She can go back to her home country to await a visa if you petition her. She will have to wait out her ban period after she leaves so may as well leave now to be able to use a visa when available. Waiver for the ban may be possible. That’s the only way for her to get legal. No path through you via adjustment of status.

I used a scanner App on my phone to scan all my documents :) Worked pretty well. I think a picture will do, but just download an app on your phone and it will make life much easier. Cant remember the name of the one I used but there are a few free ones

The answer is yes. Currently, you are a non-immigrant lawfully present in the US.
What state are you in?
Depending on the state, you may be in a limbo period where you have nothing to prove to the DMV that you are lawfully present while adjusting status, thus making it impossible to get a driver's license. You may have to wait for your EAD card to qualify for a driver's license.

Seems odd that someone concerned about a potential aging-out situation would want the petition expedited. That’s counter-productive. The quicker the petition is approved, the less use the CSPA is. Personally, if my child were facing an aging-out situation I’d be more than happy for the petition to gather dust in the USCIS storage room waiting for approval until the PD is current.

It doesn’t even matter if the petition is somehow expedited before it’s current, because an actual visa is not available until the priority date is current, and the CSPA age cannot be calculated before the PD is current either. Nothing of consequence can happen before the priority date is current.

INA 222(a): "Every alien applying for an immigrant visa and for alien registration shall make application therefor in such form and manner and at such place as shall be by regulations prescribed. In the application the alien shall state his full and true name, and any other name which he has used or by which he has been known; age and sex; the date and place of his birth; and such additional information necessary to the identification of the applicant and the enforcement of the immigration and nationality laws as may be by regulations prescribed."
The "regulations prescribed" are codified in the Code of Federal Regulations (CFR). See 22 CFR § 42.62(a): "Personal appearance of applicant before consular officer. Every alien applying for an immigrant visa, including an alien whose application is executed by another person pursuant to § 42.63(a)(2), shall be required to appear personally before a consular officer for the execution of the application or, if in Taiwan, before a designated officer of the American Institute in Taiwan, except that the personal appearance of any child under the age of 14 may be waived at the officer's discretion."

Thanks for sharing Good news.....This has nothing to do with the Biden administration. As it has been for years, Marijuana is not legal federally, and it has always been at the discretion the medical professionals and consulate officer to evaluate each case. I would caution everyone that any case is subject to a one year ban if the consulate determines. I'm glad it worked out for you. Thanks for sharing. Good luck.

Except that with approved petitions for K-1 sitting at NVC for a year now, it’s no longer faster. Interviews for K-1s are at a standstill. Since spouses are considered relatives, those interviews are happening.

I believe for O-1 you’d have to have publicly documented notoriety/accomplishments in your field, which is why Susie referenced Great British Baking Show earlier in the thread.

Incorrect. If the children are USCs, then they do not need visas or sponsorship.

it’s a terrible visa really, and covid has magnified its drawbacks.
