    Hi

I've just had my medical and I've got my interview at the US Embassy in London on 7th May.

I've got all the documents together but I'm a little confused about the financial support evidence. Now the Embassy here page says there is no specific form for this but the i134 can be used. So, do I fill it out with my information or does my US fiancée complete it?

I will be job hunting as soon as I get my EAD and have enough savings to support myself for at least 8 months, though my fiancée works and earns above the threshold to support me. Should I/we use the 134 to show this or will print outs of my bank statements and her most recent tax return be enough? Thanks in advance.

Your fiancée is your sponsor, and so he/she needs to complete the form.

Follow the instructions on how she is to provide evidence of her current income.

  2. I don’t understand how a person can be divorced by someone and not realize it.   There are signatures required, even for simple divorces.   And it wasn’t like it was a divorce done in absentia for someone who could not be located.

There must be more to this story.   One wonders about the future of a marriage where this has occurred.

And from an immigration perspective, OP you need a good immigration lawyer like yesterday.   This is well above free internet pay grade.

My 2022 tax return shows a low Total Income due to my new business losses. Of course, for tax purposes I was trying to get my income as low as possible. Can the wages and salaries be used to support the income requirements? or does it required to rely on the Adjust Gross income? Also, the 2023 income will show better, but I am waiting for my business K-1s. So, I won't be able to file the 2023 returns until July. I want to avoid an additional 8-12 week delay. Can I substitute may 2023 W-2's/1099's and/or bank statements? Or am I required to use Tax returns? Any feedback will be greatly appreciated. Thanks

I'll relay this to him, thank you again.

Unfortunately he did go back through his childhood vaccinations and there is no record of him getting the pertussis vaccine. I'm not sure why that would be, as he was born in the 90's.  But yes, this has to be in his hands. I have no way of contacting people over there. I'm generally the one trying to spearhead difficult tasks but I have to sit back on this one lol. It also sounds like since he got the DIP/TET/PO that might be sufficient...? I don't know, I'm just going to let things happen. We were trying to be proactive as he hasn't even gone to his medical exam yet so he can ask them when he does that to be sure.

Take care and thank you again.

Isn’t pertussis the “P” in the DIP combo vaccine?   If he’s had that, he should be fine.

Robbery, fatal shooting revealed as elaborate visa fraud scheme

Police believe the motive was to leverage their status as crime victims to apply for a U nonimmigrant visa, known as a “U visa.”

Investigations revealed that the robbery was part of a larger scheme involving insurance and immigration fraud. The charging documents indicate that not only was the robbery staged, but several other similar incidents occurred across the area, implicating multiple individuals, including store clerks.

Interesting.   I’ve wondered in the past if this was a fraud strategy, since, like VAWA, the U is a much abused route to GC.

I can think of all sorts of variants, just a few points

    1. Nigeria and fake divorces are well known
    2. DoS do check
    3. Seems that in this case the OP also told them, so extra reason to check.
    4. Who knows the validity of the Lawyer in Nigeria
    5. Maybe he subsequently had a valid divorce.
    6. Not sure what the US Consulate in Lagos have to do with this, he is a USC, maybe in Nigeria, I doubt he needs Csulate Services.
    7. If he wishes to petition his GF than all this will be gone through again.
    8. Sounds like the OP has not divorced if not then that should be a priority, I suppose if he never was free to marry then the marriage was never legal but doubt she has evidence of that to convince a US court.

The consulate would be involved if his naturalization was in question, as it pertains to the eligibility for other IR visas.

But why did he fake the divorce?  Couldn't he have done all this and just remarried his original wife?  Seems like the divorce being fake was completely unnecessary and a stupid risk.

Well known Nigerian scam.   Scammer obtains falsified documents, married American, divorces and then brings over original wife and family.

But you said above he'd had DTAP (which is pertussis), now you say it's DTP - has he had both? If not, which is it?

@SalishSea, in the UK polio isn't routinely given separately. https://www.nhs.uk/conditions/polio/

    22 minutes ago, FolieADeux said:

Look, he has the receipt for his vaccine. Maybe that's true in your country, but not his. His clearly shows "DIP/TET/PO", all in one. Don't need your toxicity in here.

Neither TDaP nor DTaP contain pertussis, which is what the OP stated.

OP, no one is being toxic.  You were factually incorrect.

  9. 10 hours ago, FolieADeux said:

The P in one stands for pertussis and Polio in the other one.

This is absolutely NOT correct.  Polio is an entirely separate vaccine that is not ever combined with other vaccines.  The P in both of these is pertussis.

Very much doubt you will find a single agent pertussis vaccine either in the US or UK.  It is combined with the other vaccines into DtaP or TDaP, and typically given to adults in the US every 10 years as a tetanus booster, even though it provides protection against diphtheria and pertussis as well.

