks he'll go to park with me for a short walk. We sleep in separate rooms, he never shows any affection..basically, we're just roommates who seem to hate each other. It was different when I just came, but now it's just like this because he is probably bored, as the toy is not new anymore. So I don't think therapy would help, I just picked someone who doesn't care about me and wasn't able to recognize that before we got married.
     
    Sorry about ranting here and telling all sorts of personal things, I just can't really tell this to anyone in real life, it's too embarassing.

    I see no obvious fraud.  Divorce, withdraw the I-864 and don't listen to empty threats.  Many k1s don't get an interview so I'd do this quickly.

    For a marriage of only 8 months she would be lucky to get anything of your assets or property in most states.  She has obviously been coached.  I would avoid being alone with her in any place.  Change the locks , divorce and run pull the affidavit of support.

    Even if the OP were homesick, what does that have to do with the fact that his husband is abusing him? Answer: Nothing! The OP also stated that his husband isn't willing to go to therapy because he won't admit that he's being abusive in the first place. 

     To the OP:If your husband is being abusive, binge drinking, blacking out, threatening you and isn't willing to get help you need to get out ASAP, it will only get worse. You should worry about your safety first and foremost and worry about your immigration status later. I always wonder why people are willing to stay in a dangerous situation because they want a green card. What if you're out drinking with him, he gets behind the wheel with you in the passenger seat and gets into an accident? You could be killed. Just think about about that. Is a green card more important than your life?
