Immigration is actually straightforward.
There are certain types of visas, backed up by rules and regulations.
it is not a game of “how to circumvent the rules “.
quite simple.your father has 2 options:
1. get a tourist visa also know as a B1/B2 visitor visa. He is applying on his own (as mentioned quite a few times before) and your approval is irrelevant
2. You apply for him to become a green card holder. That process also comes with its own rules as to how to keep the status once one is granted
your brother
1 apply for a tourist visa on his own merit. Your approval irrelevant
2. you apply for his immigration visa and he gets in a 20+ years queue

A tourist visa has completely different requirements and criteria.
neither has anything to do with the officer conducting an interview.I had quite a few tourists visa interviews and all required documentation - letter from the company I worked for, salary, number of vacation days, financial statements, proof of ownership (I provided car, home)… i uploaded everything ahead of time and brought the originals to the interview. I had my planned vacation agenda as well.
every time before the interview started I was asked if I preferred the interview in English or my native language. In case assistance is needed, they have native speakers working and assisting the officer. Assistance was always offered.
I witnessed a few instances where a brother got approved and sister wasn’t even though they provided the same documents, travelled together too. Tourist visa is issued on individual circumstances and documents provided. There are also countries that made that process more difficult because of visa abuse.

your MIL should not be helping your wife with the baby. That’s considered working.

His last step (of this part of the immigration process) of visa approval/denial is the interview at his local American embassy.
NO1 and NOA2 are steps leading to the interview and will not interfere with the process.

Food for thought…immigration is not an easy or a short process..detailed records of every exit and entry back to the United States is important. Also, being out of the country pushes naturalization eligibility - in your case for years…

What that means is that you have to have a green card or have a work visa. Tourist visa is not eligible for work

Just make sure you are taking the right expiration date when calculating the stay in Honduras.
what I believe others tried to explain. K1 visa will have an expiration date but the right date to start the countdown is the date on the medical.
sometimes medical is done months before and that date trumps the visa date and shaves time of the K1 visa expiration.

Don’t overthink it girl! It’s an in and out thing, especially if you’re comfortable with the civics test and the case is straightforward…

How in the Gods name do you think of hiding something like that? And especially from a person who you love? Are you aware that you will have to have health insurance in the USA? You are aware that you will not be able to work for a significant period of time thus not being able to see a doctor without your partners insurance??? How would you explain to your partner that you need to see a doctor every 3 months? What if he had issues with it?

You said you are naturalized USC. So I would assume you have an idea what immigration really is.
You talk about getting visas like it’s a walk in the park.
I’m glad you have a lot of family and friends in India, but you are talking about immigration to the USA.
All new ballgame, all new set of rules. To get a visitor visa your girlfriend must apply, interview at the consulate, show strong ties to India, work, money…and most of all, she needs to provide proof she will come back to India…you have nothing to do with her tourist visa.
immigration - focus more on the required paperwork, marry, file, and hope your case goes smoothly.
to expedite a visa - another firm set of rules and requirements.
there’s no way around the legal process no matter how you ask and unfortunately separation from a significant other is inevitable.

Government jobs have stricter regulations, and that’s just a fact. Some, require citizenship, some GC and all will - always - conduct an extensive background check. There’s no way around that. Immigration is a lengthy process and patience is necessary.

I too didn’t feel comfortable sending my naturalization certificate and my SS card through the mail, and during covid there were no appointments. I did call because I was wondering about repercussions if card was not updated and I was told I’m good because system shows the change. I was also told that there are people who never get an updated SS card.
Personally, I wanted to update my card and have immigration process behind me so as soon as they were open to public, i got an appointment, was done in 5 minutes and received an updated SS card in the mail less then a week later. I was naturalized in 12/2020 and updated SS card 4 months ago. -

The offficer said they would take care of the I751 and the N400! Well my spouse went in first, and came out about 20 minutes later. He was told that was it. The officer didn’t to speak with me and Javier would receive notice in about a month for his swearing in! They never interviewed me for the I751 and she just processed it.I won’t believe it all until we actually see the notice, but regardless, this is major progress. 😅😅😅😅

I was in the same situation. Pending I751 and scheduled N400 interview.
i received a call from USCIS maybe a week before my scheduled N400 interview and was instructed to bring my husband because I 751 needed to be adjudicated before N400.if you do not receive a call or a note from the USCIS, I would have your spouse come with you…

We did K1…but that was when process was not as slow as I see it is now.
And even though our Adjustment of Status was processed really fast (I’m from Zagreb, hubby American) not being able to work for months until my green card and work permit was issued was fun maybe for 2 weeks…as others are mentioning, spousal visa would definitely be my choice. Don’t get discouraged by paperwork though. Paperwork is a huge part of immigration reality for years until you are at the finishing line. I personally think that the attorney is not necessary, unless you have a complicated situation. Having an attorney will still require you to do the legwork.

At the end of the day, who ever is in the process of immigration to the USA should follow the law regardless of the laws of any other country in the world.
Trying to outwit or change the laws of a country you want to build your future in makes no sense.church wedding is still a wedding
k1 is a fiancé visa
you are no longer a fiancé if you are wed
as simple as that
From the time of entering the country under a K1 visa we all have/had to go through a process that takes years and a ton of evidence, patience, nerves, money…adding to already stressful process in my opinion is unnecessary unless you are willing to jeopardize your future over something that will not benefit you but could hurt you

I know I was going crazy…especially with my N-400 interview approaching and I-751 still needed to be processed. I think I was checking my USCIS account a billion times a day. Drove my husband nuts…
When they called my cell, I didn’t even answer LOL. It showed on my phone as a possible scam…
the lady that called left a message and a phone number. I was at work and almost cried…checked the number she left to see if it’s legit and she called again maybe 15 minutes later.
i will not tell you to stop stressing…I think you will regardless…i will tell you that you are a minute away from this adventure to be over!

I was in the same situation as you..and I was stressing over the same issues…waiting for I-751 to be processed and filed for N-400 when my window opened.
I was maybe 10 days away from the scheduled N-400 interview date when out of the blue I received a phone call from my service center in Tampa informing me to come for my interview with my husband because they needed to process I-751 first and I-751 requires both of us at the interview.
so, i had a combo interview.
The interview lasted maybe 30 minutes including the civics test.

I’m not sure GC is an option for a few reasons. In order for it to be approved you would need to move to the USA and live here. Proof of domicile is required .
And for your wife’s GC not to be cancelled, she would need to actually live in the USA.
none of which you said you wanted.
you may be correct, it’s not only not worth while but it is not plausible. Maybe, down the road, if you decide to move to the USA…
