Tolly reacted to sofyab in Can't Afford Plane Ticket Home for Wife
I agree, but in my understanding USC should be responsible for immigrants basic needs such as shelter and food. All extras are just that... "extras". He agreed to support her but her going or not going back home will not impact if she will become a public charge.
And he did not bring her here, they were going through the process together. I have a feeling that OP would love to buy her a ticket but he just can't do that for financial reasons. Time for her to learn that he's not obligated to support her "wants".

Tolly reacted to mindthegap in US Citizen spouse withdrawn the petition while LPR wife is out of the country
What is all this terminated and 90 days stuff?
Her status is not terminated , only the joint aspect of the existing petition is - she just has to add a waiver (divorce, abuse, hardship or whatever) to it

Tolly reacted to mindthegap in US Citizen spouse withdrawn the petition while LPR wife is out of the country
The US citizen spouse cannot withdraw the petition.
They can withdraw themselves from the joint aspect of it - meaning a waiver and an interview will be required but they cannot totally withdraw a joint petition.
The alien can then add a waiver to the existing petition converting it to a solo I-751, and no need to refile from scratch
Don't visit the embassy - get back to the US ASAP - and remember that LPRs have the absolute right to a minimum of a hearing with an immigration judge , should they encounter any issues at the POE.
When they are back, go see a divorce lawyer, as divorce paperwork will need to be filed for a divorce waiver, although quite honestly, I reckon this would qualify for an abuse waiver with a competent lawyer behind it..

Tolly got a reaction from Pearlz555 in Failed second interview for US Citizenship.
Due to the circumstances, you highlighted, I will suggest you read to her. I mean the sample questions. This will give her ability to retain the new learned information

Tolly reacted to geowrian in Military hot line told us to get married and go adjustment of status instead?
No, you don't. The "rule" is a DOS item, not USCIS. But they don't matter anyway as intent is established at POE and is not cause for a denial of AOS, according to Matter of Battista and Matter of Cavazos.

Tolly reacted to KF & OS in Military hot line told us to get married and go adjustment of status instead?
Why go back to Canada and be faced with the visa interview with no gaurantee of passing???? Nothing is assured my dear. Why go back to Canada and be separated from ur fiance for over 6 months??? What if something happens at the medical and then u have to wait longer or even become ineligible?? Just get married, wait for about 3 to 4 months after filing AOS +EAD+AP, use ur AP to travel back to Canada and finish any pending business.

Tolly reacted to A'n'L in Does She Even Need an I-601 Waiver? (merged)
No. The only way a previous non-immigrant visa denial/revocation would have a negative impact is if US overstay or misrepresentation was involved.

Tolly reacted to Unlockable in Refused
Then the reason for your refusal is that you didn't show sufficient proof of enough ties to your home country.
If you keep apply and nothing has changed with you you will keep getting denied.

Tolly reacted to NYCruiser in presidency [merged threads]
Here is my five cents. Clinton WON the debate from the second half. He was winning the first half. However, as Trump said, she has been doing this for 30 years now as a professional politician (money #######), She SHOULD have won. What exactly has she done in those years? Ask yourself that question. She came to New York and bought a huge place in Chappaqua so she would become a NY Senator here. Did nothing. State Dept? Did nothing really but travelled a lot, burnt gas in planes. She is bought and paid for by Saudi Arabia, Qatar, Wall Street to name just a few examples. Who gives millions of dollars to a 'Foundation' for nothing? That being said, Trump is a bully and a pitbull. His answers to the Obama Birther issue was disgraceful. He thinks as a CEO he can say 'jump' and people jump. Yes in HIS world but not the world of politics. He is not a racist I believe, just a businessman with shrewd and bottom line business skills. AS a politician, he does not have the smarts to BE a politician like her. THAT is the reason why he will get 45% to 50% of the vote. He is clearly an outsider with an ego the size of a hot air balloon.
We are screwed!! Vote Libertarian....:-(

I do not support Donald Trump at all but he always said he is against ILLEGAL immigrants. I have never him heard say anything about legal immigrants though. After yesterday's debate - which was a total joke -, I'm pretty sure Clinton will become president, which I do support.