Once you send in hard proof that it was all a scam, send them proof of who he is married too and all the proof that marriage is still ongoing.

Good point.  If this scenario is correct, OP's spouse is now positioned to potentially bring over that wife, child, and extended family.  Denaturalization is uncommon, but would be completely appropriate in this case.

I had to delete my original comment because I didn't want to sound like I was judging the OP.

I had a counterfeit divorce decree issue myself and it was picked up at the consulate in Lagos.

OP said they discovered. They also said the divorce decree has been "confirmed" to be fake. Like you pointed out, the beneficiary was able to Naturalize under 3 year rule, then divorced.

OP now wants to report marriage fraud? Hmmmm ok. As you also pointed out, does OP know they would also be indicted in this marriage fraud case?

USCIS would probably laugh this off as a case of an embittered ex-spouse. I am certain they did their due diligence all through Consulate, RoC and Naturalization processes.

Thanks for posting this.  It does shed some light on the issues here which are perhaps unique to Nigeria.

Would USCIS reject the application if I didn't have current employment or an offer? How do I get it to the NVC stage without it, if possible?

Savings are tough. Salaries in Poland are very low in USD and right now doesn't offer much room for it. We are open to us being separated for 6 months and lower, so I can go back in about a year, but we'd like to apply end of this month or early May.

Your ability to support an immigrant is based on current income, not employment offers.

I got married to her a couple of months ago on my last visit to Moscow. When the documents were actually being transferred from Poland to Jerusalem, so now I feel that we don’t need to submit that paper from the mask with the proof of relationship documents. It’s not a marriage certificate from court. It’s just from the mosque. I’m not sure if it’s still a big deal to them.

You have much bigger issues here than the missing divorce decree.   You need to start over with a spouse visa.

My fiancé got a RE2 blue sheet after 1st interview & needed to include more evidence, including filling in Spouse Evidence Form. - In the Spouse Form, the part of each side's family tree - family relationship I have trouble answering. I'm the petitioner, my mum & dad got divorced 22 years ago, my grandparent from dad side is long gone, I don't know when they were born, and I lost contact with my dad, we didn't end in good term, so how do answer birthday section? Should I says I don't know?

Well, what else can you do?  If you don’t know, you don’t know.

I’m just wondering what else proof of relationship she needs to stay with her or we need to send again. I just took photos of chats and call logs. I did a new intent to Marry and also got married in the mosque and I have a paper saying that me and her got married at the Mosque in Moscow. Would this would be a good proof too?

    What!?!   You got married already???

Well, she won’t be getting a fiancé visa.   Getting married made her ineligible for that visa.   You need to petition her for a spousal visa.

  16. Just now, K1visak2 said:

Yes, it was actually submitted with the petition as USCIS asked for the original divorce decree. But to mention that she is Russian and we had to request a visa transfer from Warsaw Poland to Jerusalem so I’m not sure if I got lost but they did ask for the divorce decree again.

Okay.   Well, you need to get a certified copy of the decree from the court, which will have the raised seal.

Such documents can be falsified, which is why they require originals.   (“Certified copy” is the same as original).

    Are there other red flags?

She took 10 photos with her and a copy of my Russian Visa showing I traveled to Russia 3 times the past 3 years . She also took plane  tickets and boarding passes . she took my divorce decree with her. I think the only mistake she did about that she scanned and printed the paper and instead of taking the original documents. but the printed papers looks exactly like the original. we actually thought we went prepared.

But your divorce decree should have been submitted with the petition.   Was it?

We are going through this obstacle right now too as my fiancé was given a white slip refusal for her K-1 visa the US Embassy in Jerusalem and their section 221G asking him to submit more documents. She had to travel and fly to Israel it just devastating and very expensive to stay over there and I’m not sure how long it’s going to take after we sent the necessary documents.

OP states that in this case, no documentation was requested.   Yours had requests for multiple documents, so it is not similar.

Good day all ,today unfortunately my Russian fiancé received visa refusal in Jerusalem ,under section 221(g) asking her to submit more documents .we are working on sending the required missing documents within a week .does anyone know the next steps after the embassy receives the documents and how long it would take them to process the documents and give updates afterwords? .my fiancé is Russian and she had to fly to Jerusalem to attend the interview .she was given 3 months b visa at the border of Israel .we had to transfer our case from Warsaw to Jerusalem and they arrived our transfer request and now we are just shocked by the denial .the us embassy embassy in Jerusalem are asking for a original divorce decree ,passport and proof of relationship .has anyone gone through this ,if so please advice me what need to be done to resolve this and get her visa approved

These are very basic items.   Did you file a petition without evidence of being legally able to marry, IE termination of prior marriages?

AP is a black hole, and there is no set timeline for it.   She may or may not have to attend another interview.   I’m sure it is annoying since it requires travel, but it seems you left out some required documentation.
