She was illegally at the border and was fingerprinted and released at the point of entry.  She did return and stay.  Her children were not with her but because her children are in the US now the official might think she brought them.  I assumed that since her waiver was approved that her entries are not a problem now.

She did not enter with a visa.

If she didn’t bring them, how did they get to the U.S.?

Okay, so here's a unique situation. Hawaii divorce court filed an order that my two minor children (US Citizens) ages 5 and 7 be brought to me by their mother in the Philippines. I will have sole custody of them for 3+ years.  This was a court stipulation. I have already found an excellent school for them to attend and suddenly wondered if I need to apply for some kind of student visa or would the school do that? Any help will be GREATLY appreciated. Please help...my kids will be arriving mid-June of this year.

Your post is kind of confusing.  You've posted under the student visa board, but it appears you are talking about student visas for the Philippines?  If so, you will get better responses on the Philippines country forum, and I will ask a mod to move it.

Yes i know that bro but i cant help it. I think i made a mistake goin to uscis website and hoping it doesnt have any impacts in my future b2visa application.  chatgpt and gemini from google said us embassy and uscis arent sharing any info between them although they r part of the department of state and homeland security. Also uscis doesnt share such info which is confidentiality asked.

They ABSOLUTELY share info between agencies, 100%.   Bro.

I applied for my mom December 2023, her application status still says "actively reviewed". Until recently we had no issues her waiting back on my home country but now I'm really worried that  the whole thing might be jeopardized, due to continuous unrest in Georgia(my home country where my mom is right now). Plus she is of an elderly age and that makes me even more worried about her. I thought maybe it would be a good idea for her to maybe apply for a tourist visa in the meantime and then finish her immigrant visa process here, in the states ( medical, exam, interview etc.)

The thing is, I'm not sure if that is possible exactly. So far, from what I've read online, it seems like it is possible for to visit on a B1b2 while her i130 is pending but she will need to return back to continue her process. it's quite a long distance to travel for an elderly person that never travelled internationally before and the whole thing just makes me uneasy.

Does anyone here had similar experience where they had their parent/parents come on b1b2 and then continue the rest of i130 here in the States? how realistic is that?

I also was thinking about maybe trying to expedite the whole thing?

I am just afraid, by the time her interview comes, things in my country will be come so difficult and who knows, maybe U.S. embassy won't even be there by then and I'm freaking out. My biggest nightmare is here getting stuck there alone and me not being able to bring here:(

Any advice on the matter would be appreciated!

No, that is fraud.   Also unlikely she’d even get a B visa.

On what basis would you try to expedite?   They won’t expedite because you’re tired of waiting.

good day we have our interview scheduled for June. Unfortunately, my husband is incarcerated and will not be able to make the interview when we file for our paperwork. We included the part of the policy where it said waivers for incarcerated petitioners, and we include evidence of his incarceration obviously he can’t attend the interview. What do I do, please help

So he’s been incarcerated all this time, and you’re adjusting from ESTA/B visa?   Why did he not petition you?

How will he sponsor you without an income?

I remember filling in g639 form however i deleted my account yday. That form is part of freedom of information act / privacy. I tried to access my i94  there. I did get an email saying they couldnt find anything but now i am worried since my passport number is with them , i hope the US embassy doesnt have an issue with that coz if they punch my passport number n the uscis pops up i might be in trouble as to what i was doin at the citizenshsip portal.

Again, being worried about that makes NO sense.

You are right . Mayb i was overthinking. I thought the usa embassy would think i used the uscis website to apply for a green card or something

They won’t, because that’s not how that works.   You don’t just randomly “apply” for a green card.   It’s all very regulated.

Thank you vicky's mom for the information but my question still persists as to whether accessing info from the USCIS will be known to the US embassy ? I asked chatgpt and it said asking for i94 from uscis isnt illegal and its perfectly confidential as in noone will know i accessed the USCIS

Not sure what you're getting at here, but I-94 info is accessible to you, and it is intended to be.

If you're asking whether the various agencies involved in US immigration communicate with one another, the answer is obviously YES.

Yes , any help would be appreciated.  I am little worried as i have to renew my b2 visa.  I was told to check my immigration record on uscis but i guess they could not locate anything or i was looking at the wrong place. I was wondering if the usa embassy would know about me requesting for b2 immigration record and if that would affect my future visa application?