Are you serious? When did he EVER say he doesn't want LEGAL immigration? I would think after being in this process you would understand how precious an AMERICAN CITIZENSHIP is. Of course some you know what they say. WHAT YOU BELIEVE IS THE TRUTH AND DON'T LET FACTS GET IN THE WAY.

Your wife has to file for it at the Consulate. You don't have to be there, but you need to send proof of physical presence in the US for 5 years, two of which after age 14. High school & college transcripts for example. You can send these to your wife and she can use them for the applications.

Tolly reacted to alexpop13 in Do 4 hrs & 20 mins layover in poe Atlanta/Detroit enough??I'm on K1 Visa coming from Philippines
I came through Detroit (DTW). Arrived at 5 PM and it was just one international flight at that hour so it went really smooth. I had to go to secondary, but it only took me 10 minutes there. From the moment I got out of the plane and the moment I left the airport it only passed 40 minutes, but this can vary. I would choose Detroit. I know Atlanta is one of the busiest airport in the world and it's huge.

Tolly reacted to pushbrk in cr1 denied
Yes, the previous answer was complete nonsense. An I-601 waiver is for that purpose.
The 221g is not where you should focus. It's just a general code referring to a section of the Immigration laws. Your visa was denied because the Consular Officer believes your relationship with your current wife is for immigration purposes only, and that you are still in a Genuine relationship with the mother of your children.
In a few months, your wife will receive from USCIS a Notice of Intent to Deny (NOID) indicating the reason(s) the Consulate gave for recommending they revoke their approval of the I-130 petition your wife filed in your behalf. That notice will provide the means for your wife to respond and request they re-affirm the approval instead.
What you do now, is write a very detailed report for your wife, of exactly what happened at the interview, including all questions asked, in order, and your answers. Make this report as close to verbatim as possible. Then, explain fully candidly to your wife, any reasons you can think of that could have caused the Consular Officer to conclude you are still in a relationship with the parents of your children. Be aware that although unknown to you, they may have spoken to your neighbors or even receive a letter or other communication with the mother, prior to the interview.

Tolly reacted to SusieQQQ in WASSCE RESULTS
Please stop using all capitals.
It's not entirely clear what the exact Ghana requirements are for DV, however the usual requirement is that the high school diploma is enough to enter a US 4-year college. The embassy does state what the college entry requirements are:
"The minimum university standard for admission to post-secondary education is a C- average on the SSSCE or WASSCE, with credits (A-D or A1-C6) in all subjects. U.S. universities should not admit Ghanaian students who have not attained at least this level. Students are expected to retake exams in subjects they have failed." See more detail at
http://ghana.usembassy.gov/mobile//education-of-ghana.html
Suggest also if possible you find a Ghana forum/thread where you can ask previous winners what they had to show for high school.

Tolly reacted to Ebunoluwa in AOS interview
They want to see a co mingled finances among other things like both names on the mortgage/deed, lease, joint
CC, joint bank account, joint health insurance, joint phone bills, 401K , jointly filed taxes, trips, photos here with family, etc.....
Even though you are getting ready for the AOS interview, look in the guides for ROC and you can see a list of items
that you can take to the interview if you have them and have an idea what you will need 2 years from now for ROC.

Tolly reacted to jan22 in Visa revoked , help
It's not just a waiver you need to apply for...you do need a waiver of the 5 year ban. But, all that does is give you the ability to apply for a new F1 visa. During the visa interview, you will have to explain how/why you were working illegally in the US and how you can now support your studies without doing so again. Plus, you will have to demonstrate your intent to abide by all US immigration laws that apply to your visa category -- which include not working without authorization and intending to leave the US at the end of your authorized stay. I suspect even if the waiver is approved allowing you to apply for a new visa you will have an uphill battle convincing the visa officer that you can afford to finish you studies and you have no intent of working in the US without authorization.