What immigration record?  B2 is nonimmigrant, and under jurisdiction of dept of state.

    2 hours ago, Mzk279 said:

Ok but that doesnt answer my question as to whether its going to be an issue for future visa application?

Your future ability to renew B2 visas is absolutely impacted by your travel/stay/overstay record, yes.

My beneficiary is from Iran and I am from the US. We just saw our boundless immigration timeline for our K-1 Fiance Visa and it says from the time I receive the I-129F in the mail it'll take till October 2025 to be approved after which they estimate another 8 or so months. Honestly this feels so long to us and I know our situation isn't special and all the people on here yearn to be with their partner sooner. My concerns and hers are due to the escalating tensions between countries in the region and the possibility of a war. There's also the morality police who may target her due to her social media presence which is pretty high. There are also some home factors that aren't great as well as the fact that the country wants to stop immigration of graduates from their best universities. I'm worried this wouldn't be enough to qualify for expedited process and worried about what will happen to her during the 2 years she is living there. Even if you don't have any answers about the expedite process I'd love to hear from others on how long their process took and just general support.

That won't qualify for an expedite.  The wait time is what it is, and Iranians are subject to extra vetting and background checks.

You may want to look into moving to a third country together if you cannot wait that long.

I receive a paycheck every month for salary which i deposit in my savings account. My b2 visa is up for renewal in a few months so i was wondering if the usa embassy accepts bank statements showing paycheck deposits against bank transfer for salaries which is quite common these days?

I have pay slips for the cheks deposited every month

What do you mean?   Why would you need that for a B2?

    Hello all,

I have been a US citizen for close to 10 years. I never applied to bring my parents over, as they never showed interest in relocating to the US. But we have been thinking about this lately, as they would like to be close to us.

They will be visiting the US for the first time on visitor visas soon.

I have couple of questions, if I may:

    1) As I understand, we can apply for adjustment of status (I-485) 90 days after arrival, correct, if we decide to pursue it?
    2) Would we also need to submit the I-130 form?

    3) Do they need to stay in the country while the adjustment of status is in progress and how long will it take to get the green card?

    4) Would it be better if we apply after they return back home? We could possibly submit the I-130 form while they are in the US, if that is allowed, since they will be here for about 4 months.

    Thank you!

Absolutely not, that is immigration FRAUD.

This is a good general observation, whether or not it applies to the OP's specific situation.

Yes, meant as a general observation, not necessarily OP's.  I'm sure the advent of international dating apps and gaming has contributed to international relationships, which are expensive and time consuming to develop and maintain.

Not sure where you would ever get this idea. I've been on VJ for a dozen years and this is very far from the truth. Most petitioners, are in fact, far below retirement age.

There is a certain demographic of aged petitioners who seek out young, primarily Asian brides.  Some of the country-specific subforums are chock-a-block with them.

I had no idea she was going to be this way, she certainly didn't act like this when we met and during our courtship.

This is the problem when people marry and petition foreign spouses after one or two in-person vacations together.  Really not surprising that it was never enough time to build a foundation for a lifetime.

I need advice on what my first step should be.

I am US citizen, my mom has a green card but she has been in the ph for 7 years without coming back to CA. She refused to before and now she’s sick and finally willing to come back. Her green card expires next year and she has her ph passport. She was married to my dad for 20 years and living in CA  for that whole time, but after he passed she decided to stay in the ph. Now I’m not sure what to do to get her here. Is it as easy as just buying a ticket? Or will she be turned away at the airport immigration? Does she need to go to DFA OR US EMBASSY in the ph? I live paycheck to paycheck and I don’t have money to throw around.  Any advice would be super helpful.

    thank you!!

Since you say she’s already sick and you’re living  paycheck to paycheck, you will want to thoroughly research what it will cost for her to have health insurance coverage here in the US, and whether you/she can afford it.   Even if she’s eligible for Medicare or state Medicaid, the premiums and treatment co-pays can be hundreds or thousands $$ per month.

I am US citizen and planning to marry a Canadian citizen. Can she stay with me in the US while waiting for approval? I know Canadians they enter to US without a visa for 6 months. Can she stay with me that long, exit the country and come back again? I really don't know what is the best options we have here!we really don't want to live apart for more than one year!
